Historic preservation

“ Prior to the approval of any Federal undertaking which may directly and adversely affect any National Historic Landmark, the head of the responsible Federal agency shall, to the maximum extent possible, undertake such planning and actions as may be necessary to minimize harm to such landmark, and shall afford the Advisory Council on Historic Preservation a reasonable opportunity to comment on the undertaking. ”

“ Before a property within the jurisdiction of the certified local government may be considered by the State to be nominated to the Secretary for inclusion on the National Register, the State Historic Preservation Officer shall notify the owner, the applicable chief local elected official, and the local historic preservation commission. The commission, after reasonable opportunity for public comment, shall prepare a report as to whether or not such property, in its opinion, meets the criteria of the National Register. ”

“ Americans history lives throughout the Nation by the surviving examples of our man-made heritage-not only along the streets of our cities and towns but also in our rural areas. An indispensable element of the strength, the freedom and the constructive world leadership of this Nation is the knowledge and appreciation of our history, of who we are, where we are, and how we arrived here. ”

“ In paragraph (13) strike “archaeology” and insert “prehistoric and historic archaeology, folklore, cultural anthropology, curation, conservation, and landscape architecture”. (12) Add at the end thereof the following new paragraphs: “ (14) ‘Tribal lands’ means— “ (A) all lands within the exterior boundaries of any Indian reservation; and “ (B) all dependent Indian communities. “ (15) ‘Certified local government’ means a local government whose local historic preservation program has been certified pursuant to section 101 (c) . ”

“ Where consistent with agency missions and the Secretary of the Interior's Standards for Archeology and Historic Preservation, and where appropriate, agencies shall cooperate with communities to increase opportunities for public benefit from, and access to, Federally owned historic properties. ”

“ One of the most important sources of our sense of national direction is our architectural heritage-the historic sites, structures and landmarks that link us physically with our past. This great fund of cultural resources includes not only sites such as well-known battlefields and structures of national significance such as the homes of famous patriots, but also includes typical houses, office buildings, factories, and stores, and other public buildings such as post offices, courthouses, and railroad stations. ”

“ The National Park Service, in partnership with organizations and individuals dedicated to conservation and historic preservation, is ensuring that our national parks touch the lives of as many people as possible, while sparking an interest among our Nation's children in archaeology, ethnography, history, historic landscapes, and historic structures.
Indeed, the national parks remain a magnet for the American public. Every year millions of visitors flock to them-270 million in 1996. Surveying our history and heritage, our national parks let us reach out and touch the past. ”

“ Where the Commissioners of Works are of opinion that the preservation of any ancient or mediæval structure, erection, or monument, or of any remains thereof, is a matter of public interest by reason of the historic, traditional, or artistic interest attaching thereto, they may at the request of the owner consent to become the guardians thereof ”

“ Such uses of our historic man-made resources reflect our commitment to the enrichment of present and future generations of Americans, to preserve our historic past and to assure its enhancement and appreciation and to thus significantly contribute to the revitalization of rural, community and urban development. ”

“ It is the policy of the Federal Government to provide leadership in preserving America's heritage by actively advancing the protection, enhancement, and contemporary use of the historic properties owned by the Federal Government, and by promoting intergovernmental cooperation and partnerships for the preservation and use of historic properties. ”

“ For purposes of this section, the term “building arts” includes, but shall not be limited to, all practical and scholarly aspects of prehistoric, historic, and contemporary architecture, archaeology, construction, building technology and skills, landscape architecture, preservation and conservation, building and construction, engineering, urban and community design and renewal, city and regional planning, and related professions, skills, trades, and crafts. ”

“ Each Federal agency shall establish (unless exempted pursuant to section 214) , in consultation with the Secretary, a preservation program for the identification, evaluation, and nomination to the National Register of Historic Places, and protection of historic properties. ”

“ In General.—Each Federal agency that is responsible for the protection of historic resources, including archaeological resources pursuant to this Act or any other law shall ensure each of the following—
(1) (A) All actions taken by employees or contractors of such agency shall meet professional standards under regulations developed by the Secretary in consultation with the Council, other affected agencies, and the appropriate professional societies of the disciplines involved, specifically archaeology, architecture, conservation, history, landscape architecture, and planning. ”

“ For me purposes of this section the term—
(A) “designation” means the identification and registration of properties for protection that meet criteria established by the State or the locality for significant historic and prehistoric resources within the jurisdiction of a local government; and (B) “protection” means a local review process under State or local law for proposed demolition of, changes to, or other action that may affect historic properties designated pursuant to subsection (c) . ”

