“ The report also says that efficient service can be obtained by a municipal collection when the city conducts the work with its own teams and equipment and the men employed on the work are directly responsible to their superiors who in turn are responsible to the public for the service rendered. ”

Ecclesiastics, soldiers in active service, and persons receiving emolument from public funds are debarred from these offices. ”

“ A number of chief executive officers are elected for four years; the mayor and Council appoint others, and the appointment is made at the middle of the mayor's term in order to lessen the immediate influence of municipal patronage upon elections. Single commissioners control the parks, streets, water service, harbour and wharves, and sewers, and these constitute, with the mayor, a board of public improvement. Under an enabling act of 1907 the municipal assembly in 1909 created a public service commission, of three members, appointed by the mayor. ”

“ The beginnings of the coördinated social service under municipal control are already on the horizon. Take, for instance, the Board of Public Welfare of Kansas City, Missouri. This Board is four years old. Women are active on it as district superintendents, investigators, factory inspectors; in the social service department, parole department, department of lunches and unemployed, and women’s reformatory. ”

“ Thus duplication of work is occasionally found where the social workers of a hospital, of a settlement, and of a charity branch visit in the same day a tenement mother and force her to repeat the story of her problems. The only way in which such duplication can be avoided is through the organization 238of social service and the extension of municipal functions in that line. When the hospital is a municipal enterprise, its social service department would seem to be the proper and legitimate one to have the right of way and of support ”

“ Whether the board of public works is also a part of and an agency of the municipal corporation is the question before us.

The authorities state, and our own knowledge is to the effect, that the care and superintendence of streets, alleys, and highways, the regulation of grades, and the opening of new and closing of old streets, are peculiarly municipal duties. No other power can so wisely and judiciously control this subject as the authority of the immediate locality where the work is to be done. ”

It is certainly one of the most important branches of the municipal government. ”

“ In some localities the inhabitants have met together and voluntarily formed a municipal organization for the purposes of local government, adopting the form of a municipal constitution and charter, under which said officials have been appointed; and ordinances creating and regulating a police force, a fire department, a department of health, and making provision for the care of the insane and indigent poor and sick and for public schools, have been passed. ”

“ The law names certain things which each city charter shall provide, and imposes certain restrictions on the powers of cities. There must be an elected Mayor and a body vested with legislative power; the clerk, treasurer, and assessors, and other officers may be elected or appointed. This permits the establishment of a commission system, or of a Mayor and council with distinct powers. Provision must be made for the levy, collection, and return of State, county, and school taxes, for annual appropriations for municipal purposes, and for a system of accounts. ”

“ It is a mistake to think lightly of the importance of municipal office, or of the responsibilities which are attached to it, either on the part of the citizen, who, as a member of the council, conducts the affairs of the town, or of the citizen who plays the part of taxpayer—and complainant in general. ”

“ People's councils of municipalities directly under the central authority, and of municipalities divided into districts may set up bureaux, divisions, committees or commissions to take charge of civil affairs, public security, justice, supervision, planning, finances, food, taxation, industry, commerce, labour, culture, education, public health, physical culture and sports, projects of municipal construction, and public services ”

“ The government, as provided by the charter of 1867 and numerous amendments thereto, is vested in a mayor, who holds office for two years, and a common council, which elects all administrative officials, excepting the statutory municipal officers, who are chosen by popular vote. The city owns and operates the water-works. ”

“ The Provincial Councils and the City Councils are still functioning. The administrative framework of the country survives. The municipal organization, so solidly rooted, has not ceased to exercise power. ”

“ This municipal assembly shall be the Council of Administration, which shall establish for the entire extent of its jurisdiction the rules of the common regime, and shall decide on all that concerns the municipal police, its internal security, sanitary policy, the management and use of municipal revenues, local expenditures, and generally all that is within the jurisdiction of the municipalities.
Art. 43. The active power shall be entirely, and for all the extent of the municipal district, in the hands of the mayor and his lieutenant, who shall be elected immediately by the primary assemblies. ”

“ In some of these respects, as in the exercise of the police power, the care of the public health, the administration of charity, and the administration of local justice, the municipality is actually the agent of the State, and discharges duties of interest to the State at large; in others, as in the furnishing of water or light, the State permits the community as a whole to act as a local organization for the satisfaction of purely local needs of interest to the community only. ”

“ The several administrative departments are: public safety, public works, receiver of taxes, city treasurer, city controller, law, education, charities and corrections, supplies, wharves, docks and ferries, civil service commission and sinking fund commission (composed of the mayor, the city controller and a commissioner elected by a majority vote of the city councils) . ”

