“ Article 54 The employing unit must provide labourers with occupational safety and health conditions conforming to the provisions of the State and necessary articles of labour protection, and provide regular health examination for labourers engaged in work with occupational hazards. ”

“ Safety, Health and Welfare The Industrial Health Division of the Labour Department acts as an advisory service to government and industry on matters relating to the health of workers. Essentially, the work of the division is concerned with preventing occupational disease and protecting workers against health hazards in their working environment. Hazards to the health of workers are reported by the statutory notification of occupational disease, by the factory inspectorate or by officers of the division. ”

“ People's governments at the county level and above shall develop prevention and control plans for occupational diseases, establish and improve occupational health work mechanism, strengthen supervision over and administration of occupational health work, and enhance the capacity for and level of comprehensive prevention and control of occupational diseases. ”

“ With regard to the workers who engage in operation exposed to occupational disease hazards, the employer shall, in accordance with the regulations of the public health administration department under the State Council, make arrangements for pre-service, in-service and job leaving occupational health checkups and truthfully inform the workers of the results of the checkups. The expenses for occupational health checkups shall be borne by the employer. ”

“ Respiratory protection is used to reduce worker exposures to acceptable levels in the absence of effective engineering controls, during the installation or maintenance of engineering controls, for short-duration tasks that make engineering controls impractical, and during emergencies. The decision to use respiratory protection should be based upon professional judgment, hazard assessment, and risk management practices to keep worker inhalation exposures below an internal control or an exposure limit. ”

“ The implementation of protection and prevention programmes for the promotion of occupational safety and health should be so organized that the competent authority, shipowners and seafarers or their representatives and other appropriate bodies may play an active role, including through such means as information sessions, on-board guidelines on maximum exposure levels to potentially harmful ambient workplace factors and other hazards or outcomes of a systematic risk evaluation process. ”

“ The person responsible for a workplace shall inform users who normally use a workstation in respect of which a risk assessment has been performed under section 4 about the findings of the risk assessment and any action he has taken after the assessment. ”

“ It shall be the duty of every occupier of any workplace to take, so far as is reasonably practicable, such measures to ensure that—
(a) the workplace; (b) all means of access to or egress from the workplace; and (c) any machinery, equipment, plant, article or substance kept on the workplace, are safe and without risks to health to every person within those premises, whether or not the person is at work or is an employee of the occupier. ”

“ Respirators in the workplace should be used as part of a comprehensive respiratory protection program. The program should include written standard operating procedures; workplace monitoring; hazard-based selection ”

“ Where this section applies, the Commissioner may serve a remedial order or a stop-work order in respect of a workplace on—
(a) any person who is in control of the workplace, or the process or work carried out in the workplace; (b) any person whose duty under this Act is to ensure the safety, health and welfare of any person at work in the workplace; or (c) any person who poses or is likely to pose a risk to the safety, health and welfare of any person at work in the workplace. ”

“ Protective laboratory practices and equipment means those laboratory procedures, practices and equipment accepted by laboratory health and safety experts as effective, or that the employer can show to be effective, in minimizing the potential for employee exposure to hazardous chemicals. ”
