Portrait of Samuel Freeman Miller Samuel Freeman Miller,  Tyler v. Defrees — Opinion of the Court

“ In order to institute and perfect proceedings in rem, it is necessary that the thing should be actually and constructively within the reach of the court. It is actually within its possession, when it is submitted to the process of the court; it is constructively so when, by a seizure, it is held to ascertain and enforce a right or forfeiture which can alone be decided by a judicial decree in rem. ”

Portrait of William O. Douglas William O. Douglas,  McComb v. Jacksonville Paper Company…

“ The decree was not fashioned so as to grant or withhold its benefits dependent on the state of mind of respondents. It laid on them a duty to obey specified provisions of the statute. An act does not cease to be a violation of a law and of a decree merely because it may have been done innocently. The force and vitality of judicial decrees derive from more robust sanctions. ”

Portrait of Samuel Freeman Miller Samuel Freeman Miller,  The Lucille (86 U.S. 73) — Opinion of the Court

“ An order affirming a decree in another court is neither in express terms nor by necessary implication a judgment or decree for the amount of the judgment or decree in that court. The costs of the lower court, and the interest on its judgment to the date of the decree or judgment on appeal, are to be added to it, and, though they may be computed by the clerk, they should have the judicial consideration of the court. ”
