Special 301 Report

Definition and stakes

Office of the United States Trade Representative,  Special 301 Report (2010)

“ An Out-of-Cycle Review (OCR) is a tool that USTR uses to encourage progress on IPR issues of concern. It provides an opportunity for heightened engagement with the trading partner on those issues. Successful resolution of specific IPR issues may in some circumstances lead to a change in a country's status on the Special 301 list outside of the typical time frame for the annual Special 301 Report. In 2010, USTR will conduct OCRs of the Philippines and Thailand to monitor progress on IPR protection and enforcement in those countries, and to consider again their Special 301 status. ”

“ Nevertheless, full implementation of TRIPS Agreement obligations has yet to be achieved in certain countries, particularly with respect to the TRIPS Agreement's enforcement provisions. Levels of piracy and counterfeiting remain unacceptably high in these countries. The annual Special 301 review provides an opportunity to assess these issues, and the Special 301 Report sends a necessary message to the governments of countries where serious IPR-related problems exist. ”

“ Because of significant progress made in various negotiations, the Administration has identified no "priority countries" under Special 301. Rather, the Administration has singled out 25 countries whose practices deserve special attention; 17 of those countries will be placed on a Watch List, while the remaining 8 trading partners will be placed on a Priority Watch List:
Action plans for resolving outstanding issues have been developed for each of the eight trading partners on the Priority Watch List
