“ The officers of the Government were then a set of quiet, industrious, modest and unobtrusive gentlemen who did not try to control party politics, and did not steal, but did, as a general rule, studiously endeavor, by strict attention to their official business, to win the approval of the Government which employed them, and an honorable name for themselves. ”

“ But the public know little of the permanent official who keeps the traditions and experience of the department, whose judgment is always an element, often a preponderating element, in eventful decisions, and whose pen drafts the despatches which go forth in the name of the Government. ”

“ The government is fairly entitled to the services of those who are fully able to discharge personally the duties of their office, and who are willing to give their entire attention to their official duty. ”

“ He is part of the official rather than of the political machinery of the government, and his duties call rather for training than for constructive genius. If there can be found in the official systems of the States a lower grade of service in which men may be advantageously drilled for Presidential functions, so much the better. ”

“ SAVINGS PROVISIONS.
“ (a) Legal Documents.—All orders, determinations, rules, regulations, permits, grants, loans, contracts, agreements, certificates, licenses, and privileges— “ (1) that have been issued, made, granted, or allowed to become effective by the President, the Secretary of Commerce, any officer or employee of any office transferred by this subtitle, or any other Government official, or by a court of competent jurisdiction, in the performance of any function that is transferred by this subtitle ”

“ Reform is necessary, even more, in the higher grades of the public service. President, Vice-President, Judges, Senators, Representatives, Cabinet officers—these, and all others in authority—are the people’s servants. ”

“ From all the public servants responsibility is secured, by their being representatives, mediate or immediate, for short terms, and their powers defined. It is, on the whole complexion of it, a government of laws, not of men. ”

“ The Federal and state governments are parts of one system, alike necessary for the common prosperity, peace and security, and ought to be regarded alike with a cordial, habitual and immovable attachment. ”

“ Who will undertake to say, as a state officer, that the people may not give to the general government what powers, and for what purposes, they please? How comes it, sir, that these state governments dictate to their superiors—to the majesty of the people? ”

“ And now, at the close of this first century of growth, with the inspirations of its history in their hearts, our people have lately reviewed the condition of their nation, passed judgment upon the conduct and opinions of political parties, and have registered their will concerning the future administration of the Government. To interpret and to execute that will in accordance with the Constitution is the paramount duty of the Executive. ”

“ The superintendence of our national faith, honor, and dignity being in a great measure constitutionally deposited with the Executive, we observe with singular satisfaction the vigilance, firmness, and promptitude exhibited by you in this critical state of our public affairs, and from thence derive an evidence and pledge of the rectitude and integrity of your Administration. And we are sensible it is an object of primary importance that each branch of the Government should adopt a language and system of conduct which shall be cool, just, and dispassionate, but firm, explicit, and decided. ”

“ To the people every department of the Government and every individual in each are responsible, and the more full their information the better they can judge of the wisdom of the policy pursued and of the conduct of each in regard to it. ”

“ One class of men whose special function it is to conceive, plan and direct in the affairs of state, and who therefore constitute its head. And in well-organized governments this head must consist of a deliberative and an executive department—a law-making and a law-executing power—functions corresponding perfectly to those of the cerebrum and cerebellum in the head of every individual. This head of the government or state, too, is in the thought of ends. ”

“ Let our government by laws be the chief object of our worldly concern: and as we value that, let our value and estimation rise for the supreme head, and every branch of the executive power, under which we live so happy and easy at home, whilst they all join in making the laws the measure of their whole administration. ”

“ My views have been explained to and approved by several of the principal officers of the government and I believe are well understood by the administration and seen by it with complacency; they are such as every man of honor and every good citizen must approve. ”

“ That is not a foreign but a familiar and domestic government whose officer is your next-door neighbor, whose representatives you deal with every day at the post-office and the custom- house, whose courts sit in your own State, and send their own marshals into your own county to arrest your own fellow-townsman, or to call you yourself by writ to their witness-stands. And who can help respecting officials whom he knows to be backed by the authority and even by the power of the whole nation, in the performance of the duties in which he sees them every day engaged? ”

“ On the Nation we can put our hand as a definite social group, with attitudes and qualities exact enough to mean something. On the Government we can put our hand as a certain organization of ruling functions, the machinery of lawmaking and law-enforcing. The Administration is a recognizable group of political functionaries, temporarily in charge of the government. But the State stands as an idea behind them all, eternal, sanctified, and from it Government and Administration conceive themselves to have the breath of life. ”

“ The President of the Republic, the ministers, the agents, and all the other depositories of public authority, shall be responsible, each in so far as he is concerned, for all the acts of the government and of the administration. ”

“ Each administration has its own duties—the lowest coming into contact with individuals, the higher supervising the subordinate boards. Government is absolute, notwithstanding the adoption of the watchword “Liberté.” ”

