“ Section 18. When, during a recess of the General Assembly, a vacancy shall happen in any office, the appointment to which is vested in the General Assembly; or when, at any time, a vacancy shall have occurred in any other State office, or in the office of Judge of any Court; the Governor shall fill such vacancy, by appointment, which shall expire, when a successor shall have been elected and qualified. ”

“ In pursuance of the provisions of section 2 of the civil-service act, whenever a vacancy occurs in any position which has been or may hereafter be classified under the civil-service act, and which is not an excepted position, the filling of said vacancy, unless filled through noncompetitive examination or by reinstatement, transfer, promotion, or reduction, shall be governed as follows:
1. ”

“ When a vacancy happens in the Legislative Council of Quebec, by resignation, death, or otherwise, the Lieutenant Governor, in the Queen's name, by instrument under the Great Seal of Quebec, shall appoint a fit and qualified person to fill the vacancy. ”

“ The more you thin out your woodland, the taller and stouter will be your timber. The only hope for this people is a scarcity of laborers. There are so many who must have work, or die, that every vacancy has a dozen ready applicants. ”

“ The chairman and one society shall be elected in alternate years with the secretary and two societies. If through death, resignation, or otherwise, a vacancy should occur in the case of an ordinary member, his society shall fill up the vacancy, and in the case of an official the committee shall have the power to fill up the vacancy from their own number, subject to the approval of the following general meeting. ”

“ An easy dismission to a secure seat at the board of customs or excise was promised on the first vacancy: but the chance was distant and doubtful; nor could I solicit with much ardour an ignoble servitude, which would have robbed me of the most valuable of my studious hours: at the same time the tumult of London, and the attendance on parliament, were grown more irksome; and, without some additional income, I could not long or prudently maintain the style of expence to which I was accustomed. ”

“ A vacancy occurring in the lowest grade of any group of offices shall be filled, after due public notice, from all applicants who shall present themselves, and who shall have furnished the evidence and satisfied the preliminary examination already mentioned, and who shall have passed a public competitive examination to test knowledge, ability, and special qualifications for the performance of the duties of the office. ”

“ The appointment to a vacancy is then sold to the highest bidder, who is generally a near relation, provided his property is sufficient to bid up to the mark. All the inferior offices in the towns of the provinces are sold in like manner by the governors, who also succeed to the property of those petty officers at their death or removal. ”

“ It takes cognizance of the fact that it is impossible for the head of a Department or a large office personally to know all the applicants, and therefore it provides a method by which, when a vacancy occurs by death, by resignation, by the unlimited power of removal, a suitable person may be designated to fill the vacancy. ”

“ The employee who has failed leaves, is dismissed, or is transferred to another department, and a new and equally inexperienced worker employed to fill the vacancy, with the whole cost of training to be incurred over again. Even though the new worker may be 5experienced in the particular class of work to be done, there is an appreciable loss due to the unavoidable frictions and hesitations that occur whenever a worker is being fitted into a new environment. ”

“ When they are of a certain age, and attain a particular height in their office, they become superannuated, and retire; for, should a vacancy occur, of a higher standing in the public secretariat, it is not given to them—although the training of their whole life may peculiarly fit them for the post! ”

“ And be it further enacted, That in case of a vacancy in either branch of the said corporation, by death, removal, or otherwise, of either of the members, a fit person or persons qualified, as aforesaid, shall be elected by the people, in the manner aforesaid, to fill such vacancy immediately thereafter ”

“ You should feel flattered that your division had a chance to fill the vacancy. You should rejoice in the advancement of your faithful subordinate. Some divisions, like some officials, are known the country over as developers of talent. ”

“ To the back doors of those houses come respectable servants from the neighbourhood, just to ask whether there is no chance of a vacancy, and to petition that, if there should be one, they should be sent for, that they might “really settle,” which they find it so difficult to do. In the same neighbourhood, there may be a house or two, where the mistress complains that she has no peace, because “now-a-days no servant will stay.” She hires at a distance that the reputation of her service may not deter applicants; and she has no choice, for she cannot get a servant where she is known. ”

“ Persons formerly employed by a state agency have no special entitlement to
resume their employment. All employment decisions will be based on the needs
of the agency. Prior employment with the agency may be a factor in deciding to
rehire a former employee to fill a vacancy. ”

“ Such a place as I had, for instance, for many years, but, like everything else nowadays, there are only a very limited number of these positions, while there are scores of applicants for them, and for every vacancy to be filled there are generally one or two who have very strong backing, and there is little chance for the outsider. Others have often pointed out to me that after a certain number of years they will be entitled to a benefit. ”

“ Whenever a vacancy occurs, one of those who have received a degree is taken by lot from the few senior names. But a few years since, there were five thousand of the highest rank, and twenty-seven thousand of the second rank, who had not received employment. ”

