“ The Natural Gas Act was designed to supplement state power and to produce a harmonious and comprehensive regulation of the industry. [18] Neither state nor federal regulatory body was to encroach upon the jurisdiction of the other. [19] Congress enacted this Act after full consideration of the problems of production and distribution. It considered the state interests as well as the national interest. It had both producers and consumers in mind. ”

“ Thus the Commission in this case, as it often has in the past, [4] has declared that the use of gas under industrial boilers is an 'inferior' use, the assumption being that other fuels, particularly coal, are an adequate substitute [5] in areas where such other fuels abound. However, respondents, while conceding the premise that gas may be wasted where coal is readily available, argue that Congress has not awarded the Commission any powers over conservation; rather, this authority has veen reserved to the States. This contention is based on the legislative history of the Natural Gas Act. ”

“ No. 709, 75th Cong., 1st Sess., the Committee on Interstate and Foreign Commerce said of the proposed bill which became the Natural Gas Act: 'It confers jurisdiction upon the Federal Power Commission over the transportation of natural gas in interstate commerce, and the sale in interstate commerce of natural gas for resale for ultimate public consumption for domestic, commercial, industrial, or any other use. The States have, of course, for many years regulated sales of natural gas to consumers in intrastate transactions. ”
