Requisition

“ Under ordinary circumstances the purchasing agent will place no orders until he has first received a requisition from either the stores department or the department that requires the material. The requisition should in every case state the purpose for which the material or supplies is required, as well as by whom wanted. ”

“ As a result of the analyses made by the employment supervisor and his staff, applicants are recommended to foremen who have made requisitions for the filling of vacancies. Bear in mind, it is not the function of the employment department arbitrarily to employ. When a desirable applicant has been found, he is sent, with a recommendation, to the head of the department which has made requisition for an employee. Then the foreman or superintendent or the manager either rejects or accepts the applicant. ”

“ No applicant for competitive examination, or eligible on any civil service register, or officer or employee in the executive civil service, shall directly or indirectly persuade, induce, or coerce, or attempt to persuade, induce, or coerce any prospective applicant, applicant, or eligible to withhold filing application or to withdraw from competition or eligibility for positions in the competitive classifted civil service, for the purpose of either improving or injuring the prospects or chances of any such applicant or eligible. ”

“ Provided, That if upon said register there are the names of eligibles who, under section 1754 of the Revised Statutes, have claim of preference in civil appointments, the names of such eligibles shall be certified before the names of other eligibles higher in grade. The Commission shall make regulations that will secure to each of such preference-claiming eligibles, in the order of his grade among other preference claimants, an opportunity to have his claim of preference considered and determined by the appointing officer. ”

“ That every rector, vicar, curate, and every registrar, registering officer, and secretary, who shall have the keeping, for the time being, of any register book of births, deaths, or marriages, shall at all reasonable times allow searches to be made of any register book in his keeping, and shall give a copy, certified under his hand, of any entry or entries in the same, on payment of the fee hereinafter mentioned; that is to say, for every search extending over a period not more than one year, the sum of 1s., and 6d. ”

You ought to enquire into their estates, and how they came by them; and if they have none, as many who stand candidates, I am told, have not, you may guess who assists them, and what hopeful services are expected from them. ”

That the land must be claimed by a complete grant or concession or order of survey or other mode of investitute of title in the original claimant by separation of the tract from the mass of the public domain, either by actual survey or defined, fixed natural boundaries or initial points and courses and distances by the competent authority, prior to the treaty of cession. ”

“ The property or the status is treated as being what has been so declared or decreed. For judgments in personam, decreeing the payment of a certain sum, the test of competence for the present purpose is again that the person against whom it was pronounced was subject to the jurisdiction by nationality or domicile; the judgment may then be sued on as giving of itself a good title to the sum decreed by it to be paid. For domestic purposes the competence may exist on quite other grounds. ”

“ The following is an imperfect enumeration of them:—An expression of the will of the legislature, when it makes any disposition with regard to property; Occupancy, when a man takes what belongs to nobody; Labour; Donation; Contract; Succession. Of these six causes of the commencement of a right there is a remarkable distinction between the first three and the last three. The first three give commencement to a right in favour of one individual, without necessarily putting an end to a right enjoyed by any other individual. ”

The general rule that a principal is bound by the knowledge of his agent is based on the principle of law, that it is the agent's duty to communicate to his principal the knowledge which he has respecting the subject-matter of negotiation, and the presumption that he will perform that duty. ”

“ I have not the wherewithal for the expenses which occur; for there must necessarily be a notary, interpreter, and lawyer, and persons who with my authorization shall be present to plead the suits—which will not be a few, and cannot be carried through without spending money—Page 248since I am not able, nor is it right that I should be on hand to present the petition, or to plead the causes and business of so much weight and authority. To take this task of being my agent, some honest man, however honorable his station, should be glad to do it. ”

“ But a testator, in making a bequest, may use words of condition, which, however, shall not be construed as such, if it clearly appear that they do not involve the motive and reason of the bequest. [136] Any consideration exacted from the beneficiary, or any duty imposed on him, unless it is spread over a very unusual period of time, is a condition precedent. A condition that the beneficiary shall cease to resort to public houses is a condition precedent, and is not void for uncertainty. ”

“ Investigations and adjudications of covered individuals who require a determination of suitability, eligibility for logical and physical access, eligibility to hold a sensitive position, eligibility for access to classified information, and, as appropriate, contractor employee fitness, shall be aligned using consistent standards to the extent possible. ”

