Deputy marshal

“ The deputy marshal did not put up the weapon, and the grin on his face grew deeper.
"Nobody, to look at you," said he, "would think you'd give an officer like me more trouble than any other man in the district. I had about the hottest run on record to chase you safely into the woods here. And now, by gum, here I've had to gallop myself all out of breath, barkin' my shins and skinnin' my elbows in a rough-and-tumble scoot through the underbrush, all to keep you from makin' a fool of yourself agin! It's enough to make a man resign office." ”

“ The appointment of special deputy marshals is not made by the statute a spontaneous act of authority on the part of any executive or judicial officer of the Government, but is accorded as a popular right of the citizens to call into operation this agency for securing the purity and freedom of elections in any city or town having 20,000 inhabitants or upward. Section 2021 of the Revised Statutes puts it in the power of any two citizens of such city or town to require of the marshal of the district the appointment of these special deputy marshals. ”

“ Frederick Warren, deputy marshal. I left the court room about five minutes before two o'clock—went down stairs—came back by the passage up to the supreme court—went to the closet, and there heard the shout; came out of the closet; found the crowd more dense than five minutes before, and the door being pulled and vibrating; proceeded to the city marshal's office, to notify the marshal, who said he could do nothing. I told him the crowd was forcing the door. I think I saw a white person near the corner of the recess, when I entered the closet. ”

“ The suggestions made in the circuit court, and renewed in this court, 'that there is no such official as a United States deputy marshal,' and that the marshal and his deputies have nothing to do with enforcing the internal revenue laws, are sufficiently answered by referring to the statutes. The Revised Statutes provide that every marshal may appoint one or more deputies, removable from office by the district judge or by the circuit court, and who take the like oath as the marshal, and for the faithful performance of whose duties the marshal is responsible upon his official bond. ”

“ The so-called deputy marshals provided for in this bill will have no executive head. The marshal can neither appoint nor remove them. He can not control them, and he is not responsible for them. They will have no authority to call to their aid, if resisted, the posse comitatus. They are protected by no criminal statutes in the performance of their duties. An assault upon one of these deputies with the intent to prevent a lawful election will be no more than an ordinary assault upon any other citizen. They can not keep the peace. ”

“ The deputy marshal is not in the constitutional sense an officer of the United States, and yet marshals, and deputy marshals are the persons chiefly charged with the enforcement of the peace of the United States, as that is embraced in the enforcement of federal law. ”

“ By section 2021, the marshal for the district was required, upon the application in writing of a certain number of citizens, to appoint a certain number of deputy marshals to aid and assist the supervisors in the verification of any lists of voters, and to attend the registration and election.
By section 2025, the circuit court was required to appoint, from among the circuit court commissioners, a chief supervisor, who should serve so long as he faithfully and capably discharged the duties imposed upon him. ”

“ No person shall be appointed a supervisor of election or a deputy marshal under the preceding provisions who is not at the time of his appointment a qualified voter of the city, town, county, parish, election district, or voting precinct in which his duties are to be performed. ”

“ Most of these men were of the lowest class, since only men of that kind would do the work required of them. The deputies were appointed, ten to twenty-five in each county, by Marshal Healy on the recommendation of the officials of the Republican party. Charles E. Mayer of Mobile, chairman of the Republican executive committee, nominated and secured the appointment of 217 deputy marshals, vouching for them as good Republicans, all except four Democrats who were warranted to be “mild, i.e. honest.” Robert Barbour of Montgomery and Isaac Heyman of Opelika also nominated deputies. ”

“ A marshal or deputy marshal of the United States is, it is true, not an officer appointed under a revenue law; but when engaged officially in lawful attempts to enforce a revenue law, by the arrest of persons accused of offenses against it, he is an officer acting under the authority of that law ”

I am goin' to be deputy marshal durin' her term of office, without pay, ladies an' gentlemen, an' I am goin' to lift every bit o' the work off'n her shoulders. I believe in equal sufferin'. “ PROVOST-MARSHAL, an executive officer, whose duty is to see punishments put in force, when soldiers are condemned to death, or are to be otherwise chastised. Every army is provided with a provost-marshal general, who has several deputies under him. By the last general regulations it has been ordained, that in case the army should take the field in Great Britain, a deputy provost-marshal will be appointed to each district. The provost, under those circumstances, will frequently make the tour of the camp, and its environs, and will have orders to seize such persons as are committing disorders. ”

“ The act of congress has limited the responsibility of the marshal to his own acts and the acts of his deputies.The keeper of a state jail is neither in fact nor in law the deputy of the marshal. He is not appointed by nor removable at the will of the marshal. ”

