“ DETAILS OF PERSONNEL.— The head of any Federal department or agency may detail on a reimbursable basis, or on a nonreimbursable basis for not to exceed 180 calendar days during any fiscal year, as agreed upon by the Director and the head of the Federal agency, any of the personnel of that department or agency to the Commission to assist the Commission in carrying out the duties of the Commission under this Act. Any detail shall not interrupt or otherwise affect the civil service status or privileges of the Federal employee. ”

“ It is a priority of my Administration to ensure that the Federal Government, as the Nation’s largest employer, serves as a model employer by encouraging and facilitating Federal employees’ civic participation. ”

“ Sec. 4. Managing the Federal Workforce. To promote good morale in the Federal workforce, employee accountability, and high performance, and to ensure the effective and efficient accomplishment of agency missions and the efficiency of the Federal service, to the extent consistent with law, no agency shall:
(a) subject to grievance procedures or binding arbitration disputes concerning:
the assignment of ratings of record; orthe award of any form of incentive pay, including cash awards; quality step increases ”

“ To ensure that Federal resources are used effectively and efficiently and in a manner consistent with both the public interest and section 8 of this order, all employees shall adhere to the following requirements:
Employees may not engage in lobbying activities during paid time, except in their official capacities as an employee. ”

“ Within six months of the effective date of this order the Secretary of Labor and the Administrator of the General Services Administration shall initiate a study of conflicts that may exist in their standards and other requirements affecting Federal employee safety and health, and shall establish a procedure for resolving conflicting standards for space leased by the General Services Administration.
1–602. In order to assist the agencies in carrying out their duties under Section 19 of the Act and this order the Administrator shall:
1–7. General Provisions. 1–701. ”

“ RESPONSIBILITY FOR EMPLOYER CONTRIBUTION.—Beginning on the date described in paragraph (4) , the State shall be treated as the employing agency with respect to the benefits described in subparagraph (A) which are provided to an individual who, for purposes of receiving such benefits, is continued to be treated as an employee of the Federal Government under such subparagraph. ”

“ To appoint by its board of directors such officers and employees as are not otherwise provided for in this section, to define their duties, fix their compensation, require bonds of them and fix the penalty thereof, and to dismiss at pleasure such officers or employees. Nothing in this or any other Act shall be construed to prevent the appointment and compensation as an officer or employee of the Corporation of any officer or employee of the United States in any board, commission, independent establishment, or executive department thereof. ”

“ This year, as we commemorate the Bicentennial of our Constitution, it is especially fitting that we honor our Nation's more than three million Federal employees. Their dedication to public service and their devotion to their country, sometimes under trying circumstances, have helped ensure the success of the greatest experiment in liberty the world has ever known-the United States of America.
Our Federal employees are skilled public servants who work diligently every day to build a better America. Many of them are our friends, neighbors, and community leaders. ”

“ Congress has directed that if the case is within the federal statute, the employer shall be relieved of all other obligation. But in order to relieve the employee in a doubtful case of the necessity of filing two claims, one under each act, a double burden is imposed on the employer by an inadmissible construction of the federal act. The dual system of presumptions, which are to operate in favor of the employee but apparently never against him, will serve to sustain an exercise of either state or federal jurisdiction in every case within the so-called 'twilight zone'. ”

“ Section 1. Purpose. An effective and efficient government keeps careful track of how it spends the taxpayers’ money and eliminates unnecessary, inefficient, or unreasonable expenditures. To advance this policy, executive branch employees should spend their duty hours performing the work of the Federal Government and serving the public. Federal law allows Federal employees to represent labor organizations and perform other non-agency business while being paid by American taxpayers (taxpayer-funded union time) . ”

“ The provisions of the Executive Order of January 17, 1873, prohibiting federal employees from holding office under any state, territorial or municipal government, are hereby waived to permit Honorable. ”

“ Whatever differences there may be between administrative employees of the Government and industrial workers in its employ are differences in detail so far as the constitutional power under review is concerned. Whether there are such differences and what weight to attach to them, are all matters of detail for Congress. We do not know whether the number of federal employees will expand or contract; whether the need for regulation of their political activities will increase or diminish. The use of the constitutional power of regulation is for Congress, not for the courts. ”

“ The Office of Personnel Management is hereby designated and empowered to exercise the authority of the President under section 302 (c) (1) (D) of the Federal Employees Pay Comparability Act of 1990, as incorporated in section 529 of Public Law 101-509, to extend the application of interim geographic adjustments shown on Schedule 9, upon the request of an agency head, to employees who would not otherwise be covered. ”

“ Federal employees and their union representatives are an essential source of front-line ideas and information about the realities of delivering Government services to the American people. A nonadversarial forum for managers, employees, and employees' union representatives to discuss Government operations will promote satisfactory labor relations and improve the productivity and effectiveness of the Federal Government. ”

“ For purposes of this order:
“Federal employees” and “Federal contractors” mean employees (including members of the Armed Forces and members of the National Guard in Federal service) and contractors (including such contractors’ employees) working for the executive branch;“Federal buildings” means buildings, or office space within buildings, owned, rented, or leased by the executive branch of which a substantial portion of occupants are Federal employees or Federal contractors; and“Federal lands” means lands under executive branch control. ”