“ These are some of the tasks which cannot safely be intrusted to a municipality unless its government is above suspicion, unless men of probity and capacity are placed in power, unless the whole community extends its sympathy to the work and keeps a vigilant eye upon all the officials. Municipal governments cannot be encouraged to own public utilities so long as there is a risk that somebody may own municipal governments. ”

“ That in all cases the municipal officers who administer the local affairs of the people, are to be selected by the people, and that wherever officers of more extended jurisdiction are to be selected in any way, natives of the islands are to be preferred, and if they can be found competent and willing to perform the duties, they are to receive the offices in preference to any others. ”

“ The municipalities are in their area under their own responsibility the only public body responsible for the whole local public administration. They can take over any public duty if it is not by explicit legal regulation assigned exclusively to other bodies in urgent public interest.
(2) The municipal unions have within their legal responsibilities the same position.
(3) The right to self-administer their matters are provided to the municipalities and municipal unions by the state. The overseeing of the state is restricted to ensuring that the administration is in conformance with the laws. ”

“ The plan of delegating power to appointed experts has very recently been winning approval in municipal government, where it is commonly called the "City Manager " plan. A small body of commissioners are elected and held responsible for the city government; these men may remain in their private vocations, and draw a comparatively small salary from the city. ”

“ A prominent feature of the municipal government is the large number of public-spirited citizens who administer, without remuneration, important departments; among these may be mentioned the trustees of the Public Library, trustees of the City Hospital, overseers of the poor, Park Commission, boards governing the institutions for paupers, children, and insane ”

“ Of the administrative officials, only the license inspector and public weighers are appointed by the executive, the municipal council controlling appointments to all other offices except the following, which are filled by popular election: attorney, comptroller, commissioner of public works, marshal, engineer, tax collector, treasurer, and sexton. ”

“ The municipality shall autonomously, in accordance with the Law, adopt its budget and annual balance sheet, the urban development plan and municipal development programme, establish the symbols of the municipality, as well as their use.
The municipality shall see to exercising, protection and improvement of human and minority rights, as well as to public informing in the municipality.
The municipality shall autonomously manage the municipal assets, in accordance with the Law. ”

“ Municipal committees now exist in most places having any pretension to importance, and have charge of municipal business generally, including the care and superintendence of streets, roads, fairs and markets, open spaces, water supply, drainage, education, hospitals, and the like. ”

“ In addition to the foregoing duties and functions, the city administrator shall: (a) Assist in the coordination of the work of all the officials of the City under the supervision, direction and control of the city mayor, and for this purpose, he may convene the chiefs of offices and other officials of the City; (b) Establish and maintain a sound personnel program for the City designed to promote career development and uphold the merit principle in the local government service ”

“ A municipal corporation may act through its mayor, though its common council, or its legislative department by whatever name called, its superintendent of streets, commissioner of highways, or board of public works, provided the act is within the province committed to its charge. Nor can it in principle be of the slightest consequence by what means these several officers are placed in their position,-whether they are elected by the people of the municipality, or appointed by the President or a governor. The people are the recognized source of all authority, state and municipal ”

“ In the name of the state he exercises a certain administrative control over the local authorities, such as the canseil général, the mayors and the municipal councils. This control, though considerably restricted by the law of the 10th of August 1871, on the conseils généraux, and that of the 5th of April 1884, on municipal organization, still holds good in some important respects. ”

“ The Urban District.—Of areas within which are administered the local affairs of the urban portions of the kingdom there are several of distinct importance, although in reality the institutions of urban government are less complex than they appear on the surface to be. In the main, the legal basis of urban organization is the Municipal Corporations Consolidation Act of 1882, which comprises a codification of the Municipal Corporations Act of 1835 and a mass of subsequent and amending legislation. ”

“ It shall be proper for said cities to provide, by ordinance, for the exercise of all rights and powers herein conferred upon the City Planning Commission, by a park commission, or kindred municipal bureau or commission, authorized under existing laws. And no person holding office under the government of any of said cities, except the mayor, members of councils, or commissioners, shall be ineligible to serve as a member of a City Planning Commission. ”

“ The Land can oblige the municipalities and municipal associations by means of statutory regulations to assume and carry out certain public tasks, if arrangements are made to cover costs at the same time. ”

“ Resolved, that this Congress is of opinion that power should at once be granted to each municipality or County Council to establish workshops and factories under municipal control, where such persons shall be put to useful employment, and that it be an instruction to the Parliamentary Committee to at once take the matter in hand.' ... ”

“ Such a plan of town or community life, rather than city life, should be extended to every other large city in the Nation. A simple act of legislation, accompanied by a moderate appropriation for organization and educational work, would enable the department to put its facilities at the service of local communities and of the industries throughout the United States. ”
