State commission

Definition and stakes

John King Manufacturing Company v…

“ Bruffy, this court repeatedly has held that an order of a state commission, made in the exercise of delegated legislative authority, is a statute of the state in the sense of the jurisdictional provision. Excerpts from some of the cases-all brought here from state courts on writs of error-will suffice to show the course of decision.
'Such an order, being legislative in its nature and made by an instrumentality of the state, is a state law within the meaning of the Constitution of the United States and the laws of Congress regulating our jurisdiction.' Lake Erie & Western R. R. Co.

Portrait of William O. Douglas William O. Douglas,  Public Utilities Commission of the California v…

“ There is that kind of jurisdictional controversy here, for a federal agency claims that a state commission may not act because Congress put the matter exclusively in the federal domain. In a case less clear than this we enjoined state proceedings after concluding that Congress had preempted the field. Rice v. Santa Fe Elevator Corp., 331 U.S. 218, 67 S.Ct. 1146, 91 L.Ed. 1447. By the same token we should settle this controversy at this early stage. By denying relief we advance no cause except that of litigation. ”

Portrait of Samuel Whitaker Pennypacker Samuel Whitaker Pennypacker,  The autobiography of a Pennsylvanian (1918)

“ The executive is only one of a number of commissioners having responsibility without control, and occasionally it has happened that an official, such as the state treasurer, has been designated in the commission in such manner as to impose the duties upon the individual and not the incumbent of the office. It is a custom more honored in the breach than in the observance. Where governments have fallen, it has generally been because of encroachments by one department upon the province of others. ”
