Portrait of Anthony Kennedy Anthony Kennedy,  Price Waterhouse v. Hopkins — Dissenting Opinion

“ Under Burdine, once the plaintiff presents a prima facie case, an inference of discrimination arises. The employer must rebut the inference by articulating a legitimate nondiscriminatory reason for its action. The final burden of persuasion, however, belongs to the plaintiff. Burdine makes clear that the "ultimate burden of persuading the trier of fact that the defendant intentionally discriminated against the plaintiff remains at all times with the plaintiff." ”

A. M. Chisholm,  The Boss of Wind River

When that individual made an apologetic appearance the next day, Locke turned his anger loose and almost kicked him out of the office. Then he sat down and did some really first-class thinking, marshalling all the facts he had, drawing deductions, sorting and arranging, and finally he decided that he had a prima facie case.
Thereupon he brought action against everybody concerned, directly or remotely, in the assault on the business of Kent and Crooks.
