Tenure

“ High authority, in one sense, or that of political power, has pronounced the tenure of a durable lease to be opposed to the spirit of the institutions! Yet these tenures existed when the institutions were formed, and one of the provisions of the institutions themselves guarantees the observance of the covenants under which the tenures exist. ”

“ A condition of good behavior, and a tenure during good behavior, are distinct things. The condition for good behavior is necessarily implied, and adheres to every officer. The tenure during good behavior belongs only to those officers in whose commissions that tenure is expressed. ”

“ A man could hold by serjeanty of a mesne lord, such as presiding over the lord's court, riding with the lord or on his errands, feeding his hounds, or supplying bows and arrows. Tenure in free socage may involve a nominal service to a lord, such as the gift every year of a rose, a sparrowhawk, a pair of gloves, a pair of gilt spurs, or a pound of pepper, or of incense or of wax. Tenure in socage may originate by a gift of land to a daughter or younger son, or to some dependant for past services, or a purchase with a gross sum. ”

“ The difference between your tenure and mine is trifling, and I therefore tell you to be prepared. I am prepared. You all have a heavy responsibility, and it behooves you to prepare more than it does me. ”

“ This distinction ran through all the different sorts of tenure; of which I now proceed to give an account.
1. There seem to have subsisted among our ancestors four principal species of lay tenures, to which all others may be reduced: the grand criteria of which were the natures of the several services or renders, that were due to the lords from their tenants. The services, in respect of their quality, were either free or base services ”

“ When the principle is laid down that the tenure of an officer shall be secure as long “as his character remains untarnished and the performance of his duties satisfactory”—can that be interpreted as meaning that the tenure of an officer shall also be secure, when he has become a bad fellow, so that his character is tarnished and the performance of his duties unsatisfactory? ”

“ We should be compelled to listen no more to the clamours against resumption of rent-free tenures, when almost every page will show that there was no tenure, whatever its designation, which was not open to resumption in the theory of the law, and which was not repeatedly resumed in practice. ”

“ The free tenures all exist at the present day, though, as will appear later, the military tenures have shrunk into the unimportant and exceptional tenure of grand serjeanty. The non-free tenures are to a certain extent represented by copyhold. The most important difference between the military and socage tenures was the mode of descent. ”

“ However, if the son were too young to take over, the deceased chief’s brother was temporarily in charge. The qualities of good character and knowledge were also important qualifications for chieftainship, and a chief could be deposed if he were not a good one. Tenure was normally for life, dependent upon satisfactory behavior and performance of his responsibilities. ”

“ for it is with literature as with law or empire-an established name is an estate in tenure, or a throne in possession. ”

“ Another is that there is one feature in the tenure of office law which, although obnoxious in its connection with the present system of appointments, will be of value connected with the reforms proposed. ”

“ But the tried servant of forty years, not dreaming of the possibility of his dismissal, innocently asked, "Ay, sir; whare ye gaun? I'm sure ye're aye best at hame;" supposing that, if there were to be any disruption, it must be the master who would change the place. An example of a similar fixedness of tenure in an old servant was afforded in an anecdote related of an old coachman long in the service of a noble lady, and who gave all the trouble and annoyance which he conceived were the privileges of his position in the family. ”

“ We seem to be in the place of God to them, to be his vice-regents, and empowered to receive homage from them in his name. And we are obliged, by the same tenure, to be their guardians and benefactors. ”

“ Both were subject to the feodal return, render, rent, or service, of some sort or other, which arose from a supposition of an original grant from the lord to the tenant. In the military tenure, or more proper feud, this was from it's nature uncertain; in socage, which was a feud of the improper kind, it was certain, fixed, and determinate, (though perhaps nothing more than bare fealty) and so continues to this day. ”

“ Nay at this day, and in this Land, many Tenants by their Tenures and Services are tyed to the same Subjection, even to Subordinate and Inferiour Lords: To serve the King in his Wars, and to till his Ground, is not only agreeable to the Nature of Subjects, but much desired by them ”

“ Lo, to Hiring we have come, all for to look for places,
If the master and we can agree, and he will give good wages.
The master that a servant wants, will stand now in a wonder,
You all must ask ten pounds a year, and none of you go under,
It’s you then, must do all the work, and what they do require,
So now, stand up for wages, lads, before that you do hire. ”

“ Through the whole tenor of my school-day time,
The face of one, who, whether boy or man,
Was vested with attention or respect
Through claims of wealth or blood; nor was it least
Of many benefits, in later years
Derived from academic institutes
And rules, that they held something up to view
Of a Republic, where all stood thus far
Upon equal ground; that we were brothers all
In honour, as in one community,
Scholars and gentlemen; where, furthermore,
Distinction open lay to all that came,
And wealth and titles were in less esteem
Than talents, worth, and prosperous industry. ”

