“ The management of the Administration shall be vested in an Administrator who shall be appointed from civilian life by the President, by and with the advice and consent of the Senate, and who shall be a person of outstanding qualifications known to be familiar and sympathetic with small-business needs and problems. ”

“ An occasional statute will require not only consultation, but the making of specific findings precedent to exercising powers delegated by Congress. “ In order to promote an efficient administration, the Minister may, at the request of an administrator, by notice in the Gazette publish a list specifying any administrative action or a group or class of administrative actions in respect of which the administrator concerned will automatically furnish reasons to a person whose rights are adversely affected by such actions, without such person having to request reasons in terms of this section. ”

Section II. Of the internal administration.
1. In each department there is a superior administration, and in each district a subordinate administration.
2. The administrators do not have any representative character.
They are agents elected at stated times by the people to exercise, under the surveillance and authority of the king, the administrative functions. ”

“ In case a department or municipal administration should lose one or several of its members by death, resignation, or otherwise, the remaining administrators in filling the places can add to themselves temporary administrators who act in that capacity until the following elections. ”

“ In each province there shall be a chief executive officer appointed by the State President who shall be known as the administrator of the province, and in whose name all executive acts relating to provincial affairs therein shall be done. ”

Each department shall be under the general supervision of its own Direction, which shall select, and, in accordance with the General Direction, shall appoint, all such overseers, directors and agents, as shall be necessary to the complete and systematic organization of the department, and shall have full authority to appoint such persons to these stations as they shall judge best qualified for the same. ”

“ Each executive department and agency identified by the Secretary shall appoint a senior official, who is a full-time officer of the Federal Government, to report directly to the department or agency head with respect to department or agency activity under this order, and to serve as liaison to the Board and to the Initiative. ”

“ The Executive Department.—Legislative bodies occasionally take vacations; the executive is always on duty in person or through his subordinates. Popularly considered, the executive department of government consists of the president, the king, or the prime minister; actually it includes an advisory council or cabinet, which is responsible to its chief, but shares with him the task of the management of national affairs. ”

“ The first executive duty of the incumbent of office, therefore, is to keep his faculty under control, so as to be able unhampered to carry out the policy of magnitude and secularization with a view to which the governing board has invested him with his powers. ”

“ The Executive Director may also, with the consent of any board, commission, independent establishment, or executive department of the Government, including any field service thereof, avail himself of the services of the officials, employees, and the facilities thereof and, with the consent of the State or municipality concerned, may utilize such State and local officials and employees as he may deem necessary. ”

“ Each cabinet officer, again, controls his own department pretty much as he pleases, without consultation with the President or with his coadjutors, and often in the face of determinations which have been reached by the others. ”

“ The administrators of the executive power may be either elective or not; and in the former case all or only some of them may be elective. They are elective in a proper democracy, that is to say, in a democracy which recognizes representation. If all the public officials are directly elected by the whole people, the democracy is a pure democracy; if only some, it is a mixed democracy. The public officials may also fill vacancies themselves; this is the case in a pure aristocracy. ”

“ It is of course true that as an establishment increases in size, or as a combination increases the number of its branches, especially if they are widely scattered, it becomes impossible for the manager to give his personal supervision to the details of management of each institution. An executive officer of the highest skill, however, will so select his subordinates, so direct their work, and so infuse into them his own spirit, that, under careful inspection, comparatively little will be' lost from his inability to be present personally in each separate establishment. ”

“ The constantly increasing functions of the modern state have made the executive and administrative departments the most important and powerful branches of government, and the increasing complexity of governmental machinery has rendered it absolutely essential that competent and trained public officials should be chosen. Government has become an extremely difficult and scientific business, and special capacity, training and expert knowledge are [Pg 221] more and more required in executive and administrative office. ”

“ It will be observed that there are two usages or laws in existence—one of these would be the general law, regulating an institution of that kind, which would be applicable to a university, a co-operative institution, a shoe establishment, such as we have, or any other well regulated institution. In our co-operative institution here in the city, there is a President and Board of Directors; they appoint the Superintendent. He has the charge of the buying, selling, engaging, or dismissing men, making contracts, and generally supervising and manipulating all the affairs of the institution. ”

“ Article 7 (Authority and Responsibility of Head of Administrative Agency) (1) The head of each administrative agency shall take overall charge of the affairs under his jurisdiction, and shall direct and supervise his subordinate public officials. ”

“ Departmental chiefs can be made responsible for their work only by being subordinated to a chief executive whose duty it is to keep his eye on his subordinates and who is accountable to the people for the efficient conduct of all the administrative offices. ”

“ When all have the rank and title of assistant general manager, this duality of function is the more pronounced and valuable. For the feudal notion of unbalanced components is substituted the cabinet idea of comprehensive deliberation, unified administration and devotion to a common purpose. ”

“ Reports and exhibits from the several departments accompany this communication, and the Executive will always be ready to furnish, with pleasure, such information to the honorable Congress as may develop and explain the minutest transactions of the administration. The ability, fidelity, and economy with which the business of the several departments has been conducted, leave him no ground for wishing to eschew the examination; and, on his own part, the most rigid accountability. ”

“ A similar distinction exists in regard to the constitution of the executive departments of administration. Their machinery is good, when the proper tests are prescribed for the qualifications of officers, the proper rules for their promotion; when the business is conveniently distributed among those who are to transact it, a convenient and methodical order established for its transaction, a correct and intelligible record kept of it after being transacted; when each individual knows for what he is responsible, and is known to others as responsible for it ”
