Designation

“ Designation of Origin Act is intended to establish a strict system and order in the application for and the examination of the registration of the place name of origin and the protection of the rights to the place name of origin, thereby contributing to the preservation of the quality of special products and to the protection of the interests of the institutions, enterprises and organizations turning out special products. ”

“ Or again, if the terms were anything like these, “Go into the city to such a man, who resides in this or the other place, in such and such a house,” then the note thus given of the place and the designation of the house would make it quite possible to understand the commission delivered, and to execute it. ”

“ Effect Of Revocation.—The revocation of a designation under paragraph (5) or (6) shall not affect any action or proceeding based on conduct committed prior to the effective date of such revocation. “ (8) Use Of Designation In Trial Or Hearing.—If a designation under this subsection has become effective under paragraph (2) an alien in a removal proceeding shall not be permitted to raise any question concerning the validity of the issuance of such designation as a defense or an objection. ”

“ In the last two classes the designation of the party, plaintiff or defendant, is in the singular number, but the designation is intended to embrace all the persons who are on one side, however numerous, so that each distinct interest must be represented by persons, all of whom are entitled to sue, or are liable to be sued, in the Federal courts. ”

“ When the designation in the notice appears to be a trade name, an accepted alternative de8ignation, or similar variant under which the public may be able to identity the claimant, a new application will be requested, reflecting the designation in the notice, the full name, and the relationship between them. ”

“ The legislature may focus on a particular group or class only when the group designation is a 'shorthand phrase' for the feared characteristic-i.e., when it is common knowledge that all, not just some, members of the group possess the feared characteristic and thus such legislative designation would require no legislative fact-finding about individuals. ”

“ Every person must be registered and have always on his person a brass medal hung by a chain about his neck, bearing his designation and number, with the letters designating his group, domicile, also district, ward, and arrondissement. ”

“ If the Governor fails to submit the list in whole or in part, as required under subparagraph (A) , the Administrator shall promulgate the designation that the Administrator deems appropriate for any area (or portion thereof) not designated by the State. (iii) If the Governor of any State, on the Governor’s own motion, under subparagraph (A) , submits a list of areas (or portions thereof) in the State designated as nonattainment, attainment, or unclassifiable, the Administrator shall act on such designations in accordance with the procedures under paragraph (3) (relating to redesignation) . ”

“ The Secretary of State, with the concurrence of the Attorney General in cases involving designations of authority to officers of the Department of Justice, is authorized to make additional designations provided for in the Convention or to modify the designations made by this order. ”

“ The central and most indispensable substance of every language is made up of designations for things, properties, acts, the apprehension of which is nearly as old as humanity itself, which men learned to name as soon as they learned to talk at all, and whose names are not liable to pass away or become superseded. ”

“ On the day or days and between the hours fixed for registration by Presidential proclamation, every man required to do so under the foregoing provisions shall present himself for and submit to registration before a duly designated registration official or the local board having jurisdiction in the area in which he has his permanent home or in which he may happen to be on that day or any of those days. ”

“ Classification of persons whose names are included in the register. 5. (1) Every person whose name is included in the register shall be classified by the Director-General as a white person, a coloured person or a Black, as the case may be, and every coloured person and every Black whose name is so included shall be classified by the Director-General according to the ethnic or other group to which he belongs. ”

“ The pivotal language of § 10 (b) (3) , for present purposes, is the statute's proscription of pre-induction judicial review 'of the classification or processing of any registrant * * *.' I take the phrase 'classification or processing' to encompass the numerous discretionary, factual, and mixed law-fact determinations which a Selective Service Board must make prior to issuing an order to report for induction. ”

“ I do not understand that phrase to prohibit review of a claim, such as that made here by petitioner, that the very statutes or regulations which the Board administers are facially invalid.
'Classification is the key to selection,' 32 CFR § 1622.1 (b) , and among a local Board's most important functions is 'to decide, subject to appeal, the class in which each registrant shall be placed.' 32 CFR § 1622.1 (c) . Classification is a highly individualized process, in which a Board must consider all pertinent information presented to it. ”

“ Every person subject to registration is required to familiarize himself with the rules and regulations governing registration and to comply therewith.
(b) Every person is deemed to have notice of the requirements of title I of the Selective Service Act of 1948 and of the rules and regulations prescribed thereunder upon the publication by the President of a proclamation or other public notice fixing a time for registration. ”

“ But why of all troubles the trouble of a Registry should be only grievous, I can't tell, unless because it puts an End to Strife: Is it such a mighty trouble for an Attorneys Clerk, when he is to enter up a Judgment, to step into the Registry and leave an Entry made of it? and is it such a great trouble for a Man when he has sealed a Deed to go to the Register to acknowledge it? ”

