Environmental permit

“ The department shall require as a condition of a freshwater wetlands permit that all appropriate measures have been carried out to mitigate adverse environmental impacts, restore vegetation, habitats, and land and water features, prevent sedimentation and erosion, minimize the area of freshwater wetland disturbance and insure compliance with the Federal Act and implementing regulations. ”

“ It is in the interest of the people of this State to minimize direct regulation by the Federal Government of wastewater dischargers by enacting legislation which will continue and extend the powers and responsibilities of the Department of Environmental Protection for administering the State's water pollution control program, so that the State may be enabled to implement the permit system required by the Federal Act. ”

“ USAEC, supra note 1, 146 U.S.App.D.C. at 52, 449 F.2d at 1128, where we held that consideration of environmental issues could not be delayed from the construction permit stage to the operating license stage since commitment of resources in constructing the facility would "inevitably restrict the Commission's options" and would make consideration of environmental factors at the operating license stage "a hollow exercise." ”

“ Land, municipalities, associations of municipalities and other corporations under public law shall have a duty to protect the environment from damage or pollution and to ensure that environmental damage is eliminated or offset. Public and private projects shall require proof of their environmental compatibility. Property may be restricted if, contrary to law, the environment is seriously damaged or endangered by its use. ”

“ Changes are also required in the attitudes and procedures of both public and private-sector enterprises. Moreover, environmental regulation must move beyond the usual menu of safety regulations, zoning laws, and pollution control enactments; environmental objectives must be built into taxation, prior approval procedures for investment and technology choice, foreign trade incentives, and all components of development policy. ”

“ Article 36 Government entities at all levels shall adopt incentives to promote the development of environmental protection enterprises and private environmental protection groups, as well as encourage private investment in the environmental protection industry. ”

“ Agency funding requests for facility compliance with Federal, State, and local environmental regulatory requirements shall emphasize pollution prevention through source reduction as the means of first choice to ensure compliance, with reuse and recycling alternatives having second priority as a means of compliance. ”

“ Enterprises shall be responsible for assisting the government in implementing measures related to environmental protection. Article 7 The central competent authority shall draft environmental protection laws and regulations, draw up national environmental protection plans, establish sustainable development indicators and promote and implement such laws and regulations, plans and indicators. ”

“ Departments of ecology and environment, natural resources, water resources, agriculture and rural affairs, and standardization under the State Council shall, in accordance with the division of responsibilities, establish sound standards for water environment quality, pollutant discharge, environmental restoration, water resources conservation and intensive use, ecological flow, biodiversity protection, aquaculture, and disaster prevention and mitigation. ”

“ The Legislature therefore determines that it is within the public interest to allow private entities who have applied for permits to build, install, maintain or operate any facility for the collection, treatment or discharge of any pollutant or for permits to Implement pollution prevention process modifications to undertake such building, installation, maintenance or operation or to implement such process modifications while the department is reviewing their permit application, but with the clear and full understanding that they assume all risks for their actions. ”

“ For the construction of a project where solid wastes are generated, stored, utilized, or treated, the impact on the environment shall be assessed in accordance with law, and the state regulations governing environmental protection in respect of construction projects shall be complied with. ”

“ Recognizing the right of each Party to establish its own levels of domestic environmental protection and environmental development policies and priorities, and to adopt or modify accordingly its environmental laws and regulations, each Party shall ensure that its laws and regulations provide for high levels of environmental protection and shall strive to continue to improve those laws and regulations. ”

“ This Law is enacted for the purposes of protecting and improving the ecological environment, preventing and controlling environmental pollution by solid wastes, safeguarding public health, ensuring ecological safety, advancing the ecological conservation and environmental protection, and promoting the sustainable development of the economy and society. ”

“ For greater certainty, the term “environmental law” does not include any statute or regulation, or provision thereof, the primary purpose of which is managing the commercial harvest or exploitation, or subsistence or aboriginal harvesting, of natural resources. ”

“ The Department may allow each regional industrial center that is designated as special airshed to allocate emission quotas to pollution sources within its jurisdiction that qualify under an environmental impact assessment system programmatic compliance program pursuant to the implementing rules and regulations of Presidential Decree No. ”

The Trade Representative, through the TPSC, shall determine whether an environmental review of an agreement or category of agreements is warranted based on such factors as the significance of reasonably foreseeable environmental impacts. ”

In the first place, almost every part of government is concerned with the environment in some way, and affects it in some way. “ In the exercise of his or her powers and functions the Commissioner must ensure the conservation of the environment in the Western Cape, and must give attention to the need to balance the goals of environmental conservation and sustainable development. ”

“ Co-operate, subject to their national laws, regulations and policies, in the development and implementation of new environmentally sound low-waste technologies and the improvement of existing technologies with a view to eliminating, as far as practicable, the generation of hazardous wastes and other wastes and achieving more effective and efficient methods of ensuring their management in an environmentally sound manner, including the study of the economic, social and environmental effects of the adoption of such new or improved technologies ”

“ The department shall formulate comprehensive policies for the conservation of the natural resources of the State, the promotion of environmental protection and the prevention of pollution of the environment of the State. The department shall in addition to the powers and duties vested in it by this act or by any other law have the power to:
a. Conduct and supervise research programs for the purpose of determining the causes, effects and hazards to the environment and its ecology ”

“ In recent years, we have learned that our past progress was often made without sufficient regard for the long-term consequences to our natural environment. To meet this environmental challenge, we have enacted more than a dozen significant national environmental laws. ”

“ Nothing in this proclamation shall affect the responsibility of the Department of Energy under environmental laws, including the remediation of hazardous substances or the restoration of natural resources at the Hanford facility; nor affect the Department of Energy's statutory authority to control public access or statutory responsibility to take other measures for environmental remediation, monitoring, security, safety, or emergency preparedness purposes; nor affect any Department of Energy activities on lands not included within the monument. ”

“ The entrusted party shall transport, utilize or treat industrial solid wastes in compliance with the pollution prevention and control requirements prescribed in the provisions of relevant laws and regulations and in the contract, and notify the entrusting entity of the transportation, utilization or treatment of the industrial solid wastes. ”

“ State environmental policy shall take precautions against the occurrence of harmful effects on the environment and shall work towards the economical use and reuse of non-renewable raw materials and the economical use of energy. (2) Severe impairment or endangerment of the natural environment may be permitted only to the extent that this is indispensable for the protection of paramount public interests. ”

“ Those who cause environmental damage shall be liable and responsible for compensatory measures. (5) The State and the holders of local autonomy shall be obliged to keep the accesses to mountains, forests, fields, lakes and rivers free for the general public and, if necessary, to make them free through restrictions on the right of ownership. ”

“ We will undertake rigorous investigations on soil pollution and develop and implement category-based measures to tackle this problem. We will take comprehensive measures to improve both urban and rural environments, and promote waste sorting. We will strengthen energy conservation and environmental protection industries to ensure both environmental improvement and economic growth.
We will move forward with ecological conservation and improvement. ”

“ Generally, a permit may not be issued for a new or modified major stationary source unless several stringent conditions are met. [1] The EPA regulation promulgated to implement this permit requirement allows a State to adopt a plantwide definition of the term “stationary source.” [2] Under this definition, an existing plant that contains several pollution-emitting devices may install or modify one piece of equipment without meeting the permit conditions if the alteration will not increase the total emissions from the plant. ”
