Law reporter

Definition and stakes

Supreme Court of the United States,  Wheaton v. Peters — Argument of Mr Sergeant…

“ The law is not established, at least it has not been so declared, that reports can be private property. Essentially, their contents are public property. The knowledge of the decisions of courts should not be confined. It is consistent with the views of this court, that copies of their opinions should be multiplied to any extent, and in any form required. Publicity is the very thing required.
4. The reporter is a public officer, and his duty, by law, is, to publish. He has no liberty to keep back the matter which he collects and prepares, in the performance of his official duties.

Judith Miller v. US, Matthew Cooper and Time Inc…

“ Because my colleagues and I agree that any federal common-law reporter’s privilege that may exist is not absolute and that the Special Counsel’s evidence defeats whatever privilege we may fashion, we need not and therefore should not decide anything more today than that the Special Counsel’s evidentiary proffer overcomes any hurdle, however high, a federal common-law reporter’s privilege may erect. ”

M. Lyle Spencer,  News writing

“ Gathering News.—The prospective reporter who supposes that newspaper men wander aimlessly up and down the streets of a city, watching and hoping for automobiles to collide and for men to shoot their enemies, will have his eyes opened soon after entering a news office. He will learn that a reporter never leaves the city room without a definite idea of where he is going. If newspapers had to police the streets with watchers for news as the city government assigns officers of the law, the cost of gathering news would be prohibitive. ”
