Transshipment

Definition and stakes

W. D.‏ ‏ Bernard,  Narrative of the Voyages and Services of the Nemesis from 1840 to 1843

“ No English merchant ships may transship goods without special permission: should an urgent case happen where transshipment is necessary, the circumstances must first be transmitted to the Consul, who will give a certificate to that effect, and the Superintendent of Customs will then send a special officer to be present at the transshipment. If any one presumes to transship without such permission being asked for and obtained, the whole of the goods so illicitly transshipped will be confiscated. ”

Wiley Blount Rutledge,  United States v. American Union Transport…

“ All are so-called independent forwarders and the case comes down to whether such forwarders are covered by the Act.
There is little or no dispute as to the nature of their business. They are primarily forwarders of freight, as that term is generally understood, [6] for transshipment in foreign commerce. The foreign freight forwarding business is a medium used by almost all export shippers. An exporter, intending to send goods abroad, consigns the merchandise to a forwarder who then makes all the arrangements for dispatching it to a foreign port.
