Marbury v. Madison

Definition and stakes

Martin Van Buren,  Inquiry Into the Origin and Course of Political Parties in the United States

“ Marbury and his associates, with ample facilities for its prosecution in the inferior tribunals within their reach, (Judge Cranch, the reporter of the case of Marbury v. Madison, a full believer in the judicial as well as the political infallibility of the Chief Justice, being the Federal judge in the District) should have been given up, after the determination with which it had been asserted, and the care and favor with which it had been considered and elaborated by the Chief [292] Justice, would at the first blush seem not a little unaccountable. ”

Supreme Court of the United States,  Allen v. Milligan (2023)

“ The Constitution is supreme over statutes, not vice versa. Marbury v. Madison, 1 Cranch 137, 178 (1803) . Therefore, if complying with a federal statute would require a State to engage in unconstitutional racial discrimination, the proper conclusion is not that the statute excuses the State’s discrimination, but that the statute is invalid.
If Congress has any power at all to require States to sort voters into congressional districts based on race, that power must flow from its authority to “enforce” the Fourteenth and Fifteenth Amendments “by appropriate legislation.”

Portrait of William Howard Taft William Howard Taft,  Myers v. United States (272 U.S. 52…

“ We are asked by the United States to treat the definite holding in Marbury v. Madison that the plaintiff was not subject to removal by the President at will as mere dictum-to disregard it. But a solemn adjudication by this court may not be so lightly treated. For 120 years that case has been regarded as among the most important ever decided. It lies at the very foundation of our jurisprudence. Every point determined was deemed essential, and the suggestion of dictum, either idle or partisan exhortation, ought not to be tolerated. ”
