However, it is contended that Congress may not combine this function, under Art. I, with those under Art. III, in district courts of the United States. Two objections are urged to this. One is that no jurisdiction other than specified in Art. III can be imposed on courts that exercise the judicial power of the United States thereunder.

We do not consider it too great a burden on the Board of Correction and prison officials to require them to make an evidentiary showing in the district court. If, as urged, there is now constitutional compliance, it should be fairly simple for respondents to demonstrate it to the district court. Once the district court is convinced that constitutional standards, as we defined them, have been met, it may terminate its jurisdiction of the case. We recognize that the sooner the district court may discharge its jurisdiction of the case, the better it is for everyone.

We have the benefit of the briefing before the district court and its 13-page opinion styled Order of Dismissal, issued January 1, 2021. That order adopts the position of the Department of Justice, finding that the district court lacks jurisdiction because no plaintiff has the standing demanded by Article III. We need say no more, and we affirm the judgment essentially for the reasons stated by the district court. We express no view on the underlying merits or on what putative party, if any, might have standing. The motion to expedite is dismissed as moot.
