Discharge

“ Convalescent men reported to the office of the Doctor-in-Charge for discharge on two days a week, and history sheets had to be made up for every one who left or was transferred.175 The monthly turn-over varied between four hundred and eight hundred cases, and each admission and each discharge or transfer entailed the preparation and despatch of several forms. Invaliding Boards were held regularly, and thirty-nine different forms had to be filled up and signed for each man who came before the Board. ”

“ Safety and good administration may demand the man’s summary suspension from duty by the immediate official or employe in charge. If the man has been in the service a prescribed probationary period his permanent discharge will have to be approved by higher authority. Men will not care to risk having a recommendation for discharge disapproved. They will learn that the more carefully a discharge has been considered the less readily will a reinstatement be made. ”

“ No enlisted man, duly sworn, shall be discharged from the service without a discharge in writing, signed by a field-officer of the regiment to which he belongs, or by the commanding officer, when no field-officer is present; and no discharge shall be given to any enlisted man before his term of service has expired, except by order of the President, the Secretary of War, the commanding officer of a department, or by sentence of a general court-martial. ”

“ On the discharge of the prisoners, every man before he can be discharged, must return the same complement of bedding which he had received two years before; he must have the same number of articles, let them be in ever so worn-out state ”

Discharge a Grave Injury to a Worker. ”

“ If it is taken in its ordinary meaning here, the exception in case of a discharge by way of punishment raises no difficulty, because a discharge on resignation is not within the meaning of the principal clause. The course of the departments has amounted to no more than interpreting the word in this exact sense.
Enlisted men are given similar allowances by § 1290 (U.S.C.omp. Stat. 1901, p. 916) and the earlier statutes cited. ”

“ The same applies to a fort.
DISMASTED. State of a ship deprived of her masts, by gales or by design.
DISMISS. Pipe down the people. To dismiss a drill from parade is to break the ranks.
DISMISSION. A summary discharge from the service; which a court-martial is empowered to inflict on any officer convicted of a breach of special laws, though it cannot for minor offences which formerly carried death!
DISMOUNT, To. To break the carriages of guns, and thereby render them unfit for service. Also, in gun exercise, to lift a gun from its carriage and deposit it elsewhere. ”

“ But this increase shall be considered as retained pay, and shall not be paid to the soldier until his discharge from the service, and shall be forfeited unless he serves honestly and faithfully to the date of discharge.'
To entitle the soldier to this retained pay it is therefore necessary to show,-First, his discharge from the service; second, an honest and faithful service to the date of discharge. ”

“ The discharge ‘without honor’ is merely the ending of a contract and separation from the service under a right reserved in the statute for the protection of the Government, which may work a hardship to the private discharged, but which, in the public interest, must sometimes be arbitrarily exercised. ”

“ The right to this depends upon section 1290:
'When a soldier is discharged from the service, except by way of punishment for an offense, he shall be allowed transportation and subsistence from the place of his discharge to the place of his enlistment, enrollment, or original muster into the service. The government may furnish the same in kind ”

“ The man’s kit is turned into the Quartermaster’s store No. 4, where another inventory of articles is made and forwarded to the Quartermaster’s office, to be again checked against the original clothing statement. Forms showing actual shortages of kit are submitted to the Paymaster and a copy of Can. 638 (Particulars on Discharge) to the Pay Department.
Since the inception of the brigade approximately 16,000 men have passed through this unit. The process of demobilization will require the above procedure of discharge to be applied to a strength of not less than 12,000. ”

“ Congress by special enactment raised the travel allowance for discharged soldiers to five cents a mile, payable for the distance between the place of discharge and the soldier’s home, whether the entire journey could be accomplished by railroad or not. Congress also granted a bonus of $60 to every soldier—payable also at discharge. Thousands of soldiers, when they came up for discharge, were entitled to back pay. Thus every man received a considerable sum of money with his discharge certificate, and for the overseas soldier this sum probably averaged more than $100. ”

“ The transgressions or short-comings of a servant vary from the trivial to the grave, and the evils which discharge may bring range through countless degrees from slight to serious. The penalty may be inflicted for a very small offense, and then there is wrong done, or, after numerous grave offenses, it may not be inflicted, and again there is wrong done. How shall be determined the degree of transgression beyond which to discharge is less wrong than not to discharge? ”

“ Later on, the War Department modified its policy by providing that any soldier who faced unemployment after discharge might, upon his own request, be held in the service for a reasonable time while he tried to locate a job for himself in civilian life, and that, on the other hand, if work were waiting for any man not yet in line for immediate discharge, such a man might, upon submitting proper proof that there was a civilian demand for his services, receive his discharge forthwith. ”

“ No person may destroy any records relating to a discharge or potential discharge to surface water within five years of the discharge, or to a discharge or potential discharge to ground water at any time without the prior written permission of the commissioner. ”

4. Cases of discharge from imprisonment by the lord's act, &c. ”

“ That every privy should have a supply of water, applicable as often as it may be required, and sufficient in volume to effect at each application a thorough flushing and purification of the discharge-pipe of the privy. ”

“ The quantity of the discharge seems to depend on the quantity of nourishment, and of insensible perspiration. Women who eat much, and exercise little, have the most copious discharge? in warm countries it is always least, because the perspiration is great. ”

“ No non-commissioned officer or soldier shall enlist himself in any other regiment, troop, or company, without a regular discharge from the regiment, troop, or company in which he last served, on a penalty of being reputed a deserter, and suffering accordingly. And in case any officer shall knowingly receive and entertain such non-commissioned officer or soldier, or shall not, after his being discovered to be a deserter, immediately confine him and give notice thereof to the corps in which he last served, [651] the said officer shall, by a court martial, be cashiered. ”

“ Prisoners who desire assistance from the agent of the Discharged Prisoners’ Relief Committee, in finding employment on discharge, should apply to the Governor fourteen days before they go out, when their cases will be investigated. ”

“ What do you know of the feelings of a respectable family in the middle station of life? I cant bear to be looked down on as a common soldier. Why cant my father be let buy my discharge? Youve done away with the soldier's right to have his discharge bought for him by his relations. ”

“ Any man in his thirty-third year, his term of service being then half done, can obtain an honorable discharge from the army, provided he accepts for the rest of his life one half the rate of maintenance other citizens receive. ”

“ The custom requires a consignee to designate a berth for the discharge of cargo, and is hence responsible, it is contended, for the delays to a ship in reaching the berth, though caused by the conditions existing at the port of discharge. ”

“ This is the case of an enlisted man who makes a claim similar to the above, under Rev. Stat. § 1290 (U.S.C.omp. Stat. 1901, p. 916) , as amended. He was discharged on his own application, and the order of discharge stated that he was not entitled to travel pay. ”
