Clanship

“ As a pioneer he has reached "the ends of the earth," possessing the unoccupied parts of the world. As a patriot he has established not a few of his cherished customs in the land of his adoption. His love of kindred is probably his most notable characteristic; it found embodiment in the clan system, under which his race achieved its greatest triumphs and enjoyed its greatest glories, and the bond of clanship, with its inspiring memories, the true clansman will never disregard. ”

“ The relatives under the first head will be members of the same clan as the man, and the prohibition of marriage between püliol under this head may be regarded as a restriction dependent on either clanship or kinship. ”

“ In America, the custom of marrying out of the clan is frequent and well marked. “ The clans are here described as consisting of two divisions: The one of the Kinsmen, or those of the blood of the sept; the other of the dependants or subordinate septs, who might be of different race. The former clan are well defined in the Gartmore MS., written in the year 1747. The writer says that ‘the property of these Highlands belongs to a great many different persons, who are more or less considerable in proportion to the extent of their estates, and to the command of men that live upon them, or follow them, on account of this clanship, out of the estates of others. ”

“ Such family groups were what we call clans, and so far as is known they were the earliest form in which civil society appeared on the earth. Among all wandering or partially settled tribes the clan is to be found, and there are ample opportunities for studying it among our Indians in North America. The clan usually has a chief or head-man, useful mainly as a leader in wartime; its civil government, crude and disorderly enough, is in principle a pure democracy. ”

“ It is when the head men of the clan have assumed the privileges of hereditary chiefs, and come to stand alone in the golden sunset of a divine ancestry once common to the entire group, when the mass of clansmen have sunk into simple freemen or even serfs, and the chief's men stand apart from the common folk as their lord's comitatus, that both the choral and the personal poetry of the clan give way to the songs of the chief's hall. ”

“ The old clan-system, with the idea which it nourished of the close relation between the various grades of the clan, of the duty of the chief to support his people, and of the people to do the will of the chief, must be abolished, and the Highlander must be taught, each man to depend entirely upon himself and his own exertions, and to expect nothing from any man but what he could pay for in labour or money. ”

“ The members of a clan have many common rights and privileges which bind them together, so that the clan-tie has a very real meaning. Property, however, as we shall see shortly, is largely centred in the family or the individual, and the Todas are in a state of social evolution in which the common bond constituted by membership of the clan has been largely replaced by the bond constituted by the family. They are in an intermediate condition between the state of society in which the clan is the social unit and that in which the family has taken this position. ”

“ Starting out with a single pair, when the [pg 195] family increases in size a separation is necessary; and clans are an outcome of the process of division and redivision, the bond between the clans and their union in a tribe resulting from their consciousness of kinship. Now, it is a well-known condition of exogamy that, while a man must marry without his clan, he must not marry without his tribe, and for the most part, in fact, the clan into which he shall marry is designated. In other words, allied clans gave their women in exchange mutually. ”

“ But first we have something to say about the practical and theoretic conditions which have turned men's attention to the clan organisation.
The importance which the clan has assumed in recent speculation is due to a variety of associations, partly incidental to the ordinary activities of our nineteenth-century life, partly peculiar to the character of our modern thought. The everyday life of Europe in general and of England in particular is now habituated to social contrasts greater than ever before fell within the positive range of human knowledge. ”

“ For centuries the chief strength of the Highland race had lain in the clan. By right of birth every Highlander belonged to a sept or clan. His overlord was an elected chief, whom he was expected to obey under all circumstances. This chief led in war and exercised a wide authority over his people. Just below him were the tacksmen, who were more nearly related to him than were the ordinary clansmen. Every member of the clan had some land; indeed, each clansman had the same rights to the soil as the chief himself enjoyed. ”

“ Their united authority extended over all the members and the possessions of the clan, and they were independent of every other clan. There are in some places vestiges of this primitive state of society still remaining; the transition to a limited or to a despotic monarchy may be traced by means of the ancient legends in some islands, and in others it is a matter of recent history. One clan being more numerous and stronger than another, and its chief being ambitious, it is easy to see how by conquering a neighbouring clan he increased the importance of his clan and extended his own power. ”

“ Throughout all the earlier stages of culture, and even into the civilized period, we find society organized with the clan for its ultimate unit, although in course of time its character becomes greatly altered by the substitution of kinship in the paternal, for that in the maternal line. By (p. 061) long-continued growth and repeated segmentation the primitive clan was developed into a more complex structure, in which a group of clans constituted a Phratry and tribe. phratry or brotherhood, and a group of phratries constituted a tribe. ”

“ Rights or obligations of marriage within the clan everywhere attest the same communal exclusiveness; and some forms of clan life would even lead us to believe that the brotherhood once lived under a common roof, and shared not only their sacred festivals but even their ordinary meals. Conspicuous, however, among these signs of communal kinship is an economic feature of the settled clan which living scholars have investigated with equal patience and learning—the common ownership of land. ”

