Altercation

“ Know therefore that I have determined to fight a duel to the death with this traitor, who cannot refuse to fight with me, since I have designedly assaulted and insulted him in the person of his servant, and since I do at this moment insult and challenge him in his own person, branding him before God, before you and before the honest fellows who attend us, as a cowardly and despicable murderer! ”

“ As to its manner, it is an ordinary fight or a duel, according as it takes place without or with previous arrangement and stipulated conditions. (c) As to its eject, the civil law distinguishes between assault and battery. Assault is a show of violence against the person of another, as when one lifts one’s fist or cane in a threatening manner to put another in fear of bodily harm. Battery is the actual infliction of personal violence, as when one strikes, pushes, scratches, bites, or spits on another. ”

“ But this is the A B C of the ‘codice cavalleresco’, if the insult be followed by an assault, he who receives the blow is the offended party, and the threat of an assault is equivalent to an actual assault. The offended party has the choice of a duel, weapons and conditions. ”

I have offended against my own conviction,—but, transported with passion at his infamous charges, I was not master of my reason; I accused hum of his perfidy; he denied it; I told him I had it from my father,—he changed the subject to pour abuse upon him; I insisted on a recantation to clear you; he asked by what right? I fiercely answered; by a husband's! His countenance, then, explained at least the motives of his treachery,—he loves you himself! ”

“ Then He allowed fighting, when they, the unbelievers, were the aggressors, and said:—'A sanction is given to those who have fought because they have suffered outrages;' i.e., they are allowed to fight in self-defence. ”

“ This was a kind of irregular justice, which, though necessary in savage times, could hardly fail to end in a feud, and a feud once kindled among an idle people with no variety of pursuits to divert their thoughts, burnt on for ages either sullenly glowing in secret mischief, or openly blazing into public violence. ”

A gentleman, in a coffee-house, desired another to sit further from him. ‘Why so?’—‘Because, sir, you stink.’—‘That is an affront, and you must fight me.’—‘I will fight you, if you insist upon it ”

“ When the victim floored, imprecations and oaths, and threats of vengeance, in case of resistance, immediately follow, accompanied by the most active search for the property, while they cover his mouth, kneel on his body, or beat him, as the case seems to them to require. ”

“ Much has been said, and perhaps more than has been thought, concerning the court before us. The loser is expected to complain, and his friends to give him a partial hearing; and though he breathes vengeance against his antagonist, it ends in a breath. ”

“ The ring-fence used to be stronger in days when the lust of combat induced disputes between a couple of men to result in an assault on the domicile of one of them, though, if blood did not boil too rapidly, the disputants usually agreed to fight out their differences at a suitable spot away from the dwellings, so that the friends of each party could have a hand in the fun. ”

“ But it was only while they could keep their backs to the rocky wall that they could hope to cope with their savage enemies, who, though they did not come near enough to stab, surrounded then as nearly as they could, and yelled and shouted like so many disappointed fiends. ”

“ In the first place, let it be understood that the mere challenging to fight a duel, whether verbally or in writing, and the mere carrying any such challenge, is a high misdemeanour, punishable by fine and imprisonment, according to the circumstances of the particular case. ”

“ But when once I had made it known, you can imagine the gusto with which the police prepared to enter the house and confound the obliging host with a sight of my dripping garments and accusing face. And indeed in all my professional experience I have never beheld a more sudden merging of the bully into a coward than was to be seen in this slick villain’s face, when I was suddenly pulled from the crowd and placed before him, with the old man’s wig gone from my head, and the tag of blue ribbon still clinging to my wet coat. ”

“ And in cases where deadly violence is inflicted with deliberation and malice aforethought, one may nobly throw his body as a temporary barrier between the destroyer and his helpless victim, choosing to die in that position, rather than be a passive spectator. ”

“ And a brawl there was, without any error, except of the men who hit their friends, and those who defended their enemies. My partners in breakfast and beer-can swore that I was no prisoner, but the best and most loyal subject, and the finest-hearted fellow they had ever the luck to meet with. Whereas the men from the linhay swore that I was a rebel miscreant; and have me they would, with a rope's-end ready, in spite of every [violent language] who had got drunk at my expense, and been misled by my [strong word] lies. ”

“ Retaliation in kind for many of them is impracticable, for I have had occasion to remark in a former message that under no excess of provocation could our noble-hearted defenders be driven to wreak vengeance on unarmed men, on women, or on children. ”

“ The man who had cursed the preacher doubled up and sank to the pavement under a blow from the other man’s fist. It was the swift and natural result of the controversy, for the spirit of violence was abroad. In the lull that followed the punishment the rector again lifted his voice.
“Men, you are crazy. You are taking a fool’s revenge. You are playing into the hands of your enemies. ”

