Administrative organ

“ An administrative agency may establish representative administrative organizations, such as an administrative committee, if necessary for the independent fulfillment of part of its competent duties under the conditions as determined by law. ”

“ The Administrative Organs of the State shall, under the control and jurisdiction of the Cabinet, carry out self-evaluation, plan and draft their own policies and achieve mutual coordination and liaison among the Administrative Organs of the State in respect of their policies so that they may demonstrate their administrative functions as one body. ”

“ A State organ with independent budgets or a legally chartered institution assuming administrative functions is qualified as a State-organ legal person from the date of its establishment and may engage in civil activities that are necessary for the performance of its responsibilities. ”

“ The administrative organs shall enforce the law, carry out the social plans and other decisions of the assembly, execute the established policy, follow the state of affairs in particular fields of life, organize and discharge particular services, deliberate on administrative matters, exercise administrative supervision and perform other administrative business, prepare acts, and perform other expert services for the assemblies and their political-executive organs. ”

“ The executive power cannot make any law, even provisionally, but only proclamations in conformity with the laws to order or call to mind the execution of them.
Section II. Of the internal administration.
1. In each department there is a superior administration, and in each district a subordinate administration.
2. The administrators do not have any representative character.
They are agents elected at stated times by the people to exercise, under the surveillance and authority of the king, the administrative functions. ”

“ And, Honorable Judges, the whole experience of government proves the absolute necessity for a separate legislative department. Look where you will, and in each case there is an executive cabinet, based upon appointment, untrammelled by the burdens of legislation, and subjected to the criticism and control of a reviewing body. In Europe, the city councils are elected by the people, and the administrative departments are made up through a process of selection and appointment, together with the assurance of reasonable permanence of tenure, responsibility, and adequate support. ”

“ The third great source of public departments has been the creation in comparatively recent times of a number of administrative boards or commissions, whose duties (except in the case of the Board of Works) are not primarily executive; that is, they are not concerned mainly with direct administration, but rather with the supervision and control of local authorities and of bodies exercising functions of a public or a quasi-public nature. ”

“ Notwithstanding any other Executive order, the Administrator of General Services and the Office of Administration, Executive Office of the President, on a reimbursable basis, may provide such administrative services as may be required. ”

“ Article 7 (Authority and Responsibility of Head of Administrative Agency) (1) The head of each administrative agency shall take overall charge of the affairs under his jurisdiction, and shall direct and supervise his subordinate public officials. ”

“ All members are appointed by, and dismissable by, the President. For purposes of business the body is divided into four sections, each corresponding to a group of two or three ministerial departments, and a fifth section which deals more directly with questions of administrative law. ”

“ Public notifications, disposition and other acts of administrative agencies and application, report and other acts submitted to administrative agencies according to the Acts amended by Article 5 of the Addenda before the entry into force of this Act shall be deemed acts of the administrative agencies or acts submitted to the administrative agencies succeeding to the relevant affairs according to the Acts amended by Article 5 of the Addenda, respectively. ”

“ Each agency shall have an accountable process to ensure meaningful and timely input by State and local officials in the development of regulatory policies that have federalism implications. Within 90 days after the effective date of this order, the head of each agency shall designate an official with principal responsibility for the agency's implementation of this order and that designated official shall submit to the Office of Management and Budget a description of the agency's consultation process. ”

“ Each executive department has certain public functions and duties, the performance of which is absolutely necessary to the existence of the government, but it may temporarily, at least, operate with seeming harshness upon individuals. ”

“ The heads of executive departments and agencies shall assist and provide information to the Council, consistent with applicable law, as may be necessary to carry out the functions of the Council. Each executive department and agency shall bear its own expense for participating in the Council. ”

The principle is embraced in every state constitution; and it seems now to be assumed among us, as a fundamental maxim of government, that the legislative, executive, and judicial departments ought to be separate, and the powers of one ought not to be exercised by either of the others. ”

“ Several employees have been in the department's service for six or eight years or more, and no department of the State government is better equipped with honest, faithful, public servants than is the Comptroller's office. ”

“ This construction of the department has been followed for many years, without any attempt of congress to change it, and without any attempt, as far as we are advised, of any other department of the government to question its correctness, except in the present instance. The regulation of a department of the government is not of course to control the construction of an act of congress when its meaning is plain. ”

“ The Legislative department is everywhere extending the sphere of its activity, and drawing all power into its impetuous vortex. ”

“ The law places under the supervision of the interior department and its subordinate officers, acting under its direction, the control of all mattes affecting the disposition of public lands of the United States, and the adjustment of private claims to them under the legislation of congress. ”

“ The different heads of departments are members of the National Assembly and are, therefore, all chosen directly by the people. They are delegated to manage the departments by the vote of all the members of the Assembly. Each head of department is individually responsible to the Assembly for the good conduct and administration of his department. ”

“ GOVERNMENT DEPARTMENTS.--The State government is based upon the State constitution. It has a legislative department charged with the making of the laws, an executive department to enforce the laws, and a judicial department to explain and apply the laws. Each of the departments is independent of the others, being supreme within its own sphere.
The American people believe that the functions of making, of enforcing, and of explaining the laws, should forever be separate and distinct. ”

“ I must be permitted, with the best lights I can obtain, and upon a general view of characters and circumstances, to nominate such persons alone to offices as in my judgment shall be the best qualified to discharge the functions of the departments to which they shall be appointed. ”
