“ Chapter IV, regulation 12, of the regulations provided: 'Agents of foreign principals who engage, whether or not on behalf of their foreign principal, in activities not included among the exceptions set forth in the act and regulations shall be considered subject to the requirement of registration'. The prescribed form of Supplemental Registration Statement directed the registrant to make a statement giving certain items of information, No. 11 of which was 'Comprehensive statement of nature of business of registrant'. ”

“ The regulation, it seems to us, is satisfied when the registrant, in good faith, provides a chain of forwarding addresses by which mail, sent to the address which is furnished the board, may be by the registrant reasonably expected to come into his hands in time for compliance. ”

“ A registrant whose application for apportioned registration has been accepted shall preserve its operational records for a period of three years after the close of the registration year. Such records shall be made available to the Division of Motor Vehicles or its designee upon request for an audit as to the accuracy of computation, payments and assessments for deficiencies or allowances for credit during the normal business hours of the day. ”

“ Further, since both certificates are in the nature of "receipts" attesting that the registrant [p379] has done what the law requires, it is in the interest of the just and efficient administration of the system that they be continually available, in the event, for example, of a mix-up in the registrant's file. Additionally, in a time of national crisis, reasonable availability to each registrant of the two small cards assures a rapid and uncomplicated means for determining his fitness for immediate induction, no matter how distant in our mobile society he may be from his local board. ”

“ The pivotal language of § 10 (b) (3) , for present purposes, is the statute's proscription of pre-induction judicial review 'of the classification or processing of any registrant * * *.' I take the phrase 'classification or processing' to encompass the numerous discretionary, factual, and mixed law-fact determinations which a Selective Service Board must make prior to issuing an order to report for induction. ”

“ I would take a different view if this were a case where a registrant was moved from a CO (conscientious objector) classification to I-A because he made a speech, unpopular with the Board.
This would also be a different case if the registrant were a member of an institutionalized group, [1] such as the Quakers, whose opposition to war was well known and the registrant, though perhaps unpopular with the Board, was a bona fide member of the group. ”

“ When the registrant reports, transportation to a camp for work of national importance is furnished, Reg. § 652.12. Thereafter he 'is under the jurisdiction of the camp to which he is assigned.' The local board then can take no further steps with regard to such registrant without instructions from the Director of Selective Service, but should report any information to the Director of Selective Service which might affect the registrant's status, Reg. ”

“ The registrant was organized as the successor to, or, having no assets at the time other than nominal assets, succeeded to, a group of predecessors consisting of a parent which had securities so registered and one or more wholly owned subsidiaries of such parent; or
(III) The registrant was a wholly owned subsidiary of a corporation having securities so registered, which corporation, either alone or with one or more of its other wholly owned subsidiaries, was merged with the registrant. ”

“ I do not understand that phrase to prohibit review of a claim, such as that made here by petitioner, that the very statutes or regulations which the Board administers are facially invalid.
'Classification is the key to selection,' 32 CFR § 1622.1 (b) , and among a local Board's most important functions is 'to decide, subject to appeal, the class in which each registrant shall be placed.' 32 CFR § 1622.1 (c) . Classification is a highly individualized process, in which a Board must consider all pertinent information presented to it. ”

“ It means that the courts are not to weigh the evidence to determine whether the classification made by the local boards was justified. The decisions of the local boards made in conformity with the regulations are final even though they may be erroneous. The question of jurisdiction of the local board is reached only if there is no basis in fact for the classification which it gave the registrant. ”

“ REGISTRATION WITH THE BOARD. (a) MANDATORY REGISTRATION— Beginning 180 days after the date of the determination of the Commission under section 101 (d) , it shall be unlawful for any person that is not a registered public accounting firm to prepare or issue, or to participate in the preparation or issuance of, any audit report with respect to any issuer. (b) APPLICATIONS FOR REGISTRATION— (1) FORM OF APPLICATION— A public accounting firm shall use such form as the Board may prescribe, by rule, to apply for registration under this section. ”

“ Registry under a particular name may be refused if in the opinion of the registrar the name is likely to deceive the members or the public as to the nature of the society or as to its identity. It is the duty of the chief registrar, among other things, to require from every society a return in proper form each year of its receipts and expenditure, funds and effects; and also once every five years a valuation of its assets and liabilities. ”

“ That every rector, vicar, curate, and every registrar, registering officer, and secretary, who shall have the keeping, for the time being, of any register book of births, deaths, or marriages, shall at all reasonable times allow searches to be made of any register book in his keeping, and shall give a copy, certified under his hand, of any entry or entries in the same, on payment of the fee hereinafter mentioned; that is to say, for every search extending over a period not more than one year, the sum of 1s., and 6d. ”

“ If there are encumbrances, the register states their amount and who are entitled to them. The purchaser then usually [1] prepares a conveyance or transfer of the land (generally in a short printed form issued by the registry) , and the vendor executes it in exchange for the purchase money. If there are mortgages, he pays them off to the persons named in the register as their owners, and they concur in a discharge. He then presents the executed instruments at the registry, and is entered as owner of the land instead of the vendor, the mortgages, if any, being cancelled. ”