“ Remedies.— In a suit described in subsection (a) for a violation described in that subsection, remedies (including remedies both at law and in equity) are available for the violation to the same extent as such remedies are available for such a violation in a suit against any public or private entity other than a State, instrumentality of a State, or officer or employee of a State acting in his or her official capacity. ”

“ These are the two principal types which present themselves for the instruction of the modern student of the practical in politics: administration by semi-independent executive agents who obey the dictation of a legislature to which they are not responsible, and administration by executive agents who are the accredited leaders and accountable servants of a legislature virtually supreme in all things. ”

“ To the English nation belongs the great honour of having invented local self-government and the complete co-ordination of the three departments of government the executive, the judiciary, and the legislative. ”

“ In that part of our policy called the state constitutions, principles, the reverse of these, prevail. Executive power is made dependent on legislative in some way, and vast care is taken to keep legislative and judicial power beyond the influence of executive. ”

“ In the scheme of our national Government the Presidency is preëminently the people’s office. ”

“ And, Sir, if those who have the control of the Government are not fit for this task and have not the nerve and mind for it, the People will take care that there are others who are—although, Sir, I have not a bit of fear of the present Administration, or of the present Executive. ”

“ Sir, the theory of our institutions is plain; it is, that government is an agency created for the good of the people, and that every person in office is the agent and servant of the people. Offices are created, not for the benefit of those who are to fill them, but for the public convenience ”

“ While the authority of the Federal Government extends to but part of our vast system of national, State, and local justice, yet the standards which the Federal Government establishes have the most profound influence upon the whole structure. ”

“ Continuance of Suits.—If any Government officer in the official capacity of such officer is party to a suit with respect to a function of the officer, and under this subtitle such function is transferred to any other officer or office, then such suit shall be continued with the other officer or the head of such other office, as applicable, substituted or added as a party. ”

“ Unless, therefore, the authorities whose office it is to check the executive are backed by an effective opinion and feeling in the country, the executive has always the means of setting them aside or compelling them to subservience, and is sure to be well supported in doing so. ”

“ And although this variety of interests, for reasons sufficiently explained in a former paper, may have a salutary influence on the administration of the government when formed; yet every one must be sensible of the contrary influence, which must have been experienced in the task of forming it. ”

“ Quite as important as legislation is vigilant oversight of administration; and even more important than legislation is the instruction and guidance in political affairs which the people might receive from a body which kept all national concerns suffused in a broad daylight of discussion. There is no similar legislature in existence which is so shut up to the one business of law-making as is our Congress. ”

“ All this but emphasizes the fact that the ideal we should steadily pursue is to fill our Government, both on the legislative and on the administrative side, with men of the broadest practical experience and with the highest conceptions of the disinterested service and the honorable fulfilment of their duties required of them for the public good. ”

“ In every government there are three sorts of power,—the legislative; the executive, in respect to things dependent on the law of nations; and the executive, in regard to things that depend on the civil law. ”

“ The focal center of the executive power is the government, while that of the legislative is the learned—and if this latter great support and pillar should prove defective, how is it conceivable that the state should stand? ”

“ The government of a country so vast and various must be strong, prompt, wieldy, and efficient. Its strength must consist in the certainty and uniformity of its purposes, in its accord with national sentiment, in its unhesitating action, and in its honest aims. It must be steadied and approved by open administration diligently obedient to the more permanent judgments of public opinion; and its only active agency, its representative chambers, must be equipped with something besides abundant powers of legislation. ”

“ The discharge of the duties which necessarily devolve upon the legislative and executive departments of Government in the present condition of our national affairs, can not fail to inculcate a unity of action, stimulated by a sincere and ardent desire to promote and advance the only objects for which Governments are instituted. ”

“ In a country which governs itself by means of a public meeting, a Congress or a Parliament, a country whose political life is representative, the only real leadership in governmental affairs must be legislative leadership—ascendency in the public meeting which decides everhing. ”

“ The executive power is exercised by the President of the Republic, who, for the transaction of public business, appoints six Ministers or Secretaries of State, who have charge of the portfolios of Foreign Relations, Government and Justice, the Treasury and Public Credit, War, Public Works, and Public Instruction. ”

“ But another check which our system contemplates, and certainly one of the most effectual in its operation, is to be found in the intelligence and vigilance of the people. Sovereignty residing with them, it is their opinion which must in all cases determine finally, what and how much power has been delegated, and to which government, and which department of government it has been committed. ”

“ It is, no doubt, indispensable to good government that the chiefs of the administration, whether permanent or temporary, should extend a commanding, though general, view over the ensemble of all the interests confided, in any degree, to the responsibility of the central power. ”

“ When a people have no sufficient value for, and attachment to, a representative constitution, they have next to no chance of retaining it. In every country, the executive is the branch of the government which wields the immediate power, and is in direct contact with the public; to it, principally, the hopes and fears of individuals are directed, and by it both the benefits, and the terrors, and prestige of government are mainly represented to the public eye. ”
