Moral judgment

“ The moral faculty is to the conscience, what taste is to the judgment, and sensation to perception. It is quick in its operations, and, like the sensitive plant, acts without reflection, while conscience follows with deliberate steps, and measures all her actions, by the unerring square of right and wrong. The moral faculty exercises itself upon the actions of others. ”

“ Apart from the question of the ultimate sanction of moral conduct, there have always been two explanations of the mental act variously known as "ethical judgment," "moral faculty," "moral sense" or conscience. On the one side there have been those who considered that moral judgment was an emotion, an intuition, or instinctive recognition of right or wrong, which implied no rational or intellectual process beyond [Pg 10] that which is involved in registering or perceiving the fact. ”

“ On all these grounds we conclude that moral judgment is essentially rational judgment. If a moral judgment is to satisfy the demands of objectivity, universality, impartiality, and authoritativeness, it must be based on reason. We have traced the evolution of moral judgment from its earliest beginnings in the life of the child, and have found that unless the judgment be based on reason it cannot be valid. ”

“ This, however, is a most important principle in regard to our moral decisions,—namely, the process by which we view an action, or a course of conduct, in another, and then apply the decision to ourselves. When the power of moral judgment is obscured or deadened in regard to our own conduct, by self-love or deranged moral habits, all the correctness of judgment is often preserved respecting the actions of others. ”

“ Since position and contact play so big a part in determining what can be seen, heard, read, and experienced, as well as what it is permissible to see, hear, read, and know, it is no wonder that moral judgment is so much more common than constructive thought. ”

“ Which developments are truly realisations of "the moral capability of man," and so tend to the attainment of ultimate good, and which developments are expressions of those capacities which seek an apparent good only and are to be classed as evil, as impediments to the realisation of the good,—these have to be discriminated; and is it so clear that from the mere record of human deeds we are able to draw the distinction? Do we not need some criterion of goodness to guide our judgment? ”

“ It is the want of a clear distinction between the logical process which determines the character of an act,—the moral judgment,—and the emotion which immediately supervenes when the character of the act is determined,—the moral feeling,—that accounts for the exaggerated epithets which are often attributed to the operations of the moral faculty, and for the haste and negligence in which men are consequently encouraged to indulge, when arriving at their moral decisions. ”

“ The sources of objective moral judgment in the world of time and circumstance are also thus laid open to the experience of each mind, in the power to consult the public judgment and to verify or correct the private judgment by it. ”

“ The terms stand for a step of discernment and judgment beyond these, and denote the ethical reality of good-desert or ill-desert for the moral agent who conforms to rightness, or offends against its claims. He who conforms deserves well; he that offends deserves ill. They, therefore, mark distinctly and definitely the point in the psychology of the conscience where the faculty discerns that those who do right ought to receive favor and those who do wrong ought to experience disfavor. ”

“ A third thing to be marked in this psychological analysis of the action of conscience, and revealing its nature, is the affirmation of right or wrong to particular acts or principles of conduct. In this the function of conscience passes from its fundamental idea into the form of an applicatory judgment. The ideas of right and obligation are applied to the actual affairs and activities of life. The quality of right or wrong is connected with particular actions, feelings or purposes, and these are affirmed to be right or wrong according as they have or have not such moral quality. ”

“ The highest morality demands, therefore, careful judgment. The factors to be considered are the complicated relations of men in the society of which the judge and actor himself is a member; morality may thus be identified with justice in the highest sense of the word. The decision is always a difficult one on account of the great complexity of the factors concerned; this every man perceives who endeavors, with unbiassed mind, to discover exactly what the most moral course is in any particular case. ”

“ We note how emphatically the field in which this wisdom is to be exercised is declared to be the moral conduct of life. 'Righteousness and judgment and equity' are 'wise dealing,' and the end of true wisdom is to practise these. ”

“ These are, I think, the two chief reasons which have led people to suppose that moral judgments are judgments about the will, rather than about the feelings, of some being or beings. And there are, of course, the same objections to supposing, in the case of moral laws, that the being or beings in question can be any man or set of men, as there are to the supposition that judgments about right and wrong can be merely judgments about men's feelings and opinions. ”

“ They concerned the powers and possibilities of man in the crowning endowments of his nature, and in the highest ascent of their evident intention and adaptation. They touched the great problems of personal and social welfare in the most vital relations and decisive interests. So the old sages became moralists and their great themes were the themes of virtue and duty. Not very deeply, however, did they, for centuries, succeed in penetrating the rational principles of the moral life and the authority of the moral judgments. ”

“ Thus upon the whole, 'tis impossible, that the distinction betwixt moral good and evil, can be made by reason; since that distinction has an influence upon our actions, of which reason alone is incapable. Reason and judgment may, indeed, be the mediate cause of an action, by prompting, or by directing a passion: But it is not pretended, that a judgment of this kind, either in its truth or falshood, is attended with virtue or vice. ”

“ And the perplexing phenomenon of wide diversity of moral judgments in daily life, to which we have had occasion several times already to refer, resulting from the different degrees of correctness with which the relations of life are understood and interpreted, enforces the same truth. The moral power is educable. It sees its objects in the light, not in darkness, nor fully in dawn. It acts best when flooded with the fullest knowledge. ”

“ It consists in asserting that when we judge an action to be right or wrong what we are asserting is merely that somebody or other thinks it to be right or wrong. That is to say, just as the last theory asserted that our moral judgments are merely judgments about somebody’s feelings, this one asserts that they are merely judgments about somebody’s thoughts or opinions. ”

