National authority

“ The Palestinian National Authority shall work without delay to join regional and international declarations and covenants which protect human rights. ARTICLE 11 Personal freedom is a natural right, and shall be guaranteed and protected. It is unlawful to arrest, search, imprison, restrict the freedom, or prevent the movement of, any person, except by judicial order in accordance with the provisions of law. ”

“ ARTICLE 5 The governing system in Palestine shall be a democratic parliamentary system based on political and party pluralism. The President of the National Authority shall be directly elected by people. The Government shall be responsible to the President and to the Palestinian Legislative Council.
ARTICLE 6 The principle of the rule of law shall be the basis of government in Palestine. All authorities, powers, agencies, institutions and individuals shall be subject to law. ”

“ National politics have from the start aimed primarily at efficiency—that is, at the successful use of the force resident in the state to accomplish the purposes desired by the Sovereign authority. ”

“ Each Palestinian shall have the right to find sanctuary in the legal system. Litigation procedures shall be organized b law to guarantee prompt settlement of cases. Laws shall not make any decision or administrative work immune against judicial control. Judicial mistakes shall result in compensation by the National Authority. Conditions and methods of such compensation shall be regulated by law. ARTICLE 31 An independent commission for human rights shall be established by law, which will specify its formation, duties, and jurisdiction. ”

“ On the Government we can put our hand as a certain organization of ruling functions, the machinery of law-making and law-enforcing. The Administration is a recognizable group of political functionaries, temporarily in charge of the government. But the State stands as an idea behind them all, eternal, sanctified, and from it Government and Administration conceive themselves to have the breath of life. Even the nation, especially in times of war—or at least, its significant classes—considers that it derives its authority, and its purpose from the idea of the State. ”

“ A spirit of strict deference to the sovereign rights and dignity of every State, rather than a disposition to subordinate the States into a provincial relation to the central authority, should characterize all our exercise of the respective powers temporarily vested in us as a sacred trust from the generous confidence of our constituents. ”

“ If an enterprise owned by the whole people has been established with the approval of the competent authority of a province, autonomous region or centrally administered municipality or at a higher level and it has already been registered with the administrative agency for industry and commerce, before this Law comes into force, it shall automatically qualify as a legal person without having to re-register as such. ”

“ A High Judiciary Council shall be established by law with the Chief Justice as Chairman. The law shall establish the composition and powers of this Council as well as its rules of procedure. The opinion of the Council shall be taken in respect of draft legislation pertaining to the organization of the judicial authority, including the public prosecution. ”

“ This government, moreover, has this superiority over all others, that it combines the advantages of large and small States: it will be formidable without, owing to its power; laws will be enforced; it alone among Governments will contain at once subjects, persons in authority, and foreigners. ”

“ While it was the duty of Government to preserve order, it was also the duty of a Christian nation in occupation of a foreign country to govern it in the interests of the inhabitants, and, speaking for himself, he thought the executive authority would be strengthened, not weakened, by associating the people with the work of government. ”

“ A civil juristic act performed by a person for fulfilling his responsibilities assigned by a legal person or an unincorporated organization, within the scope of authority and in the name of the legal person or the unincorporated organization, is binding on the legal person or unincorporated organization. Restrictions imposed by a legal person or an unincorporated organization on the scope of authority of a person who performs the responsibilities assigned by the legal person or unincorporated organization are not effective against a bona fide third person. ”

“ In our complex system of polity, the public will, as a source of authority, may be the will of the people as composing one nation; or the will of the States in their distinct and independent capacities; or the federal will, as viewed, for example, through the Presidential electors, representing, in a certain proportion, both the nation and the States. ”

“ There shall be a Chief Justice, in that capacity, shall be the Head of the Judicial Authority and President of the Supreme Court. The Chief Justice shall be a judge of the Supreme Court appointed by Presidential Decree with the approval of the High Judiciary council except that the first Chief Justice appointed in pursuance of this Article shall not require such approval. ”

“ That the central government was created chiefly for matters of a general character, which concerned all the States and their people, and not for matters of interior regulation, is shown as much by the history of its formation as by the express language of the Constitution. ”

“ This system, sir, will at least make us a nation, and put it in the power of the Union to act as such. We shall be considered as such by every nation in the world. We shall regain the confidence of our citizens, and command the respect of others.

“ A party who provides false materials upon application for registration and thus causes damage to another person shall be liable for compensation. Where damage is caused to another person due to a clerical error upon registration, the registration authority shall be liable for compensation. After having made such compensation, the registration authority has the right to indemnification against the person who has made the error. ”

“ They were the fundamental principles for which civil society is organized into government in all countries, and must be respected in their administration under whatever temporary dominant authority they may be exercised. ”

“ How much more sublime is the idea of forming a great nation, by a chain of republicks, subordinate to publick good, than by a chain of satraps subordinate to imperial will, or of chartered companies subordinate to selfish avarice? Such a system stands upon national interest. No people, except ourselves, have seriously attempted to make this interest the basis of civil government. ”

“ The Federal and state governments are parts of one system, alike necessary for the common prosperity, peace and security, and ought to be regarded alike with a cordial, habitual and immovable attachment. ”

“ The government on the one hand should employ its armed force to eradicate all internal obstacles and, on the other, disseminate its doctrines to enlighten the people as well as to promote national unity. 7. As soon as a province is completely restored to order, the period of political tutelage will commence and the military period will come to an end. 8. In the period of political tutelage the government should send persons, qualified through training and examination, to various counties to assist the people in the preparation of self-government. ”

“ At last peoples have become conscious of their relations to the highest powers of the State, and have sought to give permanence and certainty to those relations by setting the conditions of their subordination fast in stubborn practices or in the solemn covenants of written documents. A constitution government has always had; but not until this latest age these deliberate formulations of principle and practice which determine the whole organization and action of the State, the domain of authority, the neutral territory85 of liberty, the postulates of obedience. ”

“ Let a single man be invested with executive and judicial authority." Master and owner of the state, he will, for his own sake, protect it against foreign foes, and provide for an impartial administration of justice; that his subjects, secured and enriched, may multiply and thus increase his wealth and power. ”

“ To make our States one as to all foreign concerns, preserve them several as to all merely domestic, to give to the federal head some peaceable mode of enforcing its just authority, to organize that head into legislative, executive, and judiciary departments, are great desiderata in our federal constitution. ”

“ To establish the condition of things essential to the recognition of this fact there must be a people occupying a known territory, united under some known and defined form of government, acknowledged by those subject thereto, in which the functions of government are administered by usual methods, competent to mete out justice to citizens and strangers, to afford remedies for public and for private wrongs, and able to assume the correlative international obligations and capable of performing the corresponding international duties resulting from its acquisition of the rights of sovereignty. ”

“ Security forces and the police are a regular force created for the service of the people, protection of society and to maintain security and public order. It shall perform its duties within the limits provided by law with full respect of rights and freedoms without prejudice or discrimination. All persons must cooperate with and assist the police in the performance of their duties. ”

“ Every person shall have right to freedom of thought, conscience and expression and publication of his opinion either orally, in writing or in the form of art or through any other form of expression, subject to observance of restrictions imposed by law for the respect of the rights or reputations of others, the protection of national security or of public order or of public health or morals. ”

“ The impracticability of one consolidated Government for this great and growing nation will be more apparent and will be universally admitted. Incapable of exercising local authority except for general purposes, the General Government will no longer be dreaded. In those cases of a local nature and for all the great purposes for which it was instituted its authority will be cherished. Each Government will acquire new force and a greater freedom of action within its proper sphere. ”
