Necessity (ethics)

“ Alas, life is everywhere one long protest against a varying standard of ethics. Shall we separate the ethics of household service from the ethics of the shop, the ethics of the factory, the ethics of the professions? Shall we be governed by one code in the family, by another code in the church, by a third code in the school, and a fourth code in the state? Is the subject of ethics to be divided and pigeon-holed in compartments labeled “ethics for domestic service,” “ethics for skilled labor,” “ethics for unskilled labor,” “ethics for employers,” and “ethics for employees?” ”

“ Who is to be the judge of this sort of necessity? By what measure is the comparative value of lives to be measured? Is it to be strength, or intellect, or what? It is plain that the principle leaves to him who is to profit by it to determine the necessity which will justify him in deliberately taking another's life to save his own. ”

“ That which, when we become capable of reflection, we term conscience, consists in pleasure in forms of action furthering the welfare of society—forms gradually moulded to habit with the development of social relations,—and in a corresponding pain at the realization of having failed of such action; the knowledge of the demand, by society as a whole or by a part of society, of action in accord with the general welfare, and the sense of the justice of this demand, constituting the feeling of obligation and duty. ”

“ The basis of a correct theory of obligation lies, as already stated, in holding fast to its concrete relations to the moral end, or good. This end consists in an activity in which capacity is exercised in accordance with surroundings, with the social needs which affect the individual. It is implied in this very idea, that the end is not something which the individual may set up at his own arbitrary will. The social needs give control, law, authority. The individual may not manifest his capacity, satisfy his desires, apart from their specific relation to the environment in which they exist. ”

“ The morality of these and many of my other doings in those days will no doubt be condemned. By no one more severely than by myself—now that the necessities which then compelled me have passed. There is no subject on which men talk and think, more humbug than on that subject of morality. As a matter of fact, except in those personal relations that are governed by the affections, what is morality but the mandate of policy, and what is policy but the mandate of necessity? ”

“ Extreme cases in which moral laws may be suspended.—The particular duties, virtues, and laws which society has established and recognized are the expressions of reason and experience declaring the conditions of human well-being. As such they deserve our profoundest respect; our unswerving obedience. Still it is impossible for rules to cover every case. There are legitimate, though very rare, exceptions, even to moral laws and duties. For instance it is a duty to respect the property of others. ”

“ The imposition of some recognized rules of conduct, safeguarding the security of life and property, is as necessary to the community as the existence of a coinage for the negotiation of commercial bargains; in fact it is more so. The two are analogous: the moral code must give effect to that first and universal principle of ethics expressed thus, "Do unto others as you would they should do unto you," which is only another way of saying, "You may expect others to treat you as you intend to treat them in similar circumstances." ”

“ Now these reasons and motives are a light to the will, and serve to direct its activities; and the human conscience, which is but the reason, has drawn up for the will explicit rules, suited to all circumstances and relations, which are called ethics, or the rules. ”

“ During the transitional stages there are necessitated successive compromises between the moral code which asserts the claims of the society versus those of the individual, and the moral code which asserts the claims of the individual versus those of the society. ”

“ As it is, desire points normally toward the really desirable; the direction of human welfare lies, in general, along the line of our organic needs, of the avoidance of clashes, of the mutual subordination and cooperation of natural impulses. The principle of reason, of intelligence, is necessary in morality to find this way of cooperation, this ultimate drift of need; but without the potentiality of happiness chaos would be as good as order, both within the individual soul and within the social group. ”

“ It is to be particularly observed, further, that the obligation, thus perceived and then felt, is perceived and felt as due by the moral agent with respect to right and wrong. The ethical quality of rightness belongs to the act or principle of action. The motive, the intention, the conduct of men, is in itself morally right or wrong, good or evil. But the obligation appears as what is owed by the moral agent to what is right. The relation between right and obligation corresponds to that between right and duty. Right is in the conduct; duty is for the responsible person. ”

“ All moral laws, I wish to shew, are merely statements that certain kinds of actions will have good effects. The very opposite of this view has been generally prevalent in Ethics. ‘The right’ and ‘the useful’ have been supposed to be at least capable of conflicting with one another, and, at all events, to be essentially distinct. ”

“ There are many duties that belong to the class of imperfect obligations, which are binding on conscience, but which human laws do not and cannot undertake directly to enforce. But when the aid of a Court of Equity is sought to carry into execution ... a contract, then the principles of ethics have a more extensive sway. ”

“ If I say that the legislative authority has bad desires, I mean merely that its desires conflict with those of some section of the community to which I belong. Outside human desires there is no moral standard.
Thus, what distinguishes ethics from science is not any special kind of knowledge, but merely desire. The knowledge required in ethics is exactly like the knowledge elsewhere; what is peculiar is that certain ends are desired, and that right conduct is what conduces to them. ”

“ In the theory of obligation, every fact brought forward by evolution to show the harmony of individual and social welfare makes the way easier for establishing the reasonableness of the pursuit of social ends by the individual. ”

“ The common state of society is a medium between the extreme suppositions now made: we have our self-partialities, but have learnt the value of equity; we have few enjoyments by nature, but a considerable number by industry. Hence we have the ideas of Property; to these Justice is essential, and it thus derives its moral obligation. ”

