Advance payment

“ The two words debt and payment always refer to money. Thus we say we pay a debt, and we perform a contract for the delivery of property, or to do work.
The constitutional provision in question requires that the stock subscribed 'be paid for at the time of such subscription.' Payment must be simultaneous with subscription. In this case, we contend that payment has not yet been made; but if even in this we were wrong, still it does not appear that the payment alleged in the declaration was made 'at the time' of the subscription. ”

“ The custom of keeping the spare cash reserved for immediate use, or against contingent demands, in the hands of a banker, and making all payments, except small ones, by orders on bankers, is in this country spreading to a continually larger portion of the public. If the person making the payment and the person receiving it keep their money with the same banker, the payment takes place without any intervention of money, by the mere transfer of its amount in the banker's books from the credit of the payer to that of the receiver. ”

“ Deferred payments, etc.Provided, That all deferred payments and the interest thereon shall be payable in the money prescribed for the payment of principal and interest of the bonds authorized to be issued in payment of said lands by the preceding section and said deferred payments shall bear interest at the rate borne by the bonds. ”

“ To fix responsibility upon an indorser, payment must be demanded of the principal debtor on the very day when the obligation matures, and if payment is not made notice of the fact must be sent to the indorser before the end of the following day. ”

“ Any person having claimed payment of an enemy debt which is not admitted in whole or in part shall pay to the Clearing Office, by way of fine, interest at 5 percent on the part not admitted. Such payment will usually be good where the authority of the agent has been countermanded without notice to the debtor. ”

“ SIGNATURE ON PAYMENT Wholesale houses send such bills as soon as the goods are shipped or delivered, though the payment, as per agreement, is not to be made for thirty, sixty or ninety days.
Where there is a running account, that is, frequent orders, with total payments never completed, it is customary for the seller, at the beginning of a calendar month to send to the creditor a "statement." ”

“ As regards old-age pay, a purchaser can, by adopting a slightly higher scale of payment, secure the return of his purchase money if at any time before the annuity falls in he repents of his bargain. Further, employers of labour and friendly societies can, on behalf of their workmen or members, make all the payments necessary to buy an insurance or annuity, and recoup themselves out of wages or members’ contributions. ”

“ They pointed out that the imposition of fabulous indemnities was two-edged, that payment of nine-tenths of the sums suggested would have to be made in manufactured goods or raw materials, a mode of payment which, in the end, might be more profitable to those that paid than to the peoples who received. ”

“ Where the assignment of the in-oil payment right is donative, the transaction is considered as an assignment of future income which is taxable to the donor at such time as the income from the assigned payment right arises. ”

“ The doctrine proceeds upon the obvious ground, that nothing can be justly considered as payment in fact, but that which is in truth such, unless something else is expressly agreed to be received in its place. That a mere promise to pay cannot of itself be regarded as an effective payment is manifest. ”

“ All advances made on the security of any bill of lading, specification, receipt, acknowledgment or certificate shall give and be held to give to the person, Bank or other body corporate making such advances, a claim for the re-payment of such advances on the grain, goods, wares or merchandize therein mentioned prior to and by preference over the claim of any unpaid vendor ”

“ Parties may contract to accept payment in treasury notes, or specific articles, or in bank bills, and if they do so they are bound to accept the medium for which they contracted, provided the notes, specific articles, or bills are tendered on the day the payment under the contract becomes due, and it is clear that such a tender, if seasonable and sufficient in amount, is a good defence to the action. ”

“ In any event the question here is not whether these sums are interest. They may not be interest and yet be other than part of the sale price. [8] If not interest they may be compensation for the delay in payment.
Other contentions are made by the petitioners. It is said that in other situations interest on delayed payments has been treated as part of the principal received and not as normal income. ”

“ Presentment for payment is not necessary in order to charge the person primarily liable on a note, but if it is payable at a mentioned place and he is able and willing to pay it there at maturity, such action is equivalent to a tender of payment on his part. ”

“ The holder of a check should demand payment within a reasonable time after he has received it. He may keep it longer if he pleases, but if he does, and the bank should fail, he cannot demand payment again from the maker of the check. ”

“ Among practically all merchants it is a very common practice to bill goods to customers with settlement allowed on an optional basis. The goods may be billed “net,” i.e., the full amount shown in the invoice must be paid. Since there is a relationship between the time allowed for payment and the amount to be paid, most concerns have an established credit term, at the end of which they expect full settlement of the account, but, as an inducement for earlier payment, they offer a reduction in the amount to be paid. ”

“ Everybody who had to make a fixed money payment, such as rent or interest, would have had their payment doubled, for they would have had to produce twice as much to meet their obligations as originally sufficed for that purpose. ”

“ It is a present payment for an accident happening to a man, and he just gets the money, and there is no more about it; but it might happen occasionally that he applied it towards payment of a debt.
14,366. The premium or subscription of 3s. universally passes into the man's account?-Yes.
14,367. I cannot quite see why the payment of a policy should not also go into the man's account if he has one?-It is only when a man is wrecked that such it payment is to be made. ”

“ The disposal of the goods at the end of that period shall be decided by an agreement between the parties concerned; 11. “Deferred payment sale” means a financing method whereby newly acquired specified goods are delivered to the other party for use, against payment of the price plus interest, etc., by periodic installments for a period equal to or more than the period prescribed by Presidential Decree. ”

“ Payment of money shall, however, be considered a premium only when there is no natural connection with the payment for the main performance or where stamps, coupons or similar documents are used, the primary function of which is to serve as evidence of the right to the payment of money. ”

“ It is difficult to construe a payment as an acceptance under any circumstances. The two things are essentially different. One is a promise to perform an act, the other an actual performance. A banker or an individual may be ready to make actual payment of a check or draft when presented, while unwilling to make a promise to pay at a future time. Many, on the other hand, are more ready to promise to pay than to meet the promise when required. ”

“ And when the time of payment is not anticipated, the law deems the delivery of specific articles a good satisfaction of a money debt, because it will intend them to be more valuable than the money to the creditor who has consented to the arrangement. ”

“ Clarification relating to certain deferred interest arrangements.—A creditor shall allocate the entire amount paid by the consumer in excess of the minimum payment amount to a balance on which interest is deferred during the last 2 billing cycles immediately preceding the expiration of the period during which interest is deferred. ”

“ Even in the few cases where credit has been allowed for one or two months the greatest difficulty is experienced in obtaining payment for the goods supplied, threats and applications to the Amir being often necessary. Delays are constant, although the money is always paid in the end. ”

“ Where there is a guaranty of advances or supplies, it is necessary in the first instance to make a demand of payment from the original debtor, or at least to use reasonable diligence in endeavoring to make such a demand, and notice of nonpayment must be given in a reasonable time to the guarantee. ”

Finance may waive the right of the federal government to collect an amount owing, postpone
the time of payment, or allow payment by installment only under the conditions and

Art. VII. The Commissioners of the Treasury of the Debt shall, fifteen days previous to each payment falling due, furnish us with an account, in a special Report to be published in the 'Journal Officiel,' of the state of the funds assigned to the service of the loan. ”

“ When one has incurred a debt for wages due to workmen, clerks, or servants, that debt, within the limits of time and amount prescribed by the act, is entitled to priority of payment. The priority is attached to the debt, and not to the person of the creditor ”

“ The other officially approved arrangement is known as the 'pre-payment plan', and is also explained in Bulletin No. 4. Under this plan virtually the same arrangement as that which we have been using as an example can stand. ”
