“ When it was first noised abroad that Senator Stanford was to found a new university in California, sundry Eastern men took a sneering tone and said, "What will it find to do? The young men on the Pacific coast who are as yet fit to receive the advantages of a university are very few; the State University of California at Berkeley is already languishing for want of students." ”

“ Other colleges are: The University of Southern California, Los Angeles, with its school of agriculture at Ontario and theological school at San Fernando; the Roman Catholic colleges at San Francisco, Los Angeles, Oakland, and Santa Clara; the Pacific Methodist, at Santa Rosa; California College, at Oakland; Pomona College, at Claremont; and the University of the Pacific at San José. The Cogswell Polytechnic College, at San Francisco, is maintained by the city. There are theological schools at Oakland, San José, and San Rafael; art schools at San Francisco, San Diego, and Sacramento. ”

“ This law of the state, called the organic act, provides that 'any resident of California, of the age of fourteen years or upwards, of approved moral character, shall have the right to enter himself in the University as a student at large, and receive tuition in any branch or branches of instruction at the time when the same are given in their regular course, on such terms as the Board of Regents may prescribe.' Barrows, Ph. D., professor of Political Science at the university, was elected President of the institution, to fill the vacancy created by the resignation of Dr. ”

“ Nearly one-half of the university's students are women. A relatively large proportion of the students pursue the general academic courses, as compared with the technical or professional courses. It is to be noted, furthermore, that a relatively large proportion choose courses which may be termed humanistic; those namely in languages, literature, history, and philosophy. Hardly more than 5 per cent. of the student body are non-residents of the State. ”

“ In all the other important universities the percentage of women has materially increased, and in some instances passed the fifty-per-cent. mark. Thus in 1900 the course in literature, arts and general science showed at the University of California 55 per cent, women ”

“ Physical culture and hygiene are prescribed for all men and women. A state law forbids the sale of liquor within one mile of the university grounds. To realize the ideal of the university as the head of the educational system of the state, a system of inspection of high schools has been developed, whereby schools reaching the prescribed standard are entitled to recommend their graduates for admission to the university without examination. It was anticipated at one time that the foundation of the Leland Stanford Junior University at Palo Alto would injure the state institution at Berkeley ”

“ Executive Officers shall have attained junior standing as defined by the UCI Registrar by the time of assuming office.
5. Executive Officers shall have been registered students at the University of California, Irvine for an entire academic year immediately prior to assuming office. 6. An Executive Officer shall forfeit his/her office within one (1) week upon failing to maintain at least a 2.0 overall grade point average on a 4.0 scale during his/her term in office. 7. An Executive Cabinet member must be present at all meetings in order to cast votes. Voting by proxy will not be permitted. ”

“ Then, because of their religious and conscientious objections, they declined to take the prescribed course, and solely upon that ground the regents by formal notification suspended them from the University, but with leave to apply for readmission at any time conditioned upon their ability and willingness to comply with all applicable regulations of the University governing the matriculation and attendance of students. The University affords opportunity for education such as may not be had at any other institution in California except at a greater cost which these minors are not able to pay. ”

“ The university shall be entirely independent of all political or sectarian influence and kept free therefrom in the appointment of its regents and in the administration of its affairs, and no person shall be debarred admission to any department of the university on account of race, religion, ethnic heritage, or sex. ”

“ There are no dormitories. Student self-government works through the “Undergraduate Students’ Affairs Committee” of the Associated Students. The faculty of the university has its own social club, with a handsome building on the grounds. ”

“ Within twenty years every state in the Union had taken advantage of this splendid endowment, either to found a new state university which would comply with the requirements as regards courses of instruction or to establish an agricultural college as an independent institution, or in connection with some already existing institution. Not only do some of the finest state universities like those of California, Illinois, and Minnesota owe their origins to the Morrill Act, but others owe to it their real beginnings as institutions of collegiate grade. ”

“ Stanford gave the state of California $20,000,000 to be used in founding at Palo Alto a university whose curriculum shall not only include the usual collegiate studies, but comprise instruction in telegraphy, type-setting, type-writing, journalism, book-keeping, farming, civil engineering, and other practical branches of education. ”

“ The appellants are the above-named minors and the fathers of each as his guardian ad litem and individually. They are taxpayers and citizens of the United States and of California. Appellees are the regents constituting a corporation created by the state to administer the University, its president, and its provost. Appellants applied to the state Supreme Court for a writ of mandate compelling appellees to admit the minors into the University as students. ”