“ Federal undertakings that may affect historic properties; and (ii) the content and sufficiency of any plans developed to protect, manage, or reduce or mitigate harm to such properties; and (J) advise and assist in the evaluation of proposals for rehabilitation projects that may qualify for Federal assistance. (4) Any State may carry out all or any part of its responsibilities under this subsection by contract or cooperative agreement with any qualified nonprofit organization or educational institution. ”

“ Article 34 The State and society seek to preserve and develop the national cultural heritage; they take good care of preservation and museum work; they look after the repair and maintenance of, and seek to obtain the best effects from, historical vestiges, revolutionary relics, items of the national heritage, artistic works, and places with beautiful scenery. ”

“ The whole is depicted and for the time preserved in bronze and granite; and as generations of the future stand before this consecrated record, it will extort thoughts of the pioneer—his pleasures and his sufferings—with venerated admiration for those whose lives marked out the pathway of our civilization.
Every nation, every country, and every town has historic trees. They are not without influence on the destiny of individuals, societies, and nations. They are objects of reverence—works of time—homes of generations—and the manifest wisdom of creation. ”

“ In 1943, the Park Service allowed ranch owners at Aspen Valley to drive their cattle over the road, as gasoline and tire rationing prevented them from using trucks.99
Thomas C. Vint, chief landscape architect for the National Park Service, complained in 1948 about the incomplete central section of the road, writing that the "unsafe and inadequate outlet to the east via the Tioga route acts as a bottleneck." Vint supported the new construction, but warned that the preservation of the landscape in the area was "highly important." ”

“ More real good might at present be effected by any wealthy person who would devote his resources to the preservation of such monuments wherever they exist, by freehold purchase of the entire ruin, and afterwards by taking proper charge of it, and forming a garden round it, than by any other mode of protecting or encouraging art. ”

“ Buildings are being restored, plant life is being recorded, historic events are being dramatised for schoolchildren. And all of this has implications not just for our past heritage, but for our most important heritage-in-the-making: our young people. ”

“ If, to fill some private purses over-full, you thus callously rebuild historic cities, their history becomes merely a matter for the printed page, and themselves to the eye nothing but a congeries of crowded streets where the motor-omnibuses scream and clash and stink, and citizens hustle to get a living. History, without visible ancient buildings to assure the sceptical modern traveller that it is not wholly lies, will never by itself draw visitors. ”

“ It seems to be quite providential that the calamities of cities and the burial of treasures of art and knowledge should result in their preservation, and contribute to the education of the world. It is remarkable also that the explorers of the buried cities of the East should be the Christian nations of the West, and that such a wealth of discovery should enrich this nineteenth century. ”

“ The Nation shall regulate by law the conservation of the cultural treasures of the Nation, its artistic and historic wealth, and shall especially protect national monuments and places notable for their natural beauty or their acknowledged artistic or historic value. ”

“ What I wish for, therefore, is that an association should be set on foot to keep a watch on old monuments, to protest against all 'restoration' that means more than keeping out wind and weather, and, by all means, literary and other, to awaken a feeling that our ancient buildings are not mere ecclesiastical toys, but sacred monuments of the nation's growth and hope. ”

“ The Antiquities Act requires that any reservation of land as part of a monument be confined to the smallest area compatible with the proper care and management of the objects of historic or scientific interest to be protected. Determining the appropriate protective area involves examination of a number of factors, including the uniqueness and nature of the objects, the nature of the needed protection, and the protection provided by other laws. ”

“ They are landmarks of the generations which created them, and records of times and manners which we would fain believe that we have left behind in these days of better education and better thought. They are therefore of value to us as items of history, and, though we would not repeat many of them, we shall preserve them, not only because we reverence the graves of our forefathers, but because they are entitled to our protection as ancient monuments. ”

“ In the matter of conservation it is gratifying to be able to record an increasing realization by local bodies of their obligations in this direction and a recognition that the maintenance of ancient monuments is not entirely the concern of the Central Government. ”

“ They have all a regional environment of their own which determined their origin and growth. They have all a rich past, the monuments of which, generally to be found in abundance by careful, reverent inquirers, ought to be preserved; a past which ought to be known more or less to all the dwellers therein, and the knowledge of which will make the present more interesting. Even when old buildings have disappeared, ancient roads, pathways, and streets can be traced ”