“ Third. Petitioners contend that, standing by themselves, sections 4 (a) and 5 transgress constitutional restrictions. These sections have three parts. Section 5 (a) provides for the filing of a notification of registration. Section 5 (b) makes it the duty of every registered holding company to file a registration statement, with documents and certain detailed information, within a reasonable time after registration. ”

“ Any person aggrieved by the absence or omission from the register of any entry, or by any entry made in the register without sufficient cause, or by any entry wrongly remaining on the register, or by any error or defect in any entry in the register, may apply in the prescribed manner to the Appellate Board or to the Registrar, and the tribunal may make such order for making, expunging or varying the entry as it may think fit. ”

“ Registration of title has lately been introduced, on a voluntary basis, into the states of California, Oregon, Illinois, Massachusetts, Minnesota and Colorado, and also into Hawaii and the Philippines.
France.—In France registration of deeds is universal. Sales, mortgages, gifts and successions; easements, leases of over eighteen years, and transactions affecting the land to the extent of three years’ rent may lose priority if not registered. Wills need not be registered. Mortgages must be re-registered every ten years. Purchase deeds are registered by filing full copies. ”

“ The certificates are only evidence of the ownership of the shares, and the interest represented by the shares is held by the company for the benefit of the true owner. As the habitation or domicil of the company is and must be in the state that created it, the property represented by its certificates of stock may be deemed to be held by the company within the state whose creature it is, whenever it is sought by suit to determine who is its real owner. ”

“ The principle next in importance prescribes that registration per se and alone shall give validity to transactions affecting land. Deposit of duplicate of the instrument, together with the record of the transaction by memorandum entered in the book of registration and endorsed on the grant by the Registrar-General, to constitute registration. This method is designed to give confidence and security to purchasers and mortgagees, through the certainty that nothing affecting the title can have existence beyond the transactions of which they have notice in the memoranda endorsed on the grant. ”

“ And be it further enacted, That if any person shall apply to any register of any land office to enter any land whatever, and the said register shall knowingly and falsely inform the person so applying that the same has already been entered, and refuse to permit the person so applying to enter the same, such register shall be liable therefor to the person so applying, for five dollars for each acre of land which the person so applying offered to enter, to be recovered by action of debt in any court of record having jurisdiction of the amount. ”

“ There's more trouble than all this in transferring Copy-hold Estates, and yet we don't hear much Complaint about them Men are seldom in such hast about laying out their Money, or at least their Lawyers are not so violent in dispatch of their Business, but they may dispense with the Ceremony of a Registry, to prevent the loss of their Estates.
Festina Lente is the Conveyancers Motto, and therefore they advise their Clients not to hurry them, nor put them out of their own pace; they must think nothing troublesome but the Entering the Deed in a Registry. ”

“ Registration laws are of statutory origin, and the statute must in each case be examined to determine what instruments are to be recorded, where they are to be recorded, and the effect of a failure to record. ”

“ LAND REGISTRATION, a legal process connected with the transfer of landed property, comprising two forms—registration of deeds and registration of title, which may be best described as a species of machinery for assisting a purchaser or mortgagee in his inquiries as to his vendor’s or mortgagor’s title previously to completing his dealing, and for securing his own position afterwards. ”

“ If two or more persons shall apply at the same time for the same tract, the register shall immediately determine by lot, in the presence of the parties, which of them shall have preference. He shall file the receipt for monies produced by the party, and give him a copy of his entry, and if required, a copy of the description of the tract, and a copy of the plat of the same, or either of them ”

“ But why of all troubles the trouble of a Registry should be only grievous, I can't tell, unless because it puts an End to Strife: Is it such a mighty trouble for an Attorneys Clerk, when he is to enter up a Judgment, to step into the Registry and leave an Entry made of it? and is it such a great trouble for a Man when he has sealed a Deed to go to the Register to acknowledge it? ”

“ The transaction of business by the corporation in the state, general or special, appearing, a certificate of service by the proper officer on a person who is its agent there would, in our opinion, be sufficient prima facie evidence that the agent represented the company in the business. It would then be open, when the record is offered as evidence in another state, to show that the agent stood in no representative character to the company, that his duties were limited to those of a subordinate employe, or to a particular transaction, or that his agency had ceased when the matter in suit arose. ”

“ The register of the land office keeps a record of all entries and surveys; and on his official certificates patents are issued by the government. His records are always under his control; and all entries made in them are made by himself, or by a person authorised to act for him. ”

“ The usual method is to write the draft and register it in a draft record book. Then the necessary record is made on the collection card. A draft register is used that there may be a record showing the aggregate of drafts outstanding, and the number and amount in the hands of each bank—where drafts are sent direct, instead of through a local bank. The next step is to write a letter of advice to the bank. This method necessitates writing the names of the bank, the drawee, and the amount of the draft three times—on the draft, letter of advice, and draft register. ”

“ In the case where the registered member is not the beneficial owner, the company should be required to record, not in the register, but in another book, the nationality of the beneficial owner as disclosed by the declaration, and, as regards the latter book, to record the nationality of any new beneficial owner when and as disclosed by the registered member. ”

“ The Registrar or any officer of the Trade Marks Registry shall not, in any legal proceedings to which he is not a party, be compellable to produce the register or any other document in his custody, the contents of which can be proved by the production of a certified copy issued under this Act or to appear as a witness to prove the matters therein recorded unless by order of the court made for special cause.