“ On these occasions, when the battle rages furiously, males and females alike mingle in the strife, until both parties come pecking, tumbling, and screaming through the air, to conclude the fight upon some neighbouring roof, forgetful in their fury of the safety they usually prize so highly, and take such precautions to ensure. ”

“ When the assault is directed against a person that has been singled out for them either for his wealth or other purposes, the assault made upon him and his escort is always of a murderous nature, terminating in the inflictions of cruel wounds or death. ”

“ And if acts, savouring of sheer revenge, were done by them, they should be regarded as but the ebullitions of men, under the excitement of great and damning wrongs, and which, in their dispassionate moments, they would condemn, even in themselves. ”

“ The clumsiest and, so far as rude and blood-thirsty attack could contrive them, the most deadly weapons were the first used; the sudden destruction of life, not the art of defence, being the brutal instinct of the vengeful, cunning, and cowardly savage, or the treacherous manslayer. ”

“ Asking to be forgiven after slamming a door is like touching off a Rodman gun, and then calling out to the fort in front to 'look out' 'take care!' 'do get out of the way.' A first class slam is cumulative long after the noise has ceased—the nerves go on slamming—the valves of the heart flap to and from—the tympanum roils a revelrie to all the shattered senses, the offender slammed at, at once subsides from rage to fear ”

“ And to such injuries it is oftentimes a point of prudence, as well as duty to submit, rather than contend. But it does not follow, that because we are forbidden to resist such slight attacks, we may not defend ourselves when the assault is of a capital kind. ”

“ How many an insolent inclination to personal violence has been checked—how many a truculent heart has sickened, before the prospect of a "leaden breakfast!" Take a single case, which is really embarrassing to the candid opponent of duelling; an insult offered, by either words or deeds, to the character or person of a lady whom one is bound to protect—an injury beyond all legal cognisance, and perpetrated by one occupying the station of a gentleman. ”

“ The last extremes of opposition, the most violent expedients for defence, would be justified by being indispensable. To find safety for her honour, even in the blood of an assailant, was the prescription of duty. ”

“ Men in the heat of argument would suddenly break into abuse and invective, and then it was but a short step to blows, which if from fists would matter little, but when struck with sharp, shining blades became quite another matter. ”

“ He is charging himself with having 47 assaulted and beaten the other fellow. And the big one is charging himself with having licked the little one. Neither wants to acknowledge he got licked; and each would rather pay a fine and have it entered on the records that he won the fight. ”

“ When an interdict is issued respecting acts of violence, they were aware that there are two descriptions of causes to which the interdict had reference: one, if a man had been driven by violence from the place in which he was; the other, if he was driven from the place to which he was coming; and either of these may take place, and nothing else can, O judges. 87Consider this then, if you please. If any one has driven my household away from my farm, he has driven me too from that place. ”

“ Many a word was spoken that struck like a club, many a smile stung like a whip-lash, many a glance stabbed like a knife; even in the midst of recitations a wounded one would sometimes break into sobs or silent tears while the aggressor crimsoned and palpitated with the proud indignation of the master caste. ”

“ This drew upon him the execration of the enraged multitude; but no one attempted either to disarm or to seize him. A second blow, inflicted upon a decent looking female, roused my indignation at the cowardice of the bye-standers, and I hastily left the room, crossed the street, and having walked deliberately up to him, pretending to inquire what was the matter, before he was at all aware of my intentions, and just as he was about to relate his story, I, with a well-directed blow, with my fist under the ear, laid him sprawling upon the pavement ”

“ A man may repel force by force in the defense of his person, habitation, or property, against one or many who manifestly intend and endeavor by violence or surprise to commit a known felony on either. ”

“ Several shots are exchanged, generally without execution, as they, by fair activity, avoid them, and so the affair ends. A deadly feud is conducted in a different way. The injured party devotes himself to revenge, steals on his enemy at night, or unawares, and kills him. ”

“ The words 'by force, threats, intimidation, or by any fencing or inclosing, or any other unlawful means' are as comprehensive of transient means of obstruction as of continuing or relatively permanent means. ”

“ “and I’d be glad of a retaliation that wouldn’t recoil on myself; but treachery and violence are spears pointed at both ends; they wound those who resort to them worse than their enemies.” ”

“ The three friends, every fighting instinct in them aroused, and the lust of battle hot within them, fought with a fury and concentrated power that nothing could withstand.
Slowly they forced the thugs across the room, planting blow after blow with deadly effect. Their [206] opponents gave ground steadily, unable to withstand the terrific punishment meted out to them. ”

“ They broke through the lines and all assailed the one in whom they saw the compensation for their loss. The end you know! Now accept a word of advice from an old soldier: The assault is not a race; not he who first, but he who most surely meets the enemy, approaches victory. ”
