“ All regulations and other enactments passed by federal agencies must be in conformity with federal statute. Republican and provincial statutes and other regulations and enactments passed by agencies of the socio-political communities, and self-management enactments may not be contrary to federal statute. If a republican or provincial statute is contrary to federal statute, it will be temporarily applied pending a decision by the constitutional court, and if federal agencies are responsible for their enforcement, the federal statute concerned shall apply. ”

Executive Order 13132

“ Where a Federal statute does not preempt State law (as addressed in subsection (a) of this section) , agencies shall construe any authorization in the statute for the issuance of regulations as authorizing preemption of State law by rulemaking only when the exercise of State authority directly conflicts with the exercise of Federal authority under the Federal statute or there is clear evidence to conclude that the Congress intended the agency to have the authority to preempt State law. ”
