Tax stamp

Definition and stakes

Edward Douglass White,  American Express Company v. Maynard…

“ A stamp duty is embraced within the purview of those taxes which are denominated indirect, and one of the natural characteristics of which is, although it may not be essential, that they are susceptible of being shifted from the person upon whom in the first instance the duty of payment is laid. We are thus invoked by construction to add to the statute a provision forbidding all attempts to shift the burden of the stamp tax when the nature of the indirect taxation which the statute creates suggests a contrary inference. ”

United States v. Chamberlin — Opinion of the Court

“ Section 25 provided that the Commissioner of Internal Revenue should cause to be prepared 'for the payment of the taxes prescribed in this act suitable stamps denoting the tax on the document, article, or thing to which the same may be affixed.' The stamp is the evidence, and its purchase the convenient means, of payment. When a statute says that a person shall pay a given tax, it obviously imposes upon that person the duty to pay, and this may be enforced through the ordinary means adapted to the recovery of a definite sum due, unless that course is clearly prohibited. ”

Portrait of Fred M. Vinson Fred M. Vinson,  Toomer v. Witsell — Opinion of the Court

“ In upholding this statute, the court below adduced a reason not advanced by appellees, that the requirements as to docking, unloading, packing, and affixing a tax stamp were a proper means of insuring collection of the 1/8¢ a pound tax. [41] But the importance of having commerce between the forty-eight States flow unimpeded by local barriers persuades us that State restrictions inimical to the commerce clause should not be approved simply because they facilitate in some measure enforcement of a valid tax. ”
