“ It shall be permissible to reproduce a work if and to the extent deemed necessary for the purpose of judicial proceedings and of internal use in the legislative or administrative organs provided that such reproduction does not unreasonably prejudice the interests of the owner of author's property rights in the light of the nature of the work as well as the number of copies and the nature of reproduction. ”

“ Any person who praises, incites or propagates the activities of an antigovernment organization, a member thereof or of the person who has received an order from it, or who acts in concert with it, or propagates or instigates a rebellion against the State, with the knowledge of the fact that it may endanger the existence and security of the State or democratic fundamental order, shall be punished by imprisonment for not more than seven years. ”

“ In a case where the validity of a declaration of intention is to be affected by reason of absence of intention, fraud, duress, or by reason of knowledge or negligent ignorance of certain circumstances, the existence or non- existence of such reasons shall be determined on the basis of the agent. (2) In a case where an agent has been commissioned to do a specific juristic act and he has done such act in conformity with the principal’s instructions, the principal cannot set up the agent’s ignorance of any circumstances of which he himself was aware. ”

“ If the seller is unable to acquire and transfer the right to the buyer by reason of the fact that a part of the right which forms the object of a sale belongs to another, the buyer may demand a reduction of the purchase-price in proportion to the part. (2) If in the case of the preceding paragraph the buyer would not have bought the remaining part, had such alone been the object of the sale, the buyer acting in good faith may rescind the whole of the contract. (3) The bona fide buyer may claim damages besides claiming for a reduction of the purchase-price or the rescission of a contract. ”

“ If there is any reason to suspect of dishonest act or of material fact in contravention of any Acts, subordinate statutes or the articles of incorporation in connection with the management of affairs, any shareholder who holds shares representing no less than 3/100 of the total issued and outstanding shares may apply to the court for the appointment of an inspector to investigate the affairs of the company and the status of its property. ”

“ If both parents have parental authority, and one parent, under the names of both parents, represents its child or consents to a juristic act of the child, such representation or consent shall be valid even though it is contrary to the intention of the other parent except for the case where the other party is in bad faith. ”

“ Where an indivisible claim or obligation is converted into a divisible one with respect to the obligees or the obligors, each obligee may demand performance only in respect of his own share, and each obligor shall be liable for the performance only in respect of the share incumbent upon himself to perform. ”

“ Where the whole or a part of a insurance contract is null and void, if the policyholder and the insured have acted in good faith and without gross negligence, the insurer may be demanded to return the whole or a part of the premium. ”

“ If there is a custom which differs from any provisions of Acts or subordinate statutes which are not concerned with good morals or other social order, and if the intention of the parties to a juristic act is not clear, such custom shall prevail. ”

“ CHAPTER II. RIGHTS AND DUTIES OF CITIZENS Article 8 All citizens shall be assured dignity and value of human beings, and it shall be the duty of the State to guarantee such fundamental rights of the people to the utmost. Article 9 All citizens shall be equal before law, and there shall be no discrimination in political, economic, social, or cultural life on account of sex, religion or social status. No privileged caste shall be recognized, nor ever be established in any form. ”

“ Where a creditor of the seller desires to redeem the property in place of the seller, the buyer may extinguish the right of redemption by discharging the debt of the seller, out of the balance remaining after the amount to be repaid by the seller has been deducted from the value of the object, as assessed by an expert appointed by the court, and by paying the surplus, if any, to the seller. ”

“ If a person who has made a contract as an agent of another can neither prove his authority nor get the principal to ratify the contract, he shall be liable to the other party, at the latter’s option, either for the performance of the contract or for damages. (2) The provisions the preceding paragraph shall not apply if the other party was aware, or should have been aware, that such person had no power of representation, or if the person who made the contract as an agent had no capacity for entering into such contract. ”

“ Where several insurance contracts have been made simultaneously or successively with regard to the same subject-matter insured contract and the same events, if the total of the insured amounts exceeds the insurable value, the individual insurer has a joint and several liability up to the amount insured by each one. In this case, each insurer's liability for indemnification is subject to the ratio that the amount insured by each one has to the total insured amounts. ”

“ All persons who are arrested or detained shall have the right to prompt assistance of counsel. When a criminal defendant is unable to secure a counsel by his own efforts, the State shall assign the same for the defendant as provided by law. Article 11 No citizen shall be prosecuted for an act which does not constitute a crime under the law effective at the time it was committed, nor shall he be placed in double jeopardy. No restrictions shall be imposed upon the political rights of any citizen, nor shall any person be deprived of property rights by means of retroactive legislation. ”

“ When an insurer receives from a policyholder a payment of the whole or a part of the amount equivalent to the premium, as well as an application for an insurance contract, it shall dispatch to him a notice on whether it accepts the application or not within thirty days unless otherwise stipulated. If the insured of a personal insurance contract is to undergo a physical examination, however, the period shall run from the day on which he does it. ”

“ In case a person on active military service or an employee of the military forces, a police official or others as defined by law sustains damages in connection with the performance of official duties such as combat action, drill and so forth, he shall not be entitled to a claim against the State or public agency on the grounds of unlawful acts committed by public officials in the course of official duties, but shall be compensated as provided by law. Article 29 All citizens shall have the right to receive an equal education corresponding to their abilities. ”

“ Article 46 Members of the National Assembly shall have the duty to maintain high standards of integrity. Members of the National Assembly shall give preference to national interests and shall perform their duties according to the dictates of their conscience. Any member of the National Assembly shall neither acquire rights and benefits in property or other positions, nor assist other persons to acquire the same things, by means of contracts with or dispositions by the State, public organizations or industries in abusive exercise of his/her status as a member of the National Assembly. ”