“ Of course, the question can fairly arise only in a case in which process has been served, and in which the express object of the bill, or at least one express object, is the appointment of a receiver, and where possession by such officer is necessary for the full accomplishment of the other purposes named therein. ”

“ When the claim is provided for by existing laws, the opinion of the commissioners refers the claimant to the mode pointed out by such law.
"Demands of different natures by the same person are placed under the head which comprises the greater demand. ”

“ All persons acting as the agents of absentees, for the purpose of acquiring, managing, or registering grants of land, will be required to produce their credentials, and to follow the same course of proceedings as if the grant were for themselves, with the exception of that part which relates to registration, which must be effected in the name of the real owner. ”

“ No officer was appointed to survey or to locate any individual right. All the facts requisite to sustain the confirmation-what were village or town lots, out lots, common field lots, or commons-what were the conditions of inhabitation, cultivation, or possession, to bring the claimant within the act, were referred to the judicial tribunals. ”

“ All servants shall have according to their contract and indenture; and where there is no contract and indenture servants under eighteen years of age, at their arrival in this island shall serve seven years, and above eighteen years, shall serve four years, and all convicted felons, for the time of their banishment; and at the expiration of the terms aforesaid, shall receive from their last master, mistress, or employer, forty shillings, and a certificate of freedom on demand ”

“ Requirements of the kind, in cases where they apply, may be regarded as conditions precedent to the right of the commissioner to grant such an application; but cases often arise where they or some of them do not apply. ”

“ On calling for one or two modern wills, the clerks brought me a substantial, well-bound book, in which he informed me all modern wills have been, since the appointment of the present Registrar, enrolled at length, in a round text, so distinct and plain, that illiterate persons might read them; and not engrossed, so as to become a source of revenue, as at Doctor’s Commons, where the unlearned, in what is called ‘court-hand,’ are obliged to call in the aid of a clerk, and disburse a fee for the wills to be read to them. ”

“ A man of any craft or creed may apply for admission, but the Commune is the judge of whether his prayer will be granted or not. More or less inquiry will be made as to his antecedents, his ability to support himself, and his belongings; but, at all events, it is a business transaction, and the price varies according to the value of the communal property, the age, condition in life, and number in the family of the applicant. ”

“ And that you shall be obedient and faithful to the same, our agent or agents, and that well and truly and uprightly, according to the commission, charge, commandment, or other direction of the said agent or agents to you from time to time given and to be given, you shall prosecute and do all that which in you lieth for the good renown, commodity, benefit, and profit of the said fellowship ”

“ It requires the agent so appointed to proceed to collect the proper proof to establish the right of such person to his freedom; to perform such journeys, take such measures, institute such legal proceedings, &c., as may be necessary to return such person to this State, and charges all expenses incurred in carrying the act into effect, upon moneys not otherwise appropriated in the treasury. ”

“ No person who is an applicant for examination or who is an eligible in one branch of the classified service shall at the same time be an applicant for examination in any other branch of said service.
5. The Commission may refuse to examine an applicant who would be physically unable to perform the duties of the place to which he desires appointment. ”

“ If a principal and his agent differ, and the agent claims that he has acted in accordance with the orders of his principal, and the claim be denied by the principal, the statement of the latter shall be sustained if confirmed by oath. ”

“ The general policy of the law is indicated in the statutory requirements that, where goods of different qualities or different values are mingled, or are composed of material of different values, the highest rate of duty shall be imposed, as in the familiar instances of the classification of articles composed of two or more materials, at the rate of duty charged on the component material of chief value ”

“ In the case of an applicant actually possessing property, "if the guardians are satisfied, after due inquiry, that the means possessed by an applicant are insufficient to support himself and family, they are empowered, subject to the regulations in force, to grant such relief as will meet the necessities of the case." ”

“ To give validity of occupation it is necessary that the property should be without master, and that the intention to acquire the domain should be joined to the fact of an effective taking possession. Let us examine each of the three conditions:
1. Occupation is only to be applied to property which, although susceptible of being possessed, has no master. It does not extend to persons, who can only be the object of a submission, whether voluntary or forced. ”

“ The pivotal language of § 10 (b) (3) , for present purposes, is the statute's proscription of pre-induction judicial review 'of the classification or processing of any registrant * * *.' I take the phrase 'classification or processing' to encompass the numerous discretionary, factual, and mixed law-fact determinations which a Selective Service Board must make prior to issuing an order to report for induction. ”