“ They receive from the farmer a house and a quantity of land, nearly sufficient to maintain a family, in return for which they are under an obligation of working for him at a low price, whenever they are called upon. “ Vacancies.— ‘‘In the case of a covered individual who is removed or demoted under subsection (a) , to the maximum extent feasible, the Secretary shall fill the vacancy arising as a result of such removal or demotion. ‘‘ (h) Definitions.— ‘‘In this section: ‘‘ (1) The term ‘covered individual’ means an individual occupying a position at the Department, but does not include— ‘‘ (A) an individual occupying a senior executive position (as defined in section 713 (d) of this title) ”

“ The number of vacancies created within a given time depends obviously upon the number of removals throughout the whole body of clerks, by promotion, resignation, or death, thus causing vacancies in the lowest classes, to be filled up by the appointment of strangers to the establishment. ”

“ If a due participation of office is a matter of right, how are vacancies to be obtained? Those by death are few; by resignation none. ”

“ The doctrine of tenure applied universally to the land law formed the basis for judicial procedure in determining land rights. Those who held lands "in fee" from the King in turn subinfeudated their land to men of lesser rank. The concept of tenure covered the earl, the knight (knight's service) , the church (frank-almoin [free alms] ) , the tenant who performed labor services, and the tenant who paid a rent (socage) . Other tenures were: serjeanty [providing an implement of war or performing a nonmilitary office] and burgage. All hold the land of some lord and ultimately of the King. ”

“ A tenure of thirty years is evidently no tenure upon which to build, to plant, to raise inclosures, to change the nature of the ground, to make any new experiment which might improve agriculture, or to do anything more than what may answer the immediate and momentary calls of rent to the landlord, and leave subsistence to the tenant and his family. ”

“ Beneath whom, there will again be the landlords, resident each in his own district; under these, the land agents, tenantry, tradesmen, and hired labourers, some of whom will be Companions, others Retainers, and others free tenants: and outside all this there will be of course an irregular cavalry, so to speak, of more or less helpful friends, who, without sharing in the work, will be glad to further it more or less, as they would any other benevolent institution.
The law that a Companion shall derive no profit from his companionship does not touch the results of his own work. ”

“ A good position, or a profitable situation, should give one a chance to make himself comfortable for life. The tenant of the dairy-farm will have to leave next spring or, at the latest, in the fall, and I think you ought to manage it with the queen and the rest of them, so that your husband should get the position, and then you could be here all your life and you and yours would be well provided for. ”

“ If you are thoroughly in earnest, you will not hesitate to give your assistance to those who may be appointed to fill the vacancies created by your voluntary withdrawal from the positions to which you have been commissioned. ”

“ Inasmuch as every live organization is always growing and, therefore, taking on new employees, and inasmuch, also, as there is a state of flux in every organization, vacancies occurring for one reason or another, it is a function of the employment department to secure as many of the most desirable applicants possible for all of the positions in the enterprise. ”

“ I was born upon an estate where the life tenure was the custom, and I found that in many cases men put their children's lives on a house, and some day or other they found themselves deprived of both children and property. In other cases the lives of sailors were on, and after a time there was great doubt whether the lives were in existence or not, and generally a great deal of misery was the result of this life tenure. ”

“ The principal effect of introducing settlement by service has been to put out in a great measure the old fashion of hiring for a year, which before had been so customary in England, that even at this day, if no particular term is agreed upon, the law intends that every servant is hired for a year. ”

“ When long-continued destitution has been carried on to the bitter end, when piece by piece every article of domestic furniture has been sold or pawned, when all efforts to procure employment have failed, and when you have nothing left except the clothes in which you stand, then you can present yourself before the relieving officer and secure your lodging in the workhouse, the administration of which varies infinitely according to the disposition of the Board of Guardians under whose control it happens to be. ”

“ In spite of the smaller pay the first men on the list have usually selected the home service, because the life is more agreeable; and so far as the vacancies make it possible they are assigned to the particular department they prefer. ”

“ This rise of the free labourer following naturally on the enfranchisement of the serf had made it necessary for the landlord to rely on hired labour, and just when it was most essential for them to have an abundant supply of hands seeking employment, all at once the supply absolutely and entirely failed. ”

“ Concerning Fugitives, It is Enacted by the same Authority, that every Apprentice and Servant that shall depart and absent themselves from their Master and Dames, without leave first obtained, shall be judged by the Court to double the Time of such their Absence, by future Service over and above other Damages and costs which Master and Dame shall sustain by such unlawful Departure. ”

“ It also holds before them a reward for activity, intelligence, and good conduct; because the vacancies in the list of preferable labourers, which occur during the year, are invariably filled in the succeeding January by selecting, upon strict inquiry, the best of the extra-ticket labourers, the vacancies among the permanent men being supplied in like manner from the list of preferable labourers, while from the permanent men are appointed the subordinate officers, as markers, samplers, &c. ”

“ For a "lodger's" vote a twelve month's occupation of a separate room, with an annual rental, unfurnished, of £10, or, furnished, of 5/ per week, is necessary, The "service" vote is given to an occupier who occupies by virtue of his service, and does not apply to servants living in the employer's house. ”