“ They have not even been required in any absolute or peremptory way to join in courses of instruction that will fit them to bear arms. If they elect to resort to an institution for higher education maintained with the state's moneys, then and only then they are commanded to follow courses of instruction believed by the state to be vital to its welfare. ”

“ Among those institutions giving an economic course in the freshman year are some small and some large institutions (some of the latter being Stanford, New York University, Pennsylvania, Bryn Mawr, and the state universities of California, Iowa, Nebraska, North Dakota, Colorado, Utah) . Frequently the elementary course given to freshmen is in matter and method historical and descriptive, rather than theoretical, and is planned to precede a more rigid course in the principles. ”

“ There are valuable deposits of iron ore, coal, copper, tin, platinum, manganese, asphalt, petroleum, lead and zinc. Fruits are abundant, of great size, and are sold in all the Eastern markets.
The constitution of California requires a free school to be supported in each district six months in each year, and the system includes primary and grammar schools, high schools, evening schools, normal schools, technical schools, and the State University, which is free to both sexes, and is a perpetual public trust. The schools of California are justly famous. ”

“ When the colleges were founded, an institution for women was one of the first to be organized. When the State University came into being, women students soon had their places, and today half the students of college and university age in the state are women. Women teachers are found in educational institutions of every type.
Earlier than most states, California admitted women to her colleges of medicine and law, with the result that these professions have their quota of distinguished women. ”

“ Joel Hawes received his first request to provide a missionary for that settlement, he asked a friend of mine, 'Where is Kick-a-go?' That little settlement of 'Kickago' has now received a fund of more than three million dollars for a city library. When our academy was founded, no man in Andover suspected that California would become one of our United States; but California has recently received twelve million dollars for the founding of a University. I was acquainted with the founder of Smith College in Northampton, and also with the founder of Abbot Academy. ”

“ But that contention cannot be sustained, for we are unable to say that every question that appellants have brought here for decision is so clearly not debatable and utterly lacking in merit as to require dismissal for want of substance. [2]
The allegations of the petition do not mean that California has divested itself of any part of its power solely to determine what military training shall be offered or required at the University. ”

“ Public members shall serve for four years, except that one each of the initially appointed members selected by the Speaker of the Assembly, the President Pro Tempore of the Senate, and the Governor shall be appointed to serve for two years; student, alumni, and faculty members shall serve for one year and may not be regents of the university at the time of their service on the advisory committee. ”

“ The peculiar conditions in which this university finds itself are not easily stated to the public. There are internal reasons why we can not well take the country into confidence. Some of these reasons are connected with the relations of the Stanford heirs. Others arise from our relations to our future partner, in whose power we are, until the government suit is disposed of, that is, until the settlement of the estate. The grounds of the government suit, in brief, are these. The Central Pacific Railroad was regarded as an impossibility by most of the people of California. ”

“ Art. I, § 21, of the California Constitution, [11] and § 601 of Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. § 2000d. [12] The University cross-complained for a declaration that its special admissions program was lawful. The trial [p279] court found that the special program operated as a racial quota because minority applicants in the special program were rated only against one another, Record 388, and 16 places in the class of 100 were reserved for them. ”

“ So long as the university proceeds on an individualized, case-by-case basis, there is no warrant for judicial interference in the academic process. If an applicant can establish that the institution does not adhere to a policy of individual comparisons, or can show that a systematic exclusion of certain groups results, the presumption of legality might be overcome, creating the necessity of proving legitimate educational purpose.↑ . ”

“ All books, whether borrowed by faculty or students, must be regularly charged at the Loan Desk.
4. The use of the seminar rooms is restricted to professors and instructors and to students for whom the privilege has been requested by them. Unauthorized persons must not be admitted by students. Seminar room doors must not be left open, excepting when classes are being held in the rooms.
5. Seminar rooms must be vacated by students when the library is closed. ”

“ Academic Unit apportionment shall be as follows; undergraduate student enrollment of less than 2,000 shall entitle the Academic Unit to one representative, undergraduate enrollment of 2,000 but less than 4000 shall entitle the Academic Unit two representatives and undergraduate enrollment of 4,000 or greater shall entitle the Academic Unit to three representatives. ”

“ ADMINISTRATIVE RULES AND REGULATIONS I. Library Privileges, including the right to draw books for home use, are allowed to:
1. Regents, faculty, and officers of the University holding Regents’ appointments, and, on application, officers of institutions of higher learning in Berkeley.
2. (a) Registered students, graduate and undergraduate of all departments in Berkeley. ”
