Mens rea

Definition and stakes

Antonin Scalia, Anthony Kennedy, Clarence Thomas, and Samuel Alito,  National Federation of Independent Business v… (2012 | noyear)

“ The last of the feeble arguments in favor of petitioners that we will address is the contention that what this statute [p668] repeatedly calls a penalty is in fact a tax because it contains no scienter requirement. The presence of such a requirement suggests a penalty—though one can imagine a tax imposed only on willful action; but the absence of such a requirement does not suggest a tax. Penalties for absolute-liability offenses are commonplace. And where a statute is silent as to scienter, we traditionally presume a mens rea requirement if the statute imposes a "severe penalty." ”

“ As discussed below, the disparate intent requirements of premeditated murder and felony murder have life-or-death consequences at sentencing.↑ Arizona law has not been consistent on this point. Arizona cases have long said that "there is no lesser included homicide offense of the crime of felony murder since the mens rea necessary to satisfy the premeditation element of first degree murder is supplied by the specific intent required for the felony." ”

Supreme Court of the United States,  United States v. Hansen (2023)

“ Congress enacted the current version of the encouragement provision in 1986. It removed the mens rea requirement relating to the encouragement or inducement element—excising from the statute that a violator must “willfully or knowingly” encourage or induce a noncitizen to violate the immigration laws—while inserting a mens rea requirement for knowledge or reckless disregard of the noncitizen’s immigration status. ”