“ The public grand honors are given by all the brethren.
The new Grand Master then proceeds to install the rest of the Grand officers, each of whom is introduced with the same ceremony before the pedestal, and presented by the Grand Marshal.
The Grand Marshal first introduces the Deputy Grand Master, saying:
Most Worshipful Sir, you here see present at the pedestal, Brother C. D., who having been duly elected to serve the craft as their Deputy Grand Master, now declares himself ready for installation. ”

“ Malcomb McDowell, reporter for the Chicago Record, testified: “The United States deputy marshals and the special deputy sheriffs were sworn in by the hundreds about the 3d and 4th of July, and prior to that, too, and everybody who saw them knew they were not the class of men who ought to be made deputy marshals or deputy sheriffs.” * * * “In regard to most of the deputy marshals they seemed to be hunting trouble all the time.” * * * “At one time a serious row nearly resulted because some of the deputy marshals standing on the railroad track jeered at the women that passed and insulted them.” ”

“ Few men in this whole country have occupied a more marked position in the public mind, during all this struggle, than Superintendent Kennedy, in his legitimate position at the head of the Police and in what we must believe to have been his illegitimate one as Provost Marshal. ”

“ The importance of cavalry in medieval warfare led to the marshalship being associated with military command; this again led to the duty of keeping order in court and camp, of deciding questions of chivalry, and to the assumption of judicial and executive functions. The marshal, as a military leader, was originally a subordinate officer, the chief command under the king being held by the constable; but in the 12th century, though still nominally second to the constable, the marshal has come to the forefront as commander of the royal forces and a great officer of state. ”

“ The mass of people is too compact to admit of our addressing them in the Place. I ascend, with the Mayor, a few officers of the National Guard and two students of the Ecole Polytechnique, to the balcony of the Mairie. I raise my hand, the crowd becomes silent as though by magic, and I say:
“My friends, you are waiting for news. This is what we know: M. Thiers is no longer Minister and Marshal Bugeaud is no longer in command (applause) . They have been replaced by Marshal Gerard and M. Odilon Barrot (applause, but less general) . The Chamber has been dissolved. ”

“ These are especially due to the General Officers and Officers of the British Contingent; and he begs them to accept his best acknowledgments for the example they have given to others by their own good conduct, and for the support and assistance they have invariably afforded him to maintain the discipline of the Army. After a service of ten years‘ duration, almost without interruption, with the same Officers and troops, the Field Marshal separates from them with regret; but he trusts that they will believe that he will never cease to feel a concern for their honour and interest. ”

“ Like the lord high constable he rode into Westminster Hall with the champion after a coronation, till the coronation banquet was abandoned, taking his place on the left hand, and with the lord great chamberlain he assists at the introduction of all newly-created peers into the House of Lords.
The marshal appears in the feudal armies to have been in command of the cavalry under the constable, and to have in some measure superseded him as master of the horse in the royal palace. ”

“ I might also—if I sold out—manage a barrack-mastership, or become an inspector of yeomanry, or some such vulgar makeshift; but I own, my Lord, when a man has filled the places I have,—held staff appointments,—been a private secretary,—discharged high trusts, too, for in Mooraghabad I acted as Deputy-Resident for eight months,—it does seem a precious come-down to ask to be made a paymaster in a militia regiment, or a subaltern in the mounted police.”

“ It would not be in place here to discuss the growth of the office with the growth of the administration, just as the constableship developed in its descent from Miles of Gloucester through the Bohuns. The one point to keep in mind is that the office of marshal descended from Gilbert temp. Hen. I., to Roger Bigod, earl of Norfolk, at whose death in December (1306) , the marshalship, by his own arrangement, reverted to the king. ”

“ The United States marshals in the respective districts, the mayor and chief of police of any town or city, the sheriff of the respective counties in each State, all postmasters and justices of the peace, are authorized to act as special provost-marshals to arrest any officer or private soldier fit for duty who may be found absent from his command without just cause and convey him to the nearest military post or depot. ”

“ On the 21st of March, 1887, I wrote to Lord Dufferin regarding the relations of the district and police officers as follows: "The relations between Deputy Commissioners, District Superintendents (Civil Police) and Commandants (Military Police) are ill-defined and work badly, unless all are really good fellows. I have decided to keep the Commandant to his military work, and the District Superintendent of Police to the real civil police duty—intelligence, detection, and investigation. The Deputy Commissioner has by law supreme control and must exercise it.... ”

“ The following generals were distinguished as Marshals of the Empire (May 19th) : Berthier, Murat, Masséna, Augereau, Lannes, Jourdan, Ney, Soult, Brune, Davoust, Bessières, Moncey, Mortier, and Bernadotte; two marshal's bâtons were held in reserve as a reward for future service, and four aged generals, Lefebvre, Serrurier, Pérignon, and Kellerman (the hero of Valmy) , received the title of honorary marshals. In one of his conversations with Roederer, the Emperor frankly avowed his reasons for showering these honours on his military chiefs ”