“ But what of the voice and judgment of conscience? The difficulty is that we have a conscience behind our conscience, an intellectual one behind the moral. We can tell that the judgment of So-and-So's conscience has a past history in his instincts, his original sympathies or antipathies, his experience or want of experience. We can see quite well that our opinions of what is noble and good, our moral valuations, are powerful levers where action is concerned; ”

“ For moral philosophy is nothing else but the science of what is good, and evil, in the conversation, and society of mankind. Good, and evil, are names that signify our appetites, and aversions; which in different tempers, customs, and doctrines of men, are different: and divers men, differ not only in their judgment, on the senses of what is pleasant, and unpleasant to the taste, smell, hearing, touch, and sight; ”

“ Most startling diversities and contrasts are continually appearing. Hence it has often been said that our moral judgments rest, in fact, on no original and permanent principles discerned by a distinct and universal faculty of the soul, but are a purely adventitious and accidental product, shaped in ideas that come of circumstances,48 education or the shifting spirit of the age.13 The law of morality is reduced to the dictates of expediency or to sentiment and caprice born of our changeful desires. ”

“ We believe that a correct appreciation of psychology makes it abundantly clear that although there are many impulsive, instinctive and emotional factors totally unconnected with any rational or intellectual process which do, indeed, affect our moral judgments and give rise to ethical conventions, these factors can give no validity to moral codes ”

“ The human faculties of perception, judgment, discriminative feeling, mental activity, and even moral preference, are exercised only in making a choice. He who does anything because it is the custom, makes no choice. ”

“ Evidently he should reflect upon the moral judgments which he finds in himself, the moral being with whom he is best acquainted. He should endeavor to render consistent and luminous moral judgments which, as he finds, have too often been inconsistent and more or less blind. ”

“ When I attempt to convince any one that certain conduct which he considers right is wrong, by showing him that it is opposed to the general welfare, my final appeal is to his conscience. And in the same manner, when I correct some of my own moral conceptions, it is my conscience which determines me to the proof of them, and my conscience which is the standard that determines my decision. Conscience is the principle underlying my moral convictions. ”

“ If we look into the works on ethics, from Aristotle down to our own day—take up, for instance, the work of Herbert Spencer on the Data of Ethics, or that of Leslie Stephen on the Science of Ethics—I think you will find that in no two works is there any precise agreement as to what are the primary grounds of moral obligation. ”

“ We are aware of the attempts which have been made to invest our emotions with the stamp and attribute of morality: but, in addition to the testimony of our own experience, we have the highest authority for holding that none of the natural feelings or modifications of the human heart partake in any degree of a moral character. ”

“ For now let us observe that the ethical sentiment and idea, properly so-called, are independent of the ideas and sentiments above described as derived from external authorities, and coercions, and approbations—religious, political, or social. The true moral consciousness which we name conscience does not refer to those extrinsic results of conduct which take the shape of praise or blame, reward or punishment, externally awarded ”

“ As I consider virtue and vice to consist in action, and not in opinion, and as this action has its seat in the will, and not in the conscience, I shall confine my inquiries chiefly to the influence of physical causes upon that moral power of the mind, which is connected with volition, although many of these causes act likewise upon the conscience, as I shall show hereafter. The state of the moral faculty is visible in actions, which affect the well-being of society. ”

“ They both agree that the morality of an individual action is not a question of direct perception, but of the application of a law to an individual case. They recognise also, to a great extent, the same moral laws ”

“ The dispute of the moralists has reference, not to any characteristic of the qualities in conduct which we cognize as moral, but to the mode in which they are cognized. Our conception of such qualities involves the conception of absoluteness in them, and it is only by that notion of absoluteness that they are distinguished from the other qualities which appear in human conduct, such as wisdom, prudence, ingenuity, and the like. ”

“ You will see men who, so far as theory is concerned, will discourse eloquently concerning human justice and morality, yet they utterly disregard and ignore all moral restraints in their private character and practices. ”

“ They are the acts of the judging faculty in the sphere of applying the ethical distinctions and obligations. As a basis for the judgments, not only must the ethical distinction exist in the mind, but the action or conduct to be judged must be seen or understood in all its essential relations and motives. As duties are developed by relations, the moral character of the contemplated conduct or deed cannot be determined apart from a correct knowledge of those relations. The judging capacity will err without the light of true and full information concerning the place and purposes of the action. ”

“ If, indeed, the conscience reported entirely different codes throughout, from bottom to top and from center to circumference, or codes with contradictions as to the cardinal virtues and vices, then we might well50 question the existence and action of a real, original and normal faculty as actually perceiving a real moral distinction and principle of duty. ”

“ For though, while in obeying our fallible conscience, we have thus failed to bring our whole outward action in the case into harmony with full duty, or have even done what to others about us or to God above us was wrong, we have maintained our own subjective personal moral integrity, in maintaining that which is the fundamental and essential element of all morality, the right intention and effort. ”

“ The first problem which I have attempted to deal with is one which confronts all moralists. It consists in the difficulty of deriving ethical notions from notions which are not ethical, or of deducing the moral law from the facts of experience and of nature. ”

“ I propose therefore to begin our inquiry into the detail of goodness—into the particular kinds of conduct which the man wishing to do good for the sake of its goodness is entitled to count good—by considering what is of permanent moral value in the institutions of civil life, as established in Europe; in what way they have contributed and contribute to the possibility of morality in the higher sense of the term, and are justified, or have a moral claim upon our loyal conformity, in consequence. ”