“ A person who wishes to change his existing first name or middle name shall make an application therefor to a local registrar in charge of the locality where his name is entered in a household register in conformity with the law on civil registration. ”

“ That the respondents have a perfect and indefeasible title to soil and jurisdiction up to the existing line, by prescription, a title resting on a possession of more than a century, the highest and most sacred of the titles of nations. ”

“ Where an incorporated association has passed a special resolution for the change of its name, the public officer of the incorporated association may make application to the Registrar for his approval to the change of name. ”

“ That no person claiming to be registered in the district in which he resides in respect of any of the qualifications (c) , (d) , (e) and (f) , shall be registered in respect of the same qualification in the district in which he has his principal place of business or employment or vice versa. ”

“ There are conceptions, and classes of conceptions, of so obvious and practical character, that their designations are to be found in every language that exists or ever has existed: there are hosts of others which one community, or many, or the most, have never reached. Does a given tongue show that the race which speaks it has devoted its exclusive attention to the more trivial matters in the world without and within us, or has it apprehended higher things? ”

“ That every rector, vicar, curate, and every registrar, registering officer, and secretary, who shall have the keeping, for the time being, of any register book of births, deaths, or marriages, shall at all reasonable times allow searches to be made of any register book in his keeping, and shall give a copy, certified under his hand, of any entry or entries in the same, on payment of the fee hereinafter mentioned; that is to say, for every search extending over a period not more than one year, the sum of 1s., and 6d. ”

“ The institutions, enterprises, organizations and citizens that hold the industrial design rights shall submit an application to the industrial design registration organ for any change of the name, address and others within the term of protection. The industrial design registration organ shall register the particulars of change in the State industrial design register. ”

“ So, too, are grown folks interested in the Order. If you have passed your eighteenth birthday, and have not previously held a certificate of membership, send your name and address and use the letter "D." Members are urged to send names and addresses of their friends, that we may give Patents to them. Your teacher may be made a Patron.
To all who comply with these suggestions we will send Patents in the Order, bearing their names, creating them Founders, Knights, Ladies, or Patrons. The advantages of belonging to the Order will be attached—and there are many. ”

“ An appeal to the chief registrar in the case of the refusal of an assistant registrar to register a society or an amendment of rules, and in the case of suspension or cancelling of registry, is interposed before appeal is to be made to the High Court. ”

“ I answer that, In designating a man for the episcopal office, something has to be considered on the part of the person designate, and something on the part of the designator. For on the part of the designator, whether by election or by appointment, it is required that he choose such a one as will dispense the divine mysteries faithfully. ”

SURNAMES OF OFFICE. A class of surnames which occupies no mean place in our lists is that which has been bequeathed to us by the dignitaries and officers of mediæval times. ”

“ Provided, That if upon any register from which certification is to be made there are the names of eligibles who have, under section 1754 of the Revised Statutes, claim of preference in civil appointments, the names of such eligibles shall be certified before the names of other eligibles higher in grade. The Commission shall make regulations that will secure to each of such preference-claiming eligibles, in the order of his grade among other preference claimants, an opportunity to have his claim of preference considered and determined by the appointing officer. ”

“ The registration at each office will be for both land districts, but at the time of registration each applicant will be required to elect and state in which district he desires to make entry. To obtain registration each applicant will be required to show himself duly qualified to make homestead entry of these lands under existing laws and to give the registering officer such appropriate matters of description and identity as will protect the applicant and the government against any attempted impersonation. ”

“ In conclusion, I can only repeat that the choice of the system of arrangement depends more upon the tastes of the collector himself than upon any other consideration; but that, on the whole, the balance of advantages appears to incline in favour of the alphabetical classification under surnames, keeping each family as distinct as the information, heraldic and other, on the plates will allow. ”

“ No one is removed from a list of eligibles by the mere fact that he is not kept upon another list of higher or superior degree.
14. Inscription upon a list of eligibles is necessary only with reference to those of the public officers for which that condition is expressly required by the constitution or the law. The list of eligibles shall be formed for the first time during the course of the Year IX.
Citizens who shall be selected for the first formation of the constituted authorities, shall form a necessary part of the first lists of eligibles. ”

“ If at any time the Director-General doubts whether any such classification is correct he may, after notice to the person in question and, if such person is a minor, also to his guardian, refer the case to a board for decision as to whether the classification of that person in the register should be altered. ”

“ The object of the section was to give to lotholders deriving title from a common source-from the authorities of a pueblo or town, or from an individual who was originally the grantee of the land upon which the pueblo or town is situated-the benefit of the examination by the board of the general title under which they hold, and relieve the commissioners from the necessity of considering a multitude of separate claims for small tracts depending upon the validity of the same original title. ”