“ A fashionable counter-theory which proves to be unjustifiable. On the one hand, while we find that individual life and social life both imply maintenance of the natural relation between efforts and benefits; we also find that this natural relation, recognized before Government existed, has been all along asserting and reasserting itself, and obtaining better recognition in codes of law and systems of ethics. ”

“ From right use of such affection or actions as are approved by the moral faculty from their relation to the general good, or the good of particular persons consistently with the general good, he distinguishes the right of a man to do, possess, demand, &c., which exists when his doing, possessing, &c. tend to the good of society, or to his own, consistent with the rights of others and the general good, and when obstructing him would have the contrary tendency. ”

“ But free-will has also been discussed pragmatically, and, strangely enough, the same pragmatic interpretation has been put upon it by both disputants. You know how large a part questions of ACCOUNTABILITY have played in ethical controversy. To hear some persons, one would suppose that all that ethics aims at is a code of merits and demerits. ”

“ When the ethical feeling develops, upon the basis of sympathy, to the feeling of duty and justice, the principle included in the above law becomes the standard according to which the individual judges his own actions as well as those of others, and pronounces them good or bad. The good is that which preserves and develops the welfare of conscious beings. ”

“ It would almost seem to betray a culpable indifference to the welfare of society if we did not share this general interest. For this great commerce in social and moral principles is of necessity a matter of the greatest concern to every human being, on the ground both of its subject and of its results. ”

“ Thus in the development of the guest right we see morality broadening, the circle of moral obligation enlarged, and the stranger, ordinarily counted as an enemy and as rightless, brought for a moment within the sacred pale of ethical sentiment and duty.56 A new ground of moral obligation other than that of kinship has been established. ”

“ It was stated, at the beginning of the last chapter, that the ethical theory we are considering—the theory stated in the first two chapters—does not maintain with regard to any class of voluntary actions, that, if an action of the class in question is once right, any other action of the same class must always be right. ”

“ If, then, we take as the principle of ideal justice, so far as this can be practically aimed at in human society, the requital of voluntary services in proportion to their worth, it remains to consider on what principle or principles the comparative worth of different services is to be rationally estimated. ”

“ Even the employer is beginning to see that practical ethics, or true Christianity, and business cannot and must not be divorced; that the man he employs, instead of being a mere animal whose services he buys, is, after all his fellow-man and his brother, and demands a treatment as such, and that when he fails to recognize this truth, a righteous God steps in, demanding a penalty for its violation. ”

“ It is remarkable that the advocates for necessity have adopted a distinction made use of for other purposes, and forced it into their service; I mean moral and natural necessity. They say natural or physical necessity takes away liberty, but moral necessity does not: at the same time they explain moral necessity so as to make it truly physical or natural. ”

“ In its applicatory judgments, for fixing the ethical law of right in all the varied and complex relations and conditions of human life, it is dependent on all the subordinate faculties for the requisite light. Whatever limitations may rest on its ability, whatever partialness may mark its development, whatever complications may perplex it in adjusting duty to all the actual situations in human life, it yet remains the faculty through which the law of duty is disclosed to view, and if duty is not indicated through it, it is not indicated through any human insight at all. ”

“ If the reply is that the principle must be taken as a guide for governmental action rather than for individual action, we are at once met by the inquiry, what is to be the guide for individual action? If individual action is not to be regulated solely for the purpose of achieving "the greatest happiness of the greatest number," some other principle of regulation for individual action is required, and "the greatest happiness principle" fails to furnish the needful ethical standard. ”

“ In holding that actual social relations afford the law of what should be, we must not forget that these actual relations have a negative as well as a positive side, and that the new law must be framed in view of the negatives, the deficiencies, the wrongs, the contradictions, as well as of the positive attainments. A moral law, to sum up, is the principle of action, which, acted upon, will meet the needs of the existing situation as respects the wants, powers, and circumstances of the individuals concerned. ”

“ Is it not clear that observance of moral principles is fulfillment of certain general conditions to the successful carrying on of special activities? That the trader may prosper, he must not only keep his books correctly, but must pay those he employs according to agreement, and must meet his engagements with creditors. May we not say, then, that conformity to the second and third of these requirements is, like conformity to the first, an indirect means to effectual use of the more direct means of achieving welfare? ”

“ The principle can be easily accepted as theoretically correct, and many general rights and duties can be readily deduced as corollaries, but beyond these general rules ethical problems have rather to be worked out than thought out—in the more important matters by societies during their upward growth, in smaller matters by individuals through multitudinous adjustments and re-adjustments. ”

“ These are the real difficulties, the knotty points both in the theory of ethics, and in the conscientious guidance of personal conduct. They are overcome practically with greater or with less success according to the intellect and virtue of the individual; but it can hardly be pretended that any one will be the less qualified for dealing with them, from possessing an ultimate standard to which conflicting rights and duties can be referred. If utility is the ultimate source of moral obligations, utility may be invoked to decide between them when their demands are incompatible. ”

“ I regard utility as the ultimate appeal on all ethical questions; but it must be utility in the largest sense, grounded on the permanent interests of man as a progressive being. Those interests, I contend, authorize the subjection of individual spontaneity to external control, only in respect to those actions of each, which concern the interest of other people. If any one does an act hurtful to others, there is a primâ facie case for punishing him, by law, or, where legal penalties are not safely applicable, by general disapprobation. ”