“ For on the supposition that you will be suitably remunerated, an opportunity for work is afforded which may perhaps raise you for good above your insignificant occupation, and which, if dutifully carried out, will entitle you not only to our warmest thanks, but to those of the whole learned world. Your conduct here may therefore be decisive for the rest of your life. Remember, also, every hour, Mr. Magister, that you have to show conscientiousness and fidelity, not only to learning, but also with respect to the property of the prince who has called you to this post of confidence. ”

“ By the tenor of these presents we grant to each and all the masters and scholars that, when they come to said institution, while they remain there, and also when they return from it to their homes, they may freely carry with them both coming and going, throughout all the lands subject to us, all their things which they need while pursuing their studies, and all the goods necessary for their support, without any duty, levy, imposts, tallies, gabelles, or other exactions whatever. ”

“ The faithful servant is faithful in a little, and if it be a small thing, the servant that is faithful in it, doth thereby testify his love to his master, as much as in a greater matter. Take another similitude; A tenant, in his master’s absence, doth, upon the intreaty of his neighbour tenant, give him a butt or half a ridge of ground: and when, at his master’s return, he is challenged for suffering the other to change his march-stone, he answers. ”

“ I think I am a tenor, but after taking lessons continuously for six years from sixteen different masters I am still in doubt, and what is more, I am not quite certain whether I want to be. Did not somebody once say that a tenor was not a man but a disease? ”

“ And the relation of master and servant exists whenever the employer retains the right to direct the manner in which the business shall be done, as well as the result to be accomplished, or, in other words, 'not only what shall be done, but how it shall be done.' Railroad Co. ”

“ It is, therefore, the indispensable duty of every Master to use his best means, that is, to take all proper methods for performance of these covenants. He must endeavour to render his Apprentice skilful and industrious, by due information and constant employment: he must enforce the duties of diligence, frugality, and honesty, by his own example, by kind and gentle usage, and by instilling into his mind the necessity and usefulness of these and all other good and virtuous habits. ”

“ Whatever may have been the amount of service due to the master at the time of his departure,—whether the whole life and energy of a slave, or a limited quantity of work from a servant,—that service was his property, and he desired to turn it to the best account. ”

“ Only a scanty extract must be given.

"When your master or lady calls a servant by name, if that servant be not in the way, none of you are to answer, for then there will be no end of your drudgery.
"When you have done a fault be always pert and insolent, and behave yourself as if you were the injured person.
"The cook, the butler, the groom, and every other servant should act as if his master's whole estate ought to be applied to that particular servant's business.
"Take all tradesmen's parts against your master. ”

“ When the would-be porter is through in this schoolroom his education goes forward out on the line. Under the direction of one of the grizzled autocrats he first comes in contact with actual patrons—comes to know their personalities and their peculiarities. Also, he comes to know the full meaning of that overused and abused word—service. After all, here is the full measure of the job. He is a servant. He must realize that. And as a servant he must perfect himself. He must rise to the countless opportunities that will come to him each night he is on the run. ”

“ You are to serve your masters with cheerfulness, reverence, and humility. You are to do your masters' service with good-will, doing it as the will of God from the heart, without any sauciness or answering again. How many of you do things quite otherwise, and, instead of going about your work with a good will and a good heart, dispute and grumble, give saucy answers, and behave in a surly manner! ”

“ Nay, if the service has been true, if the master has indeed asked for what was good for himself, and the servant has done what was good for his master, they cannot choose but like each other; to have a new servant, or a new master, would be a mere horror to both of them. ”

“ The Master knowing himself to be able of cunning, shall undertake the lord's work as reasonably as possible, and truly dispend his goods as if they were his own; nor to give more wages to any brother or apprentice than he really may deserve. ”

“ The master may remain master, and the servant a servant; but, according to the constitution of the state they have entered, the service must be a voluntary one on the part of the slave, and the master must render a just equivalent. ”

“ If you have a good teacher and a bad master, improve the helps of your teacher the more diligently. If you have a bad master and good fellow-servants, or a good master and bad fellow-servants, thank God for that which you have, and make the best of it.
Direct. VIII. If you would be accommodated yourselves with the best masters and usage, labour to be the best servants; and then it is two to one but you may have your choice. Good servants are so scarce, and so much valued, that the best places would strive for you, if you will strive to be such. ”

“ You are of course aware that every Man has two mouths or voices—as well as two eyes—a bass at one and a tenor at the other of his extremities. I should not mention this, but that I have been unable to distinguish your tenor in the course of our conversation. ”

“ With those who ask a literal copy of life, whether high or low, and ask no more, the Teniers and their school must always be in the highest favour; and to those who are wearied and sceptical of blunders and failures in seeking that underlying strain of life, the mere rugged genuineness of the Teniers' work recommends itself, and is not without its own pathos; while to very many superficial observers the simple homeliness of the life which the Teniers chose to represent, prevents the observers from missing what should be present in every life. ”

“ If his employer is attentive and parsimonious, the workman is very likely to be so too; but if the master in dissolute and disorderly, the servant, who shapes his work according to the pattern which his master prescribes to him, will shape his life, too, according to the example which he sets him. ”
