“ A real farm repair shop is a rather elaborate mechanical proposition. There is a good brick chimney with a hood to carry off the smoke and gases from the blacksmith fire and the chimney should have a separate flue for a heating stove. ”

For example, manufacturers argue that the “authorized repair” infrastructure many manufacturers have in place provides small businesses with a chance to compete for consumers’ business in the repair space. ”

“ D.⁠Liability and Reputational Harm Many OEMs have argued that manufacturers will face liability or reputational harm if independent repair shops make faulty repairs, and such a burden is an unfair consequence of lifting repair restrictions. ”

“ There are so many degrees of badness in repair work, that it is not possible to cover the entire ground in a work of this kind. They run all the way from the touch up and varnish job, to the cracked, scaled and almost paintless old rigs. “ Nor are maintenance employees removed from coverage if they also have duties not integrally connected with the loading or unloading functions. Someone who repairs or maintains a piece of loading equipment is just as vital to and an integral part of the loading process as the operator of the equipment. When machinery breaks down or becomes clogged or fouled because of the lack of cleaning, the loading process stops until the difficulty is cured. It is irrelevant that an employee's contribution to the loading process is not continuous or that repair or maintenance is not always needed. ”
