Submission

“ The doctrine of absolute submission in all cases, is an absurd dogmatical precept, with nothing but ignorance and superstition to support it; but, upon particular occasions, and where it is impossible for us to overcome, to submit patiently is one of the most reasonable maxims of life. ”

“ The important subject of subscription to the thirty-nine articles of religion had long been discussed at public meetings, in the newspapers, and in pamphlets and other works, and during this session, on the 6th of February, a petition from about 240 of the clergy and many professors of civil law and physic, was presented to parliament, praying relief from subscription to these articles The document was thus worded:—“Your petitioners apprehend themselves to have certain rights and privileges which they hold of God alone, and of this kind is the exercise of their own reason and judgment. ”

“ Those who cannot attend the convention, are urged to address letters to their representatives in congress, asking them to give as careful attention to the proposed amendment and to the petitions and arguments urged in its behalf, as though the rights of men, only, were involved. A delegate from each section of the country will be heard before the committees of the House and Senate, to whom our petitions will be referred. ”

“ President the bill which I have the honor to advocate to-day, and which is reported by a committee of the Senate, is the commencement, in my humble judgment, of an attempt to answer one of the demands which the people have authoritatively made. I speak advisedly. It is the commencement of an attempt to organize a system which shall respond to one of the demands which the people have made. ”

“ Look about, learn to know well-informed men who are truthful, and form of them an examining commission. When they begin to report, trust not over-much to papyrus, but verify here and there in person. I hear that thou hast the eye of a leader; if that be true, one glance will tell thee how accurate the statements of the commission are. ”

“ If there be a person in the crowd trying to present a petition, and working his way through the ranks, the person nearest to him must take the petition and present it to the sovereign in sight of the petitioner himself, so that all may know that the petition presented has reached its destination and consequently that there exists a control of affairs on the part of the sovereign himself. ”

“ Every man, whether inhabitant or foreigner, free or not free, shall have liberty to come to any public Court, Council, or Town Meeting, and either by speech or writing to move any lawful, seasonable, and material question, or to present any necessary motion, complaint, petition, bill, or information, whereof that meeting hath proper cognizance, so it be done in convenient time, due order, and respective manner. ”

“ It was agreed in Conference that this matter was more proper for Convocation than for Parliament, and, therefore, by a vote of the House of Lords, Convocation was requested
to prepare some canon or rule for that purpose, to be humbly presented unto his majesty for his assent. [37]
The other incident arose from the discovery of the Commons' committee that in one of the rubrics of the revised Book the word persons appeared to be written by mistake for children. ”

“ And in order that it may be discharged with a conscientious regard to truth, and a fidelity becoming its importance, you are bound by the solemn tie of an oath to execute this office without malice, without resentment, without favour, and without affection. Under this sacred obligation, your fellow-subjects have reason to hope and expect that you will hear with patience, enquire with diligence, judge with candour, and present with impartiality. ”

“ We, reposing trust and confidence in your care and faithfulness, have constituted, ordained, and appointed, and by these presents do constitute, ordain, and appoint you our commissioners, giving and granting unto you, or any two or more of you, full power and authority in pursuance of the said Acts and ordinances to put in execution all and every the instructions hereunto annexed, for the exact and perfect survey and admeasurement of all and every the honors, baronies, castles, manors, lands, tenements, and hereditaments, forfeited by force or vertue of all or any of the said Acts ”

“ But really great minds rise superior to such difficulties, and so did the “committee,” or some of them, or one of them. If they could not get genuine signatures to their petitions, they could at any rate manufacture them. ”

“ I shall state both the resolution and promise, that you may judge for yourselves.
The resolve of the Convention declares, that the Constitution should be submitted to a Convention of Delegates, chosen in each State by the people, under the recommendation of its legislature, for their assent and ratification.
Mr. C—— being called upon, before his election, to declare himself on this point, promises to the people, “that he will use his endeavours, if elected, to call a Convention.” ”

“ It was resolved upon this statute, by the two chief justices and divers other justices, at a committee before the lords in parliament, in the eighth year of James I., 1. That a convocation cannot assemble at their convocation without the assent of the king. 2. That after their assembly they cannot confer, to constitute any canons, without licence of the king. 3. When they upon conference conclude any canons, yet they cannot execute any of their canons without the royal assent. ”

“ We also declare to be valid, the admission of Judges, Councillors, Assessors and other Officers of said religion, by our Privy Council or by Commissioners appointed by us to act in case of the refusal of our Courts of Parliament, Excise and Exchequer, all to be as valid as if they were admitted by the said Courts and Chambers, or by the other Judges, to whom the right of admission belongs. ”

“ It may reverse or affirm the judgments, orders, or decrees of said . . . [commission] and may remand a cause to said . . . [commission] with such mandates as law or equity shall require; and said . . . ”

“ In 1791, according to the decrees, every meeting that wished to exercise the right of petition must consist of unarmed citizens, and be announced to the competent authorities twenty-four hours beforehand. ”

“ Your petitioner, and the people who ordained him, conceived his ordination was sufficiently notorious, as the article was subscribed by every member of the society; and the honourable court considered him a public teacher of Piety, Religion, and Morality. ”

“ Can Congress require one to register before he writes an article, makes a speech, files an advertisement, appears on radio or television, or writes a letter seeking to influence existing, pending, or proposed legislation? ”

“ Therefore, Our Will and Pleasure is, that in any Suit or Suits commenced, or to be commenced in any of our Courts at Westminister, or elsewhere, by the said Treasurer and Company, or otherwise against any such persons, that our Judges for the Time being, both in our Court of Chancery, and at the Common Pleas do favour and further the said Suits so far forth as Law and Equity will in any wise further and permit. ”

“ When one or more have been substituted in Court to conduct a Suit for another, in the manner before mentioned, whether the one can-230- delegate his authority to another, or whether one of the two can nominate the other, or a third, in his place, or in that of his Principal, to gain or lose for him in that Suit, are points at least questionable. ”

“ Whenever the legislature has accurately determined what are the facts which shall give commencement, and what those which shall give termination to a right, the whole confused and intricate mass of what in English law is called Pleading, reduces itself to those clear and simple elements. A begins, by affirming some one of the facts which gives commencement to a right. ”

“ To hold, exercise, and enjoy, the said appointment, with all powers, authorities, and emoluments, to the same incident and belonging, or in any wise appertaining—you conforming, in every instance, to the act of our said Assembly, under which you are appointed. ”

“ In this she set forth the step she proposed to take, asked for suggestions, conditions, additions, alterations, or proposed omissions in the petition, of which a copy was enclosed; for information as to presenting it, for support and assistance in the labour involved. She also asked the opinion of those to whom she wrote as to the best method of procedure, whether by petition to Parliament or by a memorial to the Lords of the Privy Council. ”

“ The conditions in which voters in each territorial community may use their right of petition to ask for a matter within the powers of the community to be entered on the agenda of its Deliberative Assembly shall be determined by statute. ”
