Ecclesiastical institution

“ All property administered under divers titles, by the regular or secular clergy, whether real or personal, whatever its name or object, is henceforth the property of the nation.
Art. 3. There shall be complete independence between affairs of state and such as are purely ecclesiastical. The government will confine itself to protecting the public worship of the Catholic religion the same as any other religion.
Art. 4. The ministers of religion can accept such offerings as may be made on account of the administration of the sacraments and the other duties of their office. ”

There are many ecclesiastical matters which are of common concernment to many single congregations, as trial of church officers, ordination and deposition of ministers, dispensation of censures, judicial determination of controversies, resolution in difficult cases of conscience, ordering of things indifferent, &c. ”

“ In every country where a Christian Church is permitted to exist, the power and authority of her clergy to exercise their functions will rest upon a triple basis and be subject to twofold restrictions and limitations. ”

“ The royal placet or right of permitting or refusing, is required for all clerical enactments which are not purely inter-ecclesiastical but refer to mixed matters; the theological endowments are subject to state control and joint administration; boys’ seminaries are not allowed; clergymen appointed to office must submit to state examination; according to consuetudinary rights, about two-thirds of the benefices are filled by the king, one-third by the bishops on reporting to the civil court, which has the right of protest; clergy who break the law are removable by the civil court, etc. ”

“ The Church is the only recognized medium of communicating religious knowledge to the people at large; and where there is an Established Church the Legislature ought to embrace every fit opportunity of maintaining and extending the just influence of the clergy, due regard being had to complete toleration. ”

Now history, or written tradition, as contra-distinguished from Scripture, testifies to every single tenet of the Catholic Church—her creeds, liturgy, sacraments, jurisdiction. ”

“ The clergy of a State Church enjoy many advantages over those of unprivileged and unendowed religious persuasions; but they lie under a correlative responsibility to the State, and to every member of the body politic. ”

“ The Fathers of that Council had already formally recognised the grand evils of the age, which cried for a remedy, to be the want of sound religious instruction among the people and of theological science among the clergy. And a decree had been passed directing the bishops in each diocese to choose persons capable of preaching and instructing the people who were to be employed in this office; and requiring that certain learned men should be appointed in all churches, whether cathedral or conventual, to assist the bishops in preaching the Word of God and administering the Sacraments. ”
