Volstead Act

Definition and stakes

Francis X. Hennessy,  Citizen or Subject? (1923)

“ No one, however, has yet pointed out one particular fact to the careful thought of every average citizen of America. There are thousands of laws, interfering with individual freedom, in the statute books of the American nation and of the respective states. In one respect, however, this Volstead Act is absolutely unique among statutes in America. It is the one law in America of that kind, the kind interfering with individual freedom, which does not even pretend to be founded on a grant of authority directly from its citizens to the government which passed it. ”

Joseph P. Tumulty,  Woodrow Wilson as I Know Him

“ The House of Representatives with its overwhelming "dry" majority passed the Volstead Act over the President's veto. The President clearly foresaw the inevitable reaction that would follow its passage and its enforcement throughout the country.
As the days of the San Francisco Convention approached, he felt that it was the duty of the Democratic party frankly to speak out regarding the matter and boldly avow its attitude toward the unreasonable features of the Volstead enforcement act.

Cunard Company v. Mellon — Dissent

“ That the government has full power under the Volstead Act to prevent the landing or transshipment from foreign vessels of intoxicating liquors or their use in our ports is not doubted, and, therefore, it may provide for such assurances and safeguards as it may deem necessary to those ends. Nor do I doubt the power of Congress to do all that the court now holds has been done by that act, but such power exists not under the Eighteenth Amendment, to whose provisions the act is confined, but by virtue of other provisions of the Constitution, which Congress here has not attempted to exercise. ”