“ Among peoples which wander about, supporting themselves either by hunting, or at a somewhat more advanced stage of development by the rearing of flocks and herds, a group of men, thus permanently associated through ties of blood-relationship, is what we call a clan. When by the development of agricultural pursuits the nomadic mode of life is brought to an end, when the clan remains stationary upon some piece of territory surrounded by a strip of forest-land, or other boundaries natural or artificial, then the clan becomes a mark-community. ”

“ We see thus that the clan organization grows naturally out of the drawing together of men to strengthen themselves in the fierce struggle of savage life. The clan is simply an extension of the family. The family idea still runs through it, and kinship is the bond that holds together all the members. ”

“ The whole body of the clan were summoned to decide upon the question of war or peace. Every petty chieftain of every minor tribe, if not every individual clansman, had a voice not only in this primary question, but also, when the war was declared, in the questions arising upon subsequent military operations... The kings or chieftains were themselves chosen by the clan, although the choice was limited to those who possessed a sort of hereditary right, often complicated by a comparison of the personal merits of the rival claimants. ”

“ A clan is a body of kindred in which kinship is established by laws now long disused, and so strange to our present ideas as to be comprehended with difficulty. Some of the more salient features of the system appear in the division of the people into tribes which are interpermeated by clans, with special rules of government, adoption, punishment, protection, property, and marriage. ”

“ Travellers having but a superficial knowledge of the peoples they describe—especially in the days before savage kinship had become the subject of scientific investigation—are not careful to define, because they do not understand, the relationship of members of a tribe to one another. Their vague expressions “relatives” and “friends” are therefore subject to interpretation by what has been ascertained of clan-organisation, if we would avoid one source of error. But there is a further consideration which ought not to be overlooked. The clan system has rarely been found complete and unimpaired. ”

“ On the other hand, the clans, together with the tribes whose divisions they form, are shorn of their power; they become fused into one group which, with the rise of political society, passes under the rulership of a single chieftain. It is particularly important to notice that, when the joint family emerges and clan organization is consequently dissolved, one of the most important functions of the more restricted [Pg 314] clan alliances, so far as concerns the inner life of society, passes from the clan to the joint family. ”

“ The outsiders, the men who lived with the clan but were not of the clan, were no part of the folk, and had no share in the folkland. No services rendered, no participation in the common danger, no endurance of the burden and heat of the day, could create in an outsider any colour of right. Nothing short of admission to the clan, and of initiation in its worship, could enable him to demand as of right the grass of a single cow or the wood for a single fire.”56 ”

“ The word Clan signifies simply children or descendants, and the clan name thus implies that the members of it are or were supposed to be descended from a common ancestor or eponymus, and they were distinguished from each other by their patronymics, the use of surnames in the proper sense being unknown among them. [See GENS, ROMAN.] ... In considering the genealogies of the Highland clans we must bear in mind that in the early state of the tribal organisation the pedigree of the sept or clan, and of each member of the tribe, had a very important meaning. ”

“ In brief, these are the ohwachira (= the uterine family) , of which one or more constitutes a clan; the clan, of which one or more may constitute a sisterhood, or, as it is usually called, a phratry of clans; the sisterhood or phratry of clans, of which only two constitute a tribe in Iroquois social organization; the tribe, of which two or three constitute a sisterhood or phratry of tribes; and finally the league or confederation which is composed of just two sisterhoods or phratries of tribes. ”

“ Every clan or family lived by itself and formed a guild for mutual protection, each kinsman being his brother's keeper, and bound to avenge his death by feud with the tribe or clan which had killed him. ”

“ The totem is there represented as the very being from whom the clan is descended. So it must be that it constitutes the substance of the clan; men have it within them from their birth; it is a part of their very flesh and blood, so far are they from having received it from without. [584] More than that, the very myths upon which Hill Tout relies contain an echo of this ancient conception. The founder who gave his name to the clan certainly had a human form; but he was a man who, after living among animals of a certain species, finally came to resemble them. ”

“ Such a group of families as has been supposed is called a clan, or in Roman history a gens. It may be small, or it may be very numerous. The essential feature is that it is a body of people united by the tie of common blood. It may have existed for hundreds of years and have grown to thousands of persons. Some of the clans of the Scotch Highlands were quite large, and it would often have been a hopeless puzzle to trace a relationship running back through many generations. ”

“ But his rule only lasts as long as the others choose to obey him, and instead of being a sovereign, or even a commander-in-chief, he is but primus inter pares.
The clans themselves vary exceedingly in numbers, and, as a general rule, each clan consists of one family, gathered together after the patriarchal system. Then if one of the men should happen to excel his fellows he is sure to get together a band of followers, to separate in time from his family, and found a clan of his own. ”