“ This provision, however, is unnecessary in § 633a because, as I have explained, the ADEA contains no requirement for federal employees equivalent to Title VII's command that a complainant first seek administrative relief. ”

“ Review policies and programs for Federal employees who may be displaced by productivity improvements and make or recommend such changes as are appropriate to ensure that such policies and programs will minimize any adverse impact on Federal employees. ”

“ A loan or extension of credit to a director officer, clerk, or other employee or any representative of any such affiliate shall be deemed a loan to the affiliate to the extent that the proceeds of such loan are used for the benefit of, or transferred to, the affiliate. ”

“ The dedication of Federal employees is typified by the many handicapped Federal workers who have courageously risen above personal hardships to give of themselves to their country. That dedication is also personified by the men and women of the Senior Executive Service who through effort, leadership, and imagination distinguish themselves in service to the American people. ”

“ There is therefore no basis from which to infer that a complainant who has voluntarily sought administrative relief must exhaust all administrative remedies before proceeding to court. The Equal Employment Opportunity Commission, charged with interpretation of the ADEA, does not read the statute to require exhaustion by federal employees. ”

“ It is the policy of the executive branch in procuring goods and services that, to ensure the economical and efficient administration and completion of Federal Government contracts, contracting agencies shall not contract with employers that permanently replace lawfully striking employees. ”

“ The accountable individual may be granted relief if certain conditions are met. (SOURCE - DOS/ USAID, FAH, 4 FAH-3 H-392) accountable officer - Any U.S. Government officer or employee who by reason of his or her employment is responsible for or has custody of U.S. Government funds. An accountable officer is personally liable to the U.S. Government for any loss of the funds in his or her charge, regardless of fault, unless relief is granted or the loss is recovered. ”

“ So, in the case of appointing officers, if it can be truly said that these heads of departments are the servants of the President alone, we shall make the executive department a dangerous one.
I do not admit that any man has an estate in his office. I conceive all officers to be appointed during pleasure, except where the Constitution stipulates for a different tenure—unless, indeed, the law should create the office, or officer, for a term of years. After observing this, I must contend that the power of removal is incidental to the power of appointment. ”

“ That the members of the first branch of the national legislature ought to be elected by the people of the several States, for the term of three years, to receive fixed stipends, by which they may be compensated for the devotion of their time to public service, to be paid out of the national treasury, to be ineligible to any office established by a particular State, or under the authority of the United States, except those particularly belonging to the functions of the first branch, during the term of service, and under the national government, for the space of one year after its expiration. ”

“ Officers and employees elected or appointed to offices requiring full-time service shall resign their positions with the Federal Government. If elected or appointed to offices requiring only part-time service, they may accept and hold same without relinquishing their Federal employment, provided the holding of such part-time office does not conflict or interfere with their official duties as officers or employees of the Federal Government. ”

“ In an era of decentralization of Federal human resources management, it is increasingly important to ensure that merit system principles are applied consistently across the Federal Government and that the Executive branch has the ability to collect information about its workforce. The President and the public need to be assured that Federal agencies are monitoring the exercise of all human resources management authorities that have been delegated to them. ”

“ The legislature must always have a discretionary power of appointing officers, not expressly known to the Constitution, and this power will include that of authorizing the federal government to make the appointments in cases where the general welfare may require it. ”

“ BY VIRTUE Of the authority vested in me under Title II of the National Industrial Recovery Act of June 16, 1933 (Public No. 67, 73d Congress) , and for the purpose of increasing employment quickly:
(1) ⁠ I hereby establish a Federal Civil Works Administration, and appoint as Administrator thereof the Federal Emergency Relief. ”

“ CIVIL-SERVICE REFORM IN THE UNITED STATES. "The question as to the Civil Service [in the United States] arises from the fact that the president has the power of appointing a vast number of petty officials, chiefly postmasters and officials concerned with the collection of the federal revenue. Such officials have properly nothing to do with politics, they are simply the agents or clerks or servants of the national government in conducting its business ”

“ With respect to national policies administered by the States, the national government should grant the States the maximum administrative discretion possible. Intrusive, Federal oversight of State administration is neither necessary nor desirable.
(d) When undertaking to formulate and implement policies that have federalism implications, Executive departments and agencies shall:
(1) Encourage States to develop their own policies to achieve program objectives and to work with appropriate officials in other States. ”

“ The Constitution declares the tenure of the officers it recognizes, and says one class of them shall hold their offices during good behavior; they are the judges of your Supreme and other courts; but as to any other officer being established on this firm tenure, the Constitution is silent. It, then, necessarily follows that we must consider every other according to its nature, and regulate it in a corresponding manner. The business of the secretary of foreign affairs is of an executive nature, and must consequently be attached to the executive department. ”

“ The head of each department and agency of the Government shall be responsible for establishing and maintaining within his department or agency an effective program to insure that the employment and retention in employment of any civilian officer or employee within the department or agency is clearly consistent with the interests of the national security. ”
